HomeMy WebLinkAboutOrdinance 14675 ORDINANCE NO. ~~1 y AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, APPROVING: (1) RESOLUTION NO. 97-11-319 ADOPTED BY THE DALLAS-FORT WORTH INTERNATIONAL AIRPORT BOARD ON NOVEMBER 6, 1997 WHICH AMENDS THE 1988 REVISED CODE OF RULES AND REGULATIONS OF THE DALLAS-FORT WORTH INTERNATIONAL AIRPORT BOARD (ADOPTED BY RESOLUTION NO. 88-111) AS AMENDED, TO CONSOLIDATE CHAPTERS 4 AND 5, RENUMBER THE REMAINDER OF THE CHAPTERS, ESTABLISH A REQUIREMENT THAT COURTESY VEHICLES OF OFF-AIRPORT RENTAL COMPANIES PICK UP AND DROP OFF PEOPLE AT DESIGNATED POINTS IN THE CONSOLIDATED RENTAL CAR FACILITY; (2) RESOLUTION NO. 2001-01-17, ADOPTED BY THE DALLAS-FORT WORTH INTERNATIONAL AIRPORT BOARD ON JANUARY 4, 2001, WHICH AMENDS THE 1988 REVISED CODE OF RULES AND REGULATIONS OF THE DALLAS-FORT WORTH INTERNATIONAL AIRPORT BOARD (ADOPTED BY RESOLUTION NO. 88-111), AS AMENDED, TO DEFINE TERMS; TO PROVIDE PARKING REGULATIONS AT THE AIRPORT AND TO ESTABLISH ADMINISTRATIVE ADJUDICATION PROCEDURES AND CIVIL PENALTIES FOR PARKING VIOLATIONS; TO REGULATE PICKETING, SOLICATIONS, AND OTHER PERSONAL CONDUCT AT THE AIRPORT; TO ESTABLISH BADGE HOLDER RESPONSIBILITIES AND CORRESPONDING OFFENSES IN ACCORDANCE WITH THE AIRPORT SECURITY PLAN AND FEDERAL AVIATION REGULATION 107; TO PROVIDE LICENSING, INSURANCE, AND OPERATIONAL REQUIREMENTS AND PROCEDURES FOR GROUND TRANSPORTATION SERVICES AT THE AIRPORT; TO ESTABLISH QUALIFICATIONS AND " DRESS CODES FOR DRIVERS OF VEHICLES FOR HIRE AT THE . ~ AIRPORT AND TO REQUIRE THEM TO ACCEPT PAYMENT OF FARES BY CREDIT CARD; TO PROVIDE STANDARDS AND REQUIREMENTS FOR VEHICLES FOR HIRE AT THE AIRPORT; TO ESTABLISH STANDARDS, SPEED LIMITS, AND OFFENSES FOR OPERATING ON THE AIR OPERATIONS AREAS AND THE AIRCRAFT RESCUE AND FIREFIGHTING SERVICE ROADS; TO ESTABLISH SPEED LIMITS ON CERTAIN PUBLIC ROADS IN THE AIRPORT; AND TO MAKE CERTAIN SEMANTIC, GRAMMATICAL, AND STRUCTURAL CHANGES; (3) RESOLUTION NO. 2001-01-42, ADOPTED BY THE DALLAS-FORT WORTH INTERNATIONAL AIRPORT BOARD ON JANUARY 19, 2001, WHICH AMENDS CHAPTER 3 OF THE 1988 REVISED CODE OF RULES AND REGULATIONS OF THE DALLAS-FORT WORTH INTERNATIONAL AIRPORT BOARD (ADOPTED BY RESOLUTION NO. 88-111), AS AMENDED, TO REVISE THE DEFINITION OF "PICKETING"; (4) RESOLUTION NO. 2001-02-54, ADOPTED BY THE DALLAS-FORT WORTH INTERNATIONAL AIRPORT BOARD ON FEBRUARY 1, 2001, WHICH AMENDS THE 1988 REVISED CODE OF RULES AND REGULATIONS OF THE DALLAS-FORT WORTH INTERNATIONAL AIRPORT BOARD (ADOPTED BY RESOLUTION NO. 88-111), AS AMENDED, TO REVISE CHAPTER 4 FOR INCENTIVE FARES AND FLAT RATES; (5) RESOLUTION NO. 2001-OS-78, ADOPTED BY THE DALLAS-FORT WORTH INTERNATIONAL AIRPORT BOARD ON MAY 3, 2001, WHICH AMENDS CHAPTERS 1, 4, AND 10 AND APPENDIX I OF THE 1988 REVISED CODE OF RULES AND REGULATIONS OF THE DALLAS-FORT WORTH INTERNATIONAL AIRPORT BOARD (ADOPTED BY RESOULUTION NO. 88-111), AS AMENDED, TO CLARIFY THE SCOPE OF THE RULES AND REGULATIONS; TO PROVIDE MILEAGE AND CONDITION RESTRICTIONS ON VEHICLES PUT INTO SERVICE AS TAXICABS AT THE AIRPORT; AND TO INCREASE PENALTIES FOR VIOLATIONS OF THE RULES AND REGULATIONS; AND (6) RESOLUTION NO. 2001-06- 219 ADOPTED BY THE DALLAS -FORT WORTH INTERNATIONAL AIRPORT BOARD ON JUNE 7, 2001, WHICH AMENDS THE 1988 REVISED CODE OF RULES AND REGULATIONS OF THE DALLAS-FORT WORTH INTERNATIONAL AIRPORT BOARD (ADOPTED BY RESOLUTION NO. 88-111), AS AMENDED, TO AMEND THE SCHEDULE OF CHARGES TO INCREASE THE TAXICAB/LOADING FEE BY $1.00; PROVIDING A PENALTY NOT TO EXCEED $2,000; PROVIDING A SAVING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Section 8.F of the 1968 Contract and Agreement, as amended, between the City of Fort Worth, Texas and the City of Dallas, Texas, provides that the Dallas-Fort Worth International Airport Board shall have the power, by a duly adopted order, to adopt and enforce rules and regulations for the orderly, safe, efficient, and sanitary operation of the airport and to prescribe reasonable penalties for the breach of any rule or regulation not to exceed the maximum fines authorized by state law; and WHEREAS, Section 22.082 of the Texas Transportation Code, as amended, and Section 8.F of the 1968 Contract and Agreement, as amended, provide that such orders by the Dallas-Fort Worth International Airport Board will become effective only upon approval of the governing bodies of the cities of Fort Worth and Dallas and proper publications, and WHEREAS, pursuant to the foregoing, the Dallas-Fort Worth International Airport Board, on May 3, 1988, approved, and ordered Resolution No 88-111, adopting the 1988 Revised Code of Rules and Regulations of the Dallas-Fort Worth International Airport Board, which regulates traffic, travel, and conduct within the Dallas-Fort Worth International Airport and establishes certain procedures for the adoption of additional rules, regulations, and orders, and WHEREAS, in accordance with Section 3 of Chapter Ten of the 1988 Revised Code of Rules and Regulations of the Dallas-Fort Worth International Airport Board, the a,~rport board has requested that the city councils of the cities of Fort Worth and Dallas approve its Resolutions Nos. 97-11-319, 200.1-01-17, 2001-01-42, 2001-02-54, 2001-OS-78, and 2001-06-219 in order that they may become effective as stated by law and in the code of the airport board, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That all of the declarations and findings contasned m the preambles of this ordinance are made a part hereof and will be fully effective as a part of the ordained subject matter of this ordinance. SECTION 2 That Resolutions Nos. 97-11-319, 2001-01-17, 2001-01-42 2001-02-54, 2001-OS-78 and 2001-06-219 of the Dallas-Fort Worth International Airport Board, copies of which are attached hereto as Exhibit A and made a part of this ordinance by reference, are hereby approved, except that any conflict between the wording of anearlier-enacted Resolution (of those six Resolutions) and alater-enacted Resolution (of those six Resolutions) shall be resolved m favor of the later-enacted Resolution, deleting the earlier-enacted language which is in conflict, and, thus amending the Code of Rules and Regulations of the Dallas- Fort Worth International Airport Board. SECTION 3 That after publication of a substantive statement relating to the contents of Resolutions Nos. 97-11-319, 2001-01-17, 2001-01-42, 2001-02-54, 2001-OS-78, and 2001-06-219 (with conflicting language deleted) of the Dallas-Fort Worth International Airport Board in a newspaper of general circulation in each of the counties of Dallas and Tarrant, stating that a breach of any provision of the Resolutions will subject the violator to a penalty, and stating that the text of the Resolutions will thereafter have the same force and effect within the boundaries of the Dallas-Fort Worth International Airport as an ordinance by the city council of the city of Fort Worth would have in the city of Fort Worth, the penalty will be enforced in the same manner in which penalties prescribed by other ordinances of the city of Fort Worth is enforced. SECTION 5. That the phrases, clauses, sentences, paragraphs and sections of this ordinance and Resolutions Nos. 97-11-319, 2001-01-17, 2001-01-42, 2001-02-54, 2001-OS-78, and 2001-06-219 are severable, and if any phrase, clause, sentence, paragraph, or section is declared unconstitutional or invalid by the valid judgment or decree of any court of competent ~unsdiction, the unconstitutionality or invalidity will not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this ordinance or those Resolutions since the same would have been enacted without the incorporation of any unconstitutional phrase, clause, sentence, paragraph, or section. SECTION 6 That this ordinance will take effect immediately from and after its passage and publication in accordance with the provisions of the Charter of the City of Fort Worth and rt is accordingly so ordained. Description: This action will approve amendments to Chapters 1, 2, 3, 4, and 5 of the Code of Rules and Regulations of the Dallas/Fort Worth International Airport Board to - Codify the requirements contained in the Ground Transportation Service Enhancement Plan, which was approved by the Board on Tune 3, 1999 - Establish an administrative adjudication hearing procedure under which a civil fine maybe imposed - Prohibits picketing inside Airport terminals - Establish badge holder responsibilities and corresponding offenses in accordance with the Airport Security Plan and FAR 107 - Establish standards, corresponding offenses, and speed limits for operating on the Air Operations Areas and the ARFF service roads • The amendments to the Code of Rules and Regulations of the Dallas/Fort Worth International Airport Board also contain amendments that were approved by the Board in November 1997 The November 1997 amendments were not presented to the Dallas and Fort Worth City Councils for approval and were therefore never enacted. The following changes were made to the Code of Rules and Regulations of the Dallas/Fort Worth International Airport Board m November 1997 - Consolidated Chapter 4 and 5 into a single chapter - As a result of the consolidation of Chapter 4 and 5, the numbering of the remainder of the Chapters changed accordingly - Established requirement that Courtesy Vehicles picking up and dropping off persons at the Aii~'ort on behalf of an Off-Airport Rental Car Company to pick up and drop off such persons only at the Consolidated Rental Car Facility and at such point or points therein as established by the Administrator Justification• • The revisions to the Code of Rules and Regulations of the Dallas/Fort Worth International Airport Board are necessary to facilitate improvement to the quality of commercial ground transportation services offered at the Airport, reinforce commercial ground transportation company accountability for driver actions, control terminal curb congestion and to establish an administrative adJudication hearing procedure for parking violations. • This action meets the Board's Strategic Imperative of creating a positive, competitive, and safe environment for the Airport's employees, tenants, and traveling public at large.----_-- Additional Information: Per State law and the 1968 Contract and Agreement, these amendments will also need to be approved by the Dallas and Fort Worth City Councils and will become effective upon such approval being obtained. That the Airport Board approve revisions to recently-approved Amendments to Chapter 3 of the Code of Rules and Regulations of the Dallas/Fort Worth.International Airport Board. Description • This action will approve the attached revision to the definition of "picketing" contained in the. amendment to Chapter 3 of the Code of Rules and Regulations approved by the Board on January 4, 2001 • The pxoposed revision is as follows (language in bold is added) Picketing is defined as the stationing, parading, patrolling and/or assembling of a person or persons outside a business or place of employment, or inside an Airport terminal building, to express grievance against or to protest the practices of a tenant, subtenant, or other occupant, or to discourage entry thereto by non-striking workers or by customers. Justification • As part of the Amendments to the DFW Airport Code of Rules and Regulations approved by the Board on January 4, 2001, "picketing" would be prohibited inside Airport terminal buildings. That prohibition and the revised definition of picketing serve to protect the health, safety, and welfare of Airport patrons by reducing impairments to the free and efficient passage of persons in Airport terminal buildings, while leaving ample alternative venues for picketing as an expressive activity • Tlus action meets the Board's Strategic Imperative of creating a positive, competitive and safe environment for the Airport's employees, tenants, and traveling public. That the Airport Board approve revisions to the recently-approved Amendments to Chapters 4 of the Code of Rules and Regulations of the Dallas/Fort Worth International Airport Board. Description• • This action will approve the attached xevisions to Chapters 4 of the Code of Rules and Regulations of the DallaslFort Worth International Airport Board (Code) that were appxoved by the Board on January 4, 2001 • The proposed revisions to Chapter 4, Section 6-1, subsection II.A of the Code will add a flat rate fare of $43 00 from the Airport to the Fort Worth Central Business District and from the Fort Worth Central Business District to the Airport.
