i ~' _ .~..; 'Rf~ - ORDINANCE NO. l ~'~~I AN ORDINANCE VACATING AND EXTINGUISHING A 40-FOOT WIDE EMERGENCY ACCESS EASEMENT ON LOTS 3, 6, 7 AND 8, BLOCK 1-R, UNITED SERVICES CENTER ADDITION, FORT WORTH, TARRANT COUNTY, TEXAS, PROVIDING FOR REVERSION OF FEE IN SAID LAND, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 THAT 40-foot wide by variable length emergency access easement, containing approximately 40,387 square feet, located on Lots 3, 6, 7 and 8, Block 1-R, United Services Center Addition, Fort Worth, Texas, as recorded in Volume 388-140, Page 35, Plat Records, Tarrant County, Texas, and as more specifically described in Exhibit A attached hereto and incorporated herein by reference be and the same is vacated and extinguished SECTION 2. That the fee to the land in the above described emergency access easement is hereby released and shall revert to the adjacent owner as provided by law SECTION 3. Thence north 00 degrees-O1 minutes-00 seconds east, along the east line of said Lot 7 a distance of, 373-53/100 feet. - - - Thence west, 350-00/100 feet to the west line of said Block 1-R and the east right-of--way of Deen Road. - --- Thence north, along the west line of said Block 1-R and the eastright-of--way of said Deen Road, 40-00/100 feet to the southwest corner of Lot 8 of said Block 1-R. DISCUSSION Terri South, acting on behalf of Barney Holland Oil Company, owners of the above-described adjacent property, have requested vacation to facilitate expansion of the site's building area. Paving and storm drainage exist within the easement. Provisions have been made by the applicant to retain an appropriate drainage easement. The Engineering Department, Real Property Management Division states that a fee of $1 00 is required to satisfy the public interest. Reviewing City departments and public utility companies have raised no objections to this request. An acceptable replat has been received This request is located in COUNCIL DISTRICT 2 FISCAL INFORMATION/CERTIFICATION The Finance Director certifies that this action will have no material effect on City funds.
