ORDINANCE NO `~0~ ~ AN ORDINANCE VACATING AND EXTINGUISHING A 10-FOOT WIDE BY 687-FOOT LONG UTILIITY EASEMENT, LOCATED IN LOTS 1 AND 2, BLOCK 1, STARKS ADDITION TO THE CITY OF FORT WORTH AND VACATING AND EXTINGUISHING A 15 FOOT WIDE BY 626 FOOT LONG UTILITY EASEMENT LOCATED IN LOTS 2 AND 3, AND BLOCK 1, STARKS ADDITION, TO THE CITY OF FORT WORTH, TEXAS, PROVIDING FOR REVERSION OF FEE IN SAID LAND, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 THAT a 10-foot wide by 687-foot long utility easement, containing approximately 0 158 acres, located in Lots 1 and 2, Block 1, Starks Addition, Fort Worth, Texas, as recorded in Cabinet A, Slide 4072, Plat Records, Tarrant County, Texas and a 15 foot wide by 626-foot long utility easement, containing approximately 0 2161 acres, located in Lots 2 and 3, Block 1, Starks Addition, Fort Worth, Texas, as recorded in Cabinet A, Slide 4072, Plat Records, Tarrant County, Texas 152, Pages 819 through 823, Deed Records, Tarrant County, Texas, and as more specifically described in Exhibit A attached hereto and incorporated herein by reference be and the same is vacated, abandoned and extinguished SECTION- 2. That the fee to the land in the above described vacated utility easement is hereby released and shall revert to the adjacent owner as provided by law SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed SECTION 4. Easement No. 1 A 10-foot by approximately 687-foot utility easement containing approximately 0 158 acres of land situated in Lots 1 and 2, Block 1, Starks Addition, Fort Worth, Texas, as recorded in Cabinet A, Slide 4072, Plat Records, Tarrant County, Texas, and Easement No. 2 A 15-foot by approximately 626-foot utility easement containing 0 2161 acres of land situated in Lots 2 and 3, Block 1, Starks Addition, Fort Worth, Texas, as recorded in Cabinet A, Slide 4072, Plat Records, Tarrant County, Texas DISCUSSION Burk Collins, Hurst, Texas, owner of the above-described property, has requested vacation of the said easements in order to consolidate the building site No utilities exist within the respective easements The Engineering Department, Real Property Management Division has indicated the easements were previously dedicated by plat, therefore a $1 00 acquisition fee payment is required Reviewing City departments and public utility companies have raised no objections to this request.
