ORDINANCE NO ~~~5~~ AN ORDINANCE ALLOWING THE CREATION OF TWO (2) HEAD- IN PARKING SPACES AT THE PROPERTY LOCATED AT 300 WEST THIRD STREET SUBJECT TO CERTAIN CONDITIONS AND REQUIREMENTS AS PROVIDED HEREIN, MAKING THIS ORDINANCE CUMULATIVE OF OTHER ORDINANCES, PROVIDING A SEVERABILITY CLAUSE, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That the property owner of the commercial property located at 300 West Third Street, also known as the Saugumet Building, is hereby granted approval to construct two (2) new head-m parking spaces at said property bordering on the 400 block of Taylor Street as more specifically shown on the maps marked Exhibits "A" and "B" attached hereto and incorporated herein. Provided however, that said approval is expressly conditioned upon compliance by the property owner with all requirements, conditions and time hmrtahons as set out m Section 2 below SECTION 2 The Director of Transportation and Public Works must approve m writing all plans, designs and specifications for the creation of such spaces. The property owner shall obtain all required permits and the Construction Inspection Division of the Department of Engineering will inspect the work. All construction shall be at the sole expense of the property owner It is expressly provided that all construction shall be completed within twelve months from the effective date of this ordinance, or the approval of such parking spaces granted herein shall be void. SECTION 3 This ordinance shall be cumulative of all other ordinances or provisions of the Fort Worth City Code not m conflict herewith. It is specifically provided that this ordinance shall not be construed as repealing, altering or otherwise effecting the validity v ~: and binding force of Section 22-175, Code of the City of Fort Worth (1986), as amended, except as to the specific head-m parking spaces created pursuant to this ordinance SECTION 5 It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the vahd~udgment or decree of any court of competent~urlsdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council v~nthout the incorporation m this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 7 This ordinance shall be take effect upon adoption. DISCUSSION The Sanguinet Building (the new Bank One Building) is to be constructed in Block 75 in the Central Business District This block is bordered by Throckmorton Street, Fourth Street, Taylor Street and Third Street. Two van accessible parking spaces are needed to meet Texas Accessibility Standards/Texas Department of Licensing and Regulation (TAS/TDLR) requirements. Due to the unique design of the parking structure, the two van spaces cannot be located in a typical garage floor There is space at ground level under the garage ramp to provide the head-in spaces. The spaces would require the use of Taylor Street to maneuver This design has been reviewed and recommended by the Transportation and Public Works Department as the best way to comply with the TAS/TDLR requirements. The City Code prohibits new head-in/back-out parking on public right-of-way The attached ordinance will permit head-in parking at this location without altering the validity of Section 22-175 (Head-in Parking Prohibited) of the City Code.
