HomeMy WebLinkAboutOrdinance 14799~f~^ -~A i i y5 ORDINANCE NO. ~~ / (~' - AN ORDINANCE VACATING AND EXTINGUISHING THE NORTH 5- FEET OF A 100.5-FOOT LONG MAINTENANCE AND UTILIITY EASEMENT, LOCATED IN LOT 4, BLOCK 118, SUMMERFIELDS ADDITION, TO THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 THAT the north 5 feet of a 100 5-foot long maintenance and utility easement, located in Lot 4, Block 118, containing 503 square feet, Summerfields Addition, Fort Worth, Texas, and as recorded in Volume 388-161, Page 92, Plat Records, Tarrant County, Texas, and as more specifically described in Exhibit A attached hereto and incorporated herein by reference, be and the same is vacated and extinguished SECTION 2 That the fee to the land in the above described vacated maintenance and utility easement is hereby released and shall revert to the adjacent owner as provided by law SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed SECTION 4. DISCUSSION Gerarado Garro, owner of the above-described property, has requested vacation of the above described easement to enable the issuance of a clear title to the subject fot. Currently, a house encroaches upon the segment requested for vacation The Engineering Department, Real Property Management Division states that a $1 00 fee will satisfy the public interest. No utilities exist within the portion to be vacated Reviewing City departments and public utility companies have raised no objections to this request. A replat is required This request is located in COUNCIL DISTRICT 4 FISCAL INFORMATION/CERTIFICATION The Finance Director certifies that this action will have no material effect on City funds.
