HomeMy WebLinkAboutOrdinance 14310ORDINANCE NO. 1 y3 l o AN ORDINANCE VACATING, ABANDONING, CLOSING AND EXTINGUISHING A PORTION OF OLD HANDLEY ROAD, S.G JENNINGS SURVEY, KELL ESTATES SUBDIVISION TO THE CITY OF FORT WORTH, TEXAS, PROVIDING FOR REVERSION OF FEE IN SAID LAND, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 THAT a variable width and length segment of Old Handley Road, situated in the S G Jennings Survey, Abstract Nlo 843, containing approximately 0 2532 acres of land, more or less, and generally located as beginning at the southwest corner of Lot A- R, Block 1, and continuing west approximately 220 feet to an end point, Kell Estates Subdivision, as recorded in Cabinet A, Slide 432, Plat Records, Tarrant County, Texas, and as more specifically described in Exhibit A attached hereto and incorporated herein by reference be and the same is vacated, abandoned and permanently closed and extinguished SECTION 2 That the fee to the land in the above described variable street right-of-way is hereby released and shall revert to the adjacent owner as provided by law SECTION 3 That all ordinances or parts of ordinances in conflict herewith are hereby repealed SECTION 4. G. Jennings Survey, Abstract No. 843, City of Fort Worth, Tarrant County, Texas and being more particularly described by metes and bounds as follows: BEGINNING at a 1/2 inch iron set with a plastic cap, "Landes & Assoc.", (Hereinafter all 1/2 inch iron rods set are so marked) said iron being the southeast comer a tract of land conveyed to Abdul Wafayee as recorded in Volume 13436, Page 356, Deed Records, Tarrant County, Texas, said iron also being in the west line of Lot A-R, Block 1, Kell Estates Subdivision, Cabinet B, Slide 432, Plat Records, Tarrant County, Texas,-arid also being the northwest corner of a previously vacated portion of Old Handley Road as executed by City Ordinance No. 10836; ' THENCE S 20° 06' 46" W, along the west line of said Lot A-R 60.75 feet to a 1/2 inch iron rod set for the southeast corner of vacation, said iron also being the southwest corner of said Lot A-R, and also being in the north line of the Union Pacific Railroad Company, said iron being the beginning of anon-tangent curve to the left with a radius of 2844.92 feet and whose long chord bears N 85°02' 33" W, 176.72 feet; THENCE along said curve and with the north line of said Union Pacific Railroad Company tract 176.75 feet through a cental angle of 03° 33' 35" to a 1/2 inch iron rod set for the southwest corner; THENCE N 23° 50' 10" W, 61.21 feet to a 1/2 inch iron rod found for the southwest corner of said Wafayee tract, said iron also being the southeast corner of a TESCO tract recorded in Volume 4242, Page 199, Deed Records, Tarrant County, Texas; THENCE S 86° 12' 32" E, along the south line of said Wafayee tract 154 63 feet to a 1-1J4 inch iron pipe found; THENCE S 87° 02' S8" E, continuing along said Wafayee south line 59 10 feet to a mag nail set in asphalt; THENCE s s3° 32' S5" E, continuing along said Wafiyee south line 8.42 feet to the POINT OF BEGIN1~lING and containing 11028 square feet or 0.2532 of an acre of land, more or less. f EXHIBIT - - City of Fort Worth, Texas A~a~ un~ c~un~il C,anttr~un~~u$~an ~~ DATE REFERENCE NUMBER LOG NAME PAGE 8/22/00 **PZ-2228 06VA-00-011 1 of 1 SUBJECT STREET RIGHT-OF-WAY VACATION OLD HANDLEY ROAD RIGHT-OF-WAY IN THE S G JENNINGS SURVEY, ABSTRACT NO 843, CITY OF FORT WORTH, TEXAS VA-00-011 RECOMMENDATION It is recommended that the City Council adopt the attached ordinance vacating a variable width and length segment of Old Handley Road, situated in the S G Jennings Survey, Abstract No 843, City of Fort Worth, Texas, and containing approximately 0.2532 acres of land, more or less, and generally located as beginning at the southwest corner of Lot A-R, Block 1, Kell Estates Subdivision, as recorded in Cabinet B, Slide 432, of the Plat Records of Tarrant County, Texas, and continuing west approximately 220 feet to an end point. DISCUSSION Abdul Wafayee of Fort Worth, owner of the above-described property, has requested vacation of the above referenced street right-of-way to enable the redevelopment of the site. Existing improvements include paving, fences, telephone and electric utilities, and storm drainage facilities The Real Property Management Division has collected the appraised fee of $2,372.74 for the vacated. segment. Appropriate drainage and utility easements are to be retained The City Plan Commission recommended approval of this request on April 26, 2000 Reviewing City departments and public utility companies have raised no objections to this request.
