HomeMy WebLinkAboutOrdinance 14322~~~ ty7 Ordinance No ~ ~ ~ '~ 2 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE MISCELANEOUS PARK IMPROVEMENT FUND IN THE AMOUNT OF $2,000 FROM SOUTHWESTERN BELL PAYMENT FOR A UTILITY EASEMENT AT MEADOWBROOK GOLF COURSE, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the vanous City departments for the Fiscal Year 1999-00 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations m the Miscellaneous Park Improvement Fund m the amount of $2,000 from Southwestern Bell representing payment for a utility easement at Meadowbrook Golf Course. SECTION 2. That should any portion, section or part of this ordinance be declared invalid, inoperative or void for any reason by a court of competent ~unsdiction, such decision, opinion or judgment shall in no way unpair the remaining portions, sections or parts of sections of this ordinance, which said remaining provisions shall be and remain m full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No. 13885 and all other ordinances and appropnations amending the same except m those instances where the provisions of this ordinance are m direct conflict with such other ordinances and appropnations, in which instance said conflicting provisions of said pnor ordinances and appropnations are hereby expressly repealed. SECTION 4 This ordinance shall take effect and be in full force after the date of its passage, and it is so ordained. Box 9688 817/334.0385 ~s6 Fort Worth Texes 76147 - 2668 00-03-03814 City of Fort Worth, Texas ~I~A~a~ And aunc~l an~n~un~cAt~an C C DATE REFERENCE NUMBER LOG NAME PAGE 9/5/00 L-12890 8000NVER 1 of 2 SUBJECT CONVERSION OF DEDICATED PARKLAND TO A SOUTHWESTERN BELL EASEMENT AT THE MEADOWBOOK GOLF COURSE AND ADOPTION OF RELATED APPROPRIATION ORDINANCE RECOMMENDATION It is recommended that the City Council 1 Conduct a public hearing under the guidelines set forth by the Texas Parks and Wildlife Code, Chapter 26, Protection of Public Parks and Recreational Lands, and 2 Find that there is no feasible and prudent alternative to the utility easement; and 3 Find that the easement project includes all reasonable planning necessary to minimize harm to the Meadowbrook Golf Course, and 4 Authorize the City Manager to convert dedicated parkland to a 20-foot by 20-foot (0 0092 acre) equipment-bearing easement, which is to be placed on a portion of land situated in the F B Knight Survey, Abstract 888, Tarrant County, also being a portion of Lot 1, Block 1, Meadowbrook Golf Course Addition, Parcel 17, Daniels and Associates job number 817-451-4125, Jenson Road, Fort Worth, Texas, and 5 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Miscellaneous Park Improvement Fund by $2,000 00 from Southwestern Bell as payment for the utility easement. DISCUSSION Southwestern Bell has requested permission to use a 20-foot by 20-foot portion of dedicated parkland located at the Meadowbrook Golf Course as an equipment-bearing easement. This new facility is being planned to meet the increasing demand for phone lines in the existing area The panel will be placed in the southern portion of the existing parking lot and directly west of the existing cart storage building The cabinet would be placed on a concrete slab and would have asix-foot cedar privacy fence or chain link fence around the perimeter of the site Southwestern Bell has agreed to maintain all facilities located in the easement. The proposed easement would utilize approximately 400 square feet (0 0092 acres) of parkland presently being used as a buffer space It is believed that this easement would not eliminate any future park development within the Meadowbrook Golf Course Southwestern Bell has agreed to pay $2,000 for the easement, and all direct costs for public notice advertisement.
