AN ORDINANCE VACATING, ABANDONING, CLOSING AND
EXTINGUISHING 5T" AVENUE FROM PENNSYLVANIA AVENUE TO
WEST TERRELL STREET, SANDIDGE ADDITION, TO THE CITY OF
FORT WORTH, TEXAS, PROVIDING FOR REVERSION OF FEE IN
SAID LAND, REPEALING ALL ORDINANCES IN CONFLICT HERE-
WITH, AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
SECTION 1
THAT 5th Avenue from Pennsylvania Avenue to West Terrell Street, being 60 feet
wide by approximately 995 feet long, containing approximately 43,302 square feet,
located in Sandidge Addition and the Harris Hospital Addition, as recorded in both
Volume 47, Page 69, and Cabinet A, Slide 5278, Plat Records of Tarrant County,
Texas, and as more specifically described in Exhibit A attached hereto and
incorporated herein by reference be and the same is vacated, abandoned and
permanently closed and extinguished
SECTION 2
That the fee to the land in the above described vacated street rights-of-way is
hereby released and shall revert to the adjacent owner as provided by law
SECTION 3
That all ordinances or parts of ordinances in conflict herewith are hereby
repeated
SECTION 4.
That this ordinance shall take effect and be in full force and effect from and after
the date of its passage, and it is so ordained

RECOMMENDATION
It is recommended that the City Council
1 Adopt the attached ordinance vacating 5th Avenue from Pennsylvania Avenue to West Terrell
Street, being 60 feet wide by approximately 995 feet long, containing approximately 43,302 square
feet, located in the Bandage Addition, Volume 47, Page 69, and the Harris Hospital Addition,
Cabinet A, Slide 5278, Plat Records, Tarrant County, Texas, and
2. Waive the fair market value of $54,128 for this right-of-way in accordance with Ordinance No
13767
DISCUSSION
Harris Methodist Hospital, Fort Worth, owner of the adjacent property affecting this vacation, has
requested the street vacation to allow for the separation of patient and visitor traffic from that of
emergency and service vehicles, and to improve traffic flow and enhance pedestrian traffic. This
request completes a series of similar requests and approved vacations in the immediate area
An acceptable re-plat has been provided for City approval, and a 60-foot utility easement and a 26-foot
emergency access easement have been dedicated for existing and proposed facilities.
Reviewing City departments and public utility companies have raised no objections to this vacation
request. On May 27, 1998, the City Plan Commission recommended approval of the vacation
The Transportation and Public Works Department has stated that the subject street is to remain public,
in full use and service until Henderson Street is converted from one-way northbound to a two-way street
and all construction work, including signs and signals, are completed to provide two-way traffic on
Henderson Street. After the completion of construction and two-way traffic on Henderson Street, 5th
Avenue can be officially closed to public use and changed to private ownership and use
In accordance with Ordinance No 13767, establishing a City Council policy for waiver of right-of-way
assessments, it has been determined that this request conforms to said policy and the assessed value
of $54,128; as established by Real Property Management, should be waived
