ORDINANCE NO. ~~
AN ORDINANCE VACATING, ABANDONING, CLOSING AND
EXTINGUISHING A 10 FOOT WIDE BY 2090 43 FOOT LONG UTILITY
EASEMENT, PARK VISTA PARK BUSINESS ADDITION TO THE CITY
OF FORT WORTH, TEXAS, PROVIDING FOR REVERSION OF FEE IN
SAID LAND, REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH, AND PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
SECTION 1
THAT a 10 foot wide by 2090 43 foot long utility easement containing
approximately 20,879 square feet, along the south property line of Lots 1 through 5,
Block 3, Park Vista Business Park Addition, as recorded in Cabinet A, Slide 5393, Plat
Records of Tarrant County, Texas, and as more specifically described in Exhibit A
attached hereto and incorporated herein by reference be and the same is vacated,
abandoned and permanently closed and extinguished
SECTION 2.
That the fee to the land in the above described vacated utility easement is
hereby released and shall revert to the adjacent owner as provided by law
SECTION 3
That all ordinances or parts of ordinances in conflict herewith are hereby
repealed
SECTION 4.
That this ordinance shall take effect and be in full force and effect from and after
the date of its passage, and it is so ordained

10 FOOT WIDE UTILITY EASEMENT TO BE VACATED
20,879 square feet of land being a 10 foot wide utility easement and being more particulary described
by metes and bounds as follows.
BEGINNING at a 1/2 inch rron rod found with plastic cap stamped "Landes & Associates", at the
southeast corner of Lot 5, Blk. 3, Park Vista Business Park, an addition to the crty of Fort Worth,
Texas, as filed in Cabinet A ,slide 5393, Plat Records of Tarrant County, Texas, and also being the
southwest corner of Lot 3, Blk. 4, Park Vista Business Park, an addition to the crty of Fort Worth,
Texas, as filed in Cabinet A ,slides 5066 & 5067, Plat Records of Tarrant County, Texas;
THENCE N 89°34'38" W, 2,090 43 feet;
THENCE N 00°06'15" E, 10 00 feet,
THENCE S 89°34'38" E, 2,085.28 feet;
THENCE S 27°04'30" E, 11.27 feet to the POINT OF BEGINNING and containing 20,879 square
feet or 0 4793 of an acre of land.

RECOMMENDATION
It is recommended that the City Council adopt the attached ordinance vacating a 10-foot wide by
2090 43-foot long utility easement, containing approximately 20,879 square feet, along the south
property line of Lots 1 through 5, Block 3, Park Vista Business Park Addition, Fort Worth, Texas, as
recorded in Cabinet A, Slide 5393, Plat Records of Warrant County, Texas.
DISCUSSION
Mr Harold Muckleroy, Jr ,Vice President of Kroger Association, Inc., General Partner for Kroger 377,
L.P , owners of the above referenced property, requested vacation of this easement to facilitate
incorporation of the affected lots into a larger tract to the south Reviewing City departments and public
utility companies have raised no objection to this vacation request, as no present or proposed utilities
are located therein Are-plat is not required, however, the owners will re-plat the property to reflect the
change.
This request is located in COUNCIL DISTRICT 4
