Home My WebLink AboutOrdinance 14435Ordinance No P L/ / AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE FEDERAL AWARDED ASSETS FUND IN THE AMOUNT OF $40,000 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING EXPANSION OF THE MENTAL HEALTH LIAISON PROGRAM, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That m addition to those amounts allocated to the various City departments for the Fiscal Year 2000-01 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Federal Awarded Assets Fund in the amount of $40,000 from available funds for the purpose of funding expansion of the Mental Health Liaison Program. SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent ~unsdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 14286 and all other ordinances and appropriations amending the same except m those instances where the provisions of this ordinance are m direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect and be in full force after the date of its passage, and it is so ordained. APPROVED AS TO FORM AND LEGALITY ~~ `-~ Assistan /~ Attorney ~ 1~/ ~/~ c7-'~ Date __ 11 /~'/2-Da Adopted Effective City of Fort Worth, Texas ~1~Aya~r And Council C,anh~rtun~cAt~ian DATE REFERENCE NUMBER LOG NAME PAGE 12/12/00 **C-18386 35GRANT-5 1 of 4 SUBJECT ACCEPTANCE OF LOCAL LAW ENFORCEMENT BLOCK GRANT, ADOPTION OF RELATED APPROPRIATION ORDINANCE, AND APPROVAL OF PROGRAM CONTRACTS FOR YEAR FIVE RECOMMENDATION It is recommended that the City Council 1 Authorize the City Manager to accept a grant award from the U S Department of Justice in the amount of $1,127,532 for the period of November 7, 2000, through November 30, 2002, and 2 Authorize the transfer of $127,532 from the General Fund to the Grants Fund as the cash match to the Local Law Enforcement Block Grants Program, and ~ 3 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Federal Awarded Assets Fund by $40,000 from available funds, and 4 Authorize the transfer of $40,000 from the Federal Awarded Assets Fund to the Grants Fund to provide funds for the expansion of the Mental Health Liaison Program, and 5 Authorize the use of interest earned in the amount of $70,000, and 6 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund by $1,365,064 from available funds, .and 7 Approve a contract extension with the Boys and Girls Club of Greater Fort Worth in the amount of $1,068,035, and contracts with the Tarrant `County Sheriff's Office ($161,240) for a records management system and Tarrant County for expansion of the Mental Health Liaison Program ($40,000) DISCUSSION During the FY1999 Local Law Enforcement Block Grant application process, Texas Attorney General John Cornyn sent a letter to the U S Department of Justice certifying that there was a funding disparity between a number of counties and cities within Texas. Fort Worth and Arlington were certified due to the fact that more than 50% of the cost of prosecution and incarceration of violent crime offenders is borne by Tarrant County However, Fort Worth and Arlington both receive 200% more of the Local Law Enforcement Block Grant Funds than Tarrant County Again this year, Attorney General Cornyn sent a letter to the U S Department of Justice certifying that there was a funding disparity Legislation governing disparity requires that certified agencies aggregate their funds and develop a joint application The legislation does not speak to the contents of the joint application, or how the funds should be divided To this end, representatives of Fort Worth, Tarrant County, and Arlington met a number of times to develop a plan acceptable to all parties. DATE REFERENCE NUMBER LOG NAME PAGE 12/12/00 **C-18386 35GRANT-5 2 of 4 SUBJECT ACCEPTANCE OF LOCAL LAW ENFORCEMENT BLOCK GRANT, ADOPTION OF RELATED APPROPRIATION ORDINANCE, AND APPROVAL OF PROGRAM CONTRACTS FOR YEAR FIVE The plan, which was approved by the Tarrant County Commissioners on Tuesday, duly 25, 2000, contains the following a) Tarrant County has agreed to~ waive the classification as a "disparate jurisdiction" for the current year funding, thus negating the certification process, and b) Each entity will submit separate grant applications, and c) Each entity will contribute the cash match independently; and d) Arlington will contract with Tarrant County to provide $76,355 from Local Law Enforcement Block Grant funds for the Tarrant County Sheriff's records management system and the Mental Health Liaison Program, and e) Fort Worth will contract with Tarrant County to .provide $161,240 from Local Law Enforcement Block Grant funds for the Tarrant County Sheriff's records management system, and $40,000 from awarded assets for an expansion of the Mental Health Liaison Program Fort Worth has provided funds to Tarrant County for the adult and juvenile drug treatment courts in previous grants With this year's monies, Tarrant County will use the Block Grant monies for the procurement of computer technology equipment to assist with the purchase of a records management system for the Tarrant County Sheriff's Department The Mental Health Liaison Program is an existing project that provides training for area law enforcement officers in dealing with persons who have mental health problems, and to act as an information resource to officers in the field The expansion of the program, which entails hiring two additional part-time employees, will allow for 24-hours aday/7 days a week information services There are insufficient funds in the Local Law Enforcement Block Grant to fund this project without cutting other programs, so it is proposed that the expansion be funded through use of awarded assets. The 5th year of funding of the Local Law Enforcement Block Grant Program for Fort Worth includes $1,127,532 in federal funds, $127,532 in cash matches, $40,000 from awarded assets, and an estimated $70,000 of interest earned for a total of $1,365,064 The funds will be provided in advance beginning October 1, 2000, and the City will have up to two years to expend these funds Funds must be placed in an interest bearing account, and all accrued interest will be considered program income and must be used on Local Law Enforcement Block Grant projects. These will be placed in a separate account and used for closing costs and/or equipment needed at the end of the grant. Matching funds are budgeted in the Non-Departmental, General Fund Locaf Law Enforcement Block Grant regulations do not allow payment of indirect costs. Police Department • Eauipment $ 23,538 For the purchase and/or upgrade of technical equipment in the Police Department to enhance efficiency and effectiveness Parks and Community Services Department • Comin' Up $1,068,035 This is the City's gang intervention program, operated by the Boys & Girls Club of Greater Fort Worth since 1993 In trying to keep gang members from attacking each other, this program also seeks to offer job training, counseling, GED programs, family referrals and case management. Tarrant County • Records Management System $ 161,240 The current records management system is over ten years old and not compatible with other systems throughout the county Tarrant County has worked with a consultant over the past year to design a new information system for all of their operations and the Tarrant County Sherrifs Office records management system will be a crucial component of this system Prior to any funds being spent on this project it will require review by the state Criminal Justice Information Systems Point of Contact and release of a federal special condition • Mental Health Liaison Program $ 40,000 The Mental Health Liaison Program 'was added to the plan following discussions with Tarrant County and will be funded with awarded assets. This will expand the program to allow for 24/7 provision of information resources for officers and for training of field officers. • Interest Earned $ 70,000 All accrued interest will be considered program income and must be used on Local Law Enforcement Block Grant projects. These will be placed in a separate account and used for closing costs and/or equipment needed at the end of the project. This is an estimated amount based upon interest earned during the first Local Law Enforcement Block Grant.
