Home My WebLink AboutOrdinance 14137,r r Ordinance No '~' 3 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SEWER CAPITAL PROJECT FUND IN THE AMOUNT OF $760,217 70 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING A CONTRACT TO TEXAS-STERLING CONSTRUCTION, INC., FOR MAINS 126 AND 250 DRAINAGE AREA SANITARY SEWER REHABILITATION AND IMPROVEMENTS, PART 5, UNIT 2, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1999-00 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Sewer Capital Project Fund in the amount of $760,217 70 from available funds for the purpose of funding a contract to Texas-Sterling Construction, Inc., for Mains 126 and 250 Drainage Area Sanitary Sewer System Rehabilitation and Improvements, Parts 5, Unit 2. SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No. 13886 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect and be in full force and effect and after the date of its passage, and it is so ordained. UNIT 2 RECOMMENDATION It is recommended that the City Council 1 Authorize the City Manager to transfer $760,217 70 from the Water & Sewer Operating Fund to the Sewer Capital Project Fund, and 2 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Sewer Capital Project Fund in the amount of $760,217 70 from available funds, and 3 Authorize the City Manager to execute a contract with Texas-Sterling Construction, Inc. in the amount of $666,217 70 for Mains 126 and 250 Drainage Area Sanitary Sewer System Rehabilitation and Improvements, Part 5, Unit 2 DISCUSSION On August 15, 1995 (M&C C-14962), the City Council authorized the City Manager to execute an engineering agreement with Turner Collie & Braden, Inc. to prepare plans and specifications for Mains 126 and 250 drainage area sanitary sewer system rehabilitation and improvements. The project consists of the rehabilitation of the following sanitary sewer main and laterals.
