HomeMy WebLinkAboutOrdinance 1433709-14-00 P02 52 IN ORDINANCE NO. ~ ~~ 3 7 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF FORT WORTH, BEING ORDINANCE NO. 13896, AS AMENDED, CODIFIED AS APPENDIX "A" OF THE CODE OF THE CITY OF FORT WORTH, ESTABLISHING FOUR NEW ONE-FAMILY RESIDENTIAL ZONING DISTRICTS WITH MINIMUM LOT SIZES OF 7,500 SQUARE FEET, 10,000 SQUARE FEET, ONE-HALF ACRE, AND ONE ACRE; ESTABLISHING LOT WIDTH, LOT COVERAGE, SETBACK AND HEIGHT REQUIREMENTS; ESTABLISHING OTHER DEVELOPMENT STANDARDS; RENAMING "A" ONE-FAMILY DISTRICT AS "A-5" ONE- FAMILY DISTRICT; AMENDING RESIDENTIAL USE TABLE TO DELETE REFERENCE TO "A" ONE-FAMILY DISTRICT AND TO REFLECT USES ALLOWED IN "A-43", "A-21", "A-10", "A-7.5" AND "A-5" ONE-FAMILY DISTRICTS, AMENDING DEFINITION OF "ONE- AND TWO-FAMILY RESIDENTIAL DISTRICTS", PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE, PROVIDING A SEVERABILITY CLAUSE, PROVIDING A PENALTY CLAUSE, PROVIDING A SAVINGS CLAUSE, PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER, AND PROVIDING AN EFFECTIVE DATE WHEREAS, the zoning ordinance of the Crty of Fort Worth currently provides for only two one-family zoning districts the "A" One-Family District requiring a minimum lot size of 5,000 square feet and the "AR" One-Family Restricted District requiring a minimum lot size of 3,500 square feet; WHEREAS, although the City affirms its commitment to affordable housing and recognizes the need for the continued availability of small lot residential zoning, experience has shown that larger lot sizes are appropriate m certain situations to promote the public health, safety, morals or general welfare by, among other things, providing for different street standards, ensuring compatibility with adjacent uses, and maintaining compatible lot sizes m developed areas, WHEREAS, the Crty Council m adopting this ordinance affirms rts intent that the ordinance not be applied mvoluntaraly to existing zoned properties absent compelling circumstances, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 Chapter 4, Article 7 of Ordinance No 13896, the zoning ordinance of the City of Fort Worth, Section 4 700, "One-Family (`A') Distract", is renumbered as Section 4 700 4 and renamed .. "One-Family (`A-5') Distract" All references to the "A" Distract are amended to refer to the "A-5" Distract. Further, Subsection A, "Purpose and Intent", is amended as follows A. Purpose and Intent It is the purpose and intent of the One-Family ("A-5") District to provide a zone with a minimum lot size of 5,000 square feet for the development of aone-family dwelling on each lot and accessory uses. SECTION 2. Chapter 4, Article 7 of Ordinance No 13896, the zoning ordinance of the City of Fort Worth, "Residential Distracts", is hereby amended by adding a new Section 4 700, "One-Family (`A-43') District", to provide for one-family lots with a minimum size of one acre (43,560 square feet), as follows A. Purpose and Intent It is the purpose and intent of the One-Family ("A-43") Distract to provide a zone with a minimum lot size of one acre for rural-style development of aone-family dwelling on each lot and accessory uses. The minimum lot size of one acre may also be appropriate to maintain compatible lot sizes m developed areas, ensure compatibility with adjacent uses, or otherwise promote the public health, safety, morals or general welfare 2 B. Uses In the One-Family ("A-43") Distract, no building or land shall be used and no building shall be hereafter erected, reconstructed, altered or enlarged, nor shall a Certificate of Occupancy be issued, except m accordance with the use tables m Chapter 4, Articles 6 and 8, and the supplemental standards of Chapter 5 C. Property Development Standards In the One-Family ("A-43'') District, the minimum dimension of lots and yards and the height of buildings shall be as follows Lot Area. One acre (43,560 square feet) minimum (Sections 6 501 and 7 106) Lot Width. 125 feet minimum at building hne Lot Coverage 30% maximum Front Yard.* 35 feet minimum Rear Yard. 25 feet minimum Szde Yard.* Interior lot: 25 feet minimum Corner lot:** 35 feet minimum adjacent to side street and 25 feet minimum for interior lot line Height. 35 feet maximum (See Section 6 100) *May be subject to setback averaging (Section 6 lO1D) **May be subject to projected front yard (Section 6 lO1F) D Other Development Standards Development m the One-Family ("A-43") District may be subject to a variety of general development standards m Chapter 6, and the following provisions. 1 Signs. On-premises signs subject to the following: a. An umlluminated nameplate bearing the family name of the occupants residing m the residence not to exceed one square m foot area. b An umllummated sign for those uses allowed that are not residential. The sign shall not exceed 30 square feet in area, shall be no higher than six feet above grade, and shall be placed a minimum of ten feet behind the property hne. Such sign shall not be placed within 20 feet of drives providing ingress and egress to the property 3 2 Parking. Two spaces per dwelling unit, located behind the front building line. For nonresidential uses, see Chapter 6, Article 2 3 Residential Design Standards. See Chapter 6, Article 5 4 Landscaping and Buffers. Nonresidential uses may require landscaping or buffers. Chapter 4, Article 7 of Ordinance No 13896, the zoning ordinance of the City of Fort Worth, "Residential Distracts", is hereby amended by adding a new Section 4 700 1, "One-Family (`A-21') Distract", to provide for one-family lots with a minimum size of one-half acre (21,780 square feet), as follows A. Purpose and Intent It is the purpose and intent of the One-Family ("A-21 ") Distract to provide a zone with a minimum lot size of one-half acre for semi-rural development of aone-family dwelling on each lot and accessory uses. The minimum lot size of one-half acre may also be appropraate to maintain compatible lot sizes m developed areas, ensure compatibility with adjacent uses, or otherwise promote the public health, safety, morals or general welfare. B. iJses In the One-Family ("A-21") Distract, no building or land shall be used and no building shall be hereafter erected, reconstructed, altered or enlarged, nor shall a Certificate of Occupancy be issued, except in accordance with the use tables in Chapter 4, Articles 6 and 8, and the supplemental standards of Chapter 5 C. Property Development Standards In the One-Family ("A-21 ") Distract, the minimum dimension of lots and yards and the height of buildings shall be as follows 4 Lot Area. Purpose and Intent It is the purpose and intent of the One-Family ("A-10") District to provide a zone with a minimum lot size of 10,000 square feet for the development of cone-family dwelling on each lot and accessory uses. The minimum lot size of 10,000 square feet may also be appropriate to maintain compatible lot sizes m developed areas, ensure compatibility with adjacent uses, or otherwise promote the public health, safety, morals or general welfare. B. Uses In the One-Family ("A-10") District, no building or land shall be used and no building shall be hereafter erected, reconstructed, altered or enlarged, nor shall a Certificate of Occupancy be issued, except m accordance with the use tables m Chapter 4, Articles 6 and 8, and the supplemental standards of Chapter 5 C. The minimum lot size of 7,500 square feet 7 may also be appropriate to maintain compatible lot sizes in developed areas, ensure compatibility with adjacent uses, or otherwise promote the public health, safety, morals or general welfare B. Uses In the One-Family ("A-7 5") District, no building or land shall be used and no building shall be hereafter erected, reconstructed, altered or enlarged, nor shall a Certificate of Occupancy be issued, except m accordance with the use tables m Chapter 4, Articles 6 and 8, and the supplemental standards of Chapter 5 C. Chapter 4, Article 1 of Ordinance No 13896, the .zoning ordinance of the City of Fort Worth, Section 4 100, "Districts Established," is amended to reflect creation of the "A-43", "A-21", "A-10" and "A-7 5" One-Family Distracts and the renaming of the "A" One-Family District as "A- 5" One-Family, as follows B Residential Districts 1 One-Family, One Acre ("A-43") Distract 2 One-Family, One-Half Acre ("A-21 ") Distract 3 One-Family, 10,000 Square Feet ("A-10") District 4 One-Family, 7,500 Square Feet ("A-7 5") 5 One-Family, 5,000 Square Feet ("A-5") District 6 One-Family Restricted ("AR") District 7 Two-Family ("B") Distract 8 Zero Lot Lme/Cluster ("R1") Distract 9 Townhouse/Cluster ("R2") Distract, 10 Low Density Multifamily ("CR") District 11 Medium Density Multifamily ("C") Distract 12 High Density Multifamily ("D") Distract 9' SECTION 7. Chapter 4, Article 6 of Orrdmance No 13896, the zoning ordinance of the City of Fort Worth, Section 4 603, "Residential District Use Table", is amended to delete the column referring to the "A" One-Family Distract and to add columns reflecting the uses permitted m the "A-43", "A- 21", "A-10", "A-7 5" and "A-5" One-Family Districts, as shown m Exhibit "A" attached and incorporated herein. SECTION 8. Chapter 9 of OrdmanGe No 13896, the zoning ordinance of the City of Fort Worth, "Definitions", is amended by amending the definition of "One- and Two-Family Districts" to include the "A-43", "A-21", "A-10", "A-7 5" and "A=5" One-Family Districts, as follows ONE- AND TWO-FAMILY DISTRICTS Collectively, the "A-43", "A-21", "A-10", "A-7 5", "A-5", "AR", "B", "Rl" and "R2" Districts. SECTION 9. Any reference m the zoning ordinance to the "A" One-Family Distract is hereby deemed to include the "A-43", "A-21", "A-10", "A-7 5" and "A-5" One-Family Distracts, except where such construction would be clearly inconsistent with the intent of the ordinance SECTION 10. Except as expressly amended, all provisions of the Ordinance No 13896, as amended, shall remain m full force and effect. SECTION 11. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are m 10 direct conflict with the provisions of such ordinances and such Code, m which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 12. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation m this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 13 Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($2,000 00) .for each offense. Each day that a violation exists shall constitute a separate offense SECTION 14 All rights and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of Ordinance No 3011, Ordinance No 13896, or any other ordinances affecting zoning which have accrued at the time of the effective date of this ordinance; and, as to such accrued violations and all pending lrtigahon, both civil and cnmmal, whether pending m court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. 11 SECTION 15. The City Secretary of the City of Fort Worth, Texas, is hereby directed to publish the caption, penalty clause and effective date of this ordinance for two (2) days in the official newspaper of the Crty of Fort Worth, Texas, as authorized by Section 52 013, Texas Local Government Code.
