HomeMy WebLinkAboutOrdinance 14437~ ORDINANCE NO ~ L~L~~ 7 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF FORT WORTH, BEING ORDINANCE NO. 13896, AS AMENDED, CODIFIED AS APPENDIX "A" OF THE CODE OF THE CITY OF FORT WORTH, INCREASING MEMBERSHIP OF THE BOARD OF ADJUSTMENT TO NINE MEMBERS AND TWO ALTERNATE MEMBERS, PROVIDING THAT A QUORUM CONSISTS OF SEVEN MEMBERS; REQUIRING THE AFFIRMATIVE VOTE OF SEVEN MEMBERS FOR ANY ACTION BY THE BOARD, PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE, PROVIDING A SEVERABILITY CLAUSE, AND PROVIDING AN EFFECTIVE DATE WHEREAS, the Board of Adjustment currently consists of five members and four alternate members, WHEREAS, state law allows the Board of Adjustment to consist of mne members, plus alternate members to serve in the absence of one or more regular members, WHEREAS, rt is deemed advisable to expand the Board of Adjustment from five members to mne members and to provide for the appointment of two alternate members, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 The first sentence of Section 2 101(A) of Ordinance No 13896, the zoning ordinance of the City of Fort Worth, "Creation and Appointment", is hereby amended to read as follows. There is hereby created a Board of Adjustment, to be composed of mne members and two alternate members to serve in the absence of one or more regular members, all of whom shall be qualified electors of the Crty of Fort Worth. All other provisions of Section 2.101(A) shall remain iri full force and effect. w- ~ SECTION 2. Section 2.101(B) of Ordinance No 13896, the zomng ordinance of the City of Fort Worth, "Terms of Office," is hereby amended to read as follows. The members of the Board of Adjustment shall be identified by place numbers one through mne. The odd-numbered places shall expire on October 1 of each odd-numbered year and the even-numbered places shall expire on October 1 of each even-numbered year The term of one of the alternate members shall expire on October 1 in each odd-numbered year and the term of the other alternate member shall expire on October 1 in each even-numbered year Board of Adjustment members may be appointed to succeed themselves. Vacancies shall be filled for unexpired terms, but no member shall be appointed for a term in excess of two years. An alternate member may be appointed to serve as a regular member, at the discretion of the City Council. SECTION 3 The first sentence of Section 2 101(D) of Ordinance No 13896, the zoning ordinance of the City of Fort Worth, "Meetings and Quorum," is hereby amended to read as follows Seven members of the Board of Adjustment shall constitute a quorum for the conduct of business. All other provisions of Section 2.101(D) shall remain in full force and effect. SECTION 4 Section 2.101(E) of Ordinance No 13896, the zomng ordinance of the City of Fort Worth, "Decision by Board of Adjustment," is hereby amended to read as follows. The affirmative vote of seven members of the Board of Adjustment shall be required to reverse or modify any order, decision or interpretation of this Ordinance. SECTION 5. Except as expressly amended, all provisions of Ordinance No 13896, as amended, shall remain in full force and effect. 2 SECTION 6. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions. of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 7. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent ~unsdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section.
