HomeMy WebLinkAboutOrdinance 14038Ordinance No AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $222,330 00 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING THE COMPREHENSIVE ENERGY ASSISTANCE PROGRAM, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That m addition to those amounts allocated to the various City departments for the Fiscal Year 1999-00 and m the Budget of the City Manager, there shall also be increased estimated receipts and appropriations m the Grants Fund in the amount of $222,330 00 from available funds for the purpose of funding the Comprehensive Energy Assistance Program. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent ~urisd~ction, such decision, opinion or judgment shall m no way impair the rema~nmg portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 13886 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, m which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 This ordinance shall take effect and be ~n full force and effect and after the date of its passage, and it is so ordained APPROVED AS TO FORM AND LEGALITY Assistant City Attorney /~- S - oU Date /-~-a0 Adopted AA ~V --~- Effectwe City of Fort Worth, Texas ~1-~A~a~r and C,aunc~l ~a~rtn~tun~cAt~an DATE REFERENCE NUMBER LOG NAME PAGE 1!4/00 **G-12775 80END 1 of 2 SUBJECT SUPPLEMENTAL APPROPRIATION ORDINANCE WITH THE TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS FOR THE COMPREHENSIVE ENERGY ASSISTANCE PROGRAM RECOMMENDATION It is recommended that the City Council Authorize the City Manager to accept funds in the amount of $222,330 from the Texas Department of Housing and Community Affairs (TDHCA), increasing the 1999 allocation from $1,230,506 to $1,452,836, and 2. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the Grants Fund by $222,330, and 3 Apply indirect cost rates in accordance with the City's Administrative Regulation 3-15, at a rate of 25 52%, which is the most recently approved rate for this department, and apply the new, approved rate when available DISCUSSION On April 6, 1999 (M&C G-12530), the City Council accepted a grant in the amount of $737,948 from TDHCA for the Comprehensive Energy Assistance Program (CEAP) The City was notified through Letter of Notification No 10, effective July 1, 1999, that its 1999 allocation had been increased to $1,230,506 The City was then notified through letter of Notification No 11, effective October 8, that its 1999 allocation had been increased to $1,452,836 Any decision that TDHCA makes to obligate additional funds or deobligate funds is based upon factors, including but not limited to, the status of funding under grants to the TDHCA, the rate of contractor's utilization of funds under this or previous contracts, the existence of questioned or disallowed costs under this or other contracts between the parties, and the contractor's overall compliance with the terms of this contract. Given the fact that the City has performed satisfactorily in all measured areas, additional funds have been allocated The CEAP has six components. 1) Energy Crisis, 2) Elderly/Disabled Assistance, 3) Co-Payment Assistance, 4) Heating and Cooling Systems, 5) Direct Service Support and 6) Case Management.
