AN ORDINANCE .DECLARING CERTAIN FINDINGS; PROVIDING FOR THE
EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT WORTH;
PROVIDING FOR THE ANNEXATION OF A CERTAIN 1,559.1 ACRES (2.436 SQUARE
MILES) OF LAND, MORE OR LESS, OUT OF THE D.C. PACE SURVEY, ABSTRACT NO.
1245, THE T. FREEMAN SURVEY, ABSTRACT NO. 546, THE G.S. RALL SURVEY,
ABSTRACT NO.1985, THE WILLIAM ROBINSON SURVEY, ABSTRACT NO.1310, THE
B.B.B. & C. RR COMPANY SURVEY, ABSTRACT NO. 221, THE E.G. BARNETT

LOCATED IN TARRANT COUNTY, TEXAS, WHICH SAID TERRITORY LIES
ADJACENT 'TO AND ADJOINS THE PRESENT CORPORATE BOUNDARY LIMITS OF
FORT WORTH, TEXAS AND WHICH TERRITORY IS COTERMINOUS WITH THE
BOUNDARIES OF TARRANT COUNTY MUNICIPAL UTILITY DISTRICT NO. 1 AND
CONTAINS EAGLE MOUNTAIN MUNICIPAL UTILITY DISTRICT; PROVIDING THAT
THE TERRITORY ANNEXED SHALL BEAR ITS PRO RATA PART OF TAXES;
PROVIDING THAT THE INHABITANTS THEREOF SHALL HAVE ALL THE
PRIVILEGES OF ALL THE CITIZENS OF FORT WORTH, TEXAS; PROVIDING THAT
THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT
HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF
ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT; PROVIDING FOR
SEVERABILITY AND NAMING AN EFFECTIVE DATE.
WHEREAS, a public heanng before the City Council of the City of Fort Worth, Texas,
wherein all interested persons were given an opportunity to be heard on the proposed annexation of
the terrntory herennafter described, was held nn the Cnty Council Chambers nn the Mumcnpal Office
Building of Fort Worth, Texas, on the 31st day of August 1999, which date was not more than forty
(40) days nor less than twenty (20) days pnor to nnstntutnon of annexation proceednngs, and
WHEREAS, a second public hearing before the City Council of the City of Fort Worth,
Texas, wherein all interested persons were graven an opportunity to be heard on the proposed
annexation of the terntory hereinafter described, was held in the temtory to be annexed in a portable

tent structure situated north of Robertson Road and west of Boat Club Road, Tarrant County, Texas,
on the 17th day of September 1999, which date was not more than forty (40) days nor less than
twenty (20) days pnor to the institution of annexation proceedings, and
WHEREAS, notice of the first such public hearing was published in a newspaper having
general circulation in the City of Fort Worth, Texas, and in the hereinafter described terntory on the
20th day of August 1999, which date was not more than twenty (20) days nor less than ten (10) days
prior to the date of such public heanng; and
WHEREAS, nonce of the second such public hearing was published m a newspaper having
general circulation in the City of Fort Worth, Texas, and m the hereinafter described terntory on the
3rd day of September 1999, which date was not more than twenty (20) days nor less than ten (10)
days pnor to the date of said public heanng; and
WHEREAS, a service plan providing for the extension of full municipal services into the
hereinafter described terntory was made available for inspection by and explained to the inhabntants
of the area to be annexed at the public hearings, and
WHEREAS, the Service Plan attached as Exhibit "B"was amended after the public hearings
and meets or exceeds all requirements under state law for the provision of services to the area to be
annexed, and
WHEREAS, all other requirements under state law have been met; and
WHEREAS, the population of the City of Fort Worth, Texas, is in excess of 100,000
inhabitants, and
WHEREAS, the hereinafter described terntory lies within the exclusive extraterntonal
jurisdiction of the City of Fort Worth, Texas, and

WHEREAS, the hereinafter described temtory lies adjacent to and adjoins the City of Fort
Worth, Texas, and
WHEREAS, the hereinafter described temtory contains 1,559 1 acres (2.436.square miles)
of land, more or less,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH, TEXAS:
SECTION 1.
That the following described land and temtory lying adjacent to and ad~oimng the City of
Fort Worth, Texas is hereby added to and annexed to the City of Fort Worth, Texas, and said
temtory hereinafter described shall hereafter be included within the boundary limits of the City of
Fort Worth, Texas, and the present corporate boundary limits of said Crty, at the vanous points
contiguous to the area hereinafter described, are altered and amended so as to include said area
wrtlun the corporate hmrts of the City of Fort Worth, Texas, to-wrt:
Being a 1559 1-acre tract out of the D C. Pace Survey, Abstract No 1245, the T Freeman
Survey, Abstract No 546, the G S Rall Survey, Abstract No 1985, the William
Robinson Survey, Abstract No 1310, the B.B.B & C RR Company Survey, Abstract
No 221, the E.G Barnett Survey, Abstract No 245, the G.S Rall Survey, Abstract No
1869, the A.C.H. & B Survey, Abstract No 56, the J.H. Simmons Survey, Abstract

of all the citizens m accordance with the Service Plan and shall be bound by the acts, ordinances,
resolutions and regulations of the City of Fort Worth, Texas.
SECTION 4
That attached hereto, marked Exhibit "B"and incorporated~herein for all purposes incident
hereto, ns the Service Plan providing for the extension of full municipal services into the area to be
annexed.

SECTION 5.
That Tarrant County Municipal Utility District is abolished on January 4, 2000, at 11 59
p.m. At that lime, the City will .take over .all .the. property .and other assets,. assume all debts,
liabilities and' obligations, and perform.all:functions of Tarrant County Municipal Utility District
No 1
SECTION 6.
That this ordinance shall and does amend every prior ordinance m conflict herewith, but as
to all other ordinances or sections of ordinances not m direct conflict, this ordinance shall be, and
the same is hereby made cumulative.
SECTION 7.
That it is hereby declared to be the intent of the City Council that the sections, paragraphs,
sentences, clauses and phrases of this ordinance are severable, ..and if any phrase, clause,.. sentence,
paragraph or section of this ordinance shall be declared unconstitutional by the valid ~udgrnent or
decree of any court of competent ~unsdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs .and sections. of this ordinance, since the same
would have been enacted by the Crty Council without the incorporation in this ordinance of any
unconstitutional phrase, clause, sentence, paragraph or section. If any of the land included within
the property description set out m Section 1 is presently part of and included within the linuts of any
other city, town, or village or is not within the ~unsdiction and authority of the City of Fort Worth
to annex, then that land is excluded and excepted from the annexed area.

That this ordinance shall take effect and be in full force and effect from and after the date of
its passage, and it is so ordained.

Full mumcnpal services to the Annexation Area will be furnished by or on behalf of the City of Fort
Worth, Texas, nn accordance wrath the following senvnce plan programs
1. PROGRAM FOR SERVICES TO BE PROVIDED WITHIN 60 DAYS
The Cnty will provnde the following senvnces m the Annexatnon Area within 60 days after the
annexatnon, unless otherwnse noted.
A. Police Protection
The Fort Worth Police Department will provide protection and law enforcement
services m the Annexation Area commencing immediately upon.annexation. The
services will include:
• Assignment of a Neighborhood Patrol Officer (NPO) to the Annexation
Area. The NPO will be assigned to the area 40 hours a week, with the 40
hours to be determined by the call load of the neighborhood. The NPO is
assigned a vehicle, pager and cell phone to allow the community 24-hour
access to the assigned officer The NPO is available to answer questions
from the neighborhood, provide creme information and statistics, and
facilitate resolution of problems (both creme-related and quality of life)
The NPO will be exclusively assigned to the Annexation Area to provide
standard NPO police services. The City reserves the right to reassign the
NPO consistent with future public safety needs and standard Police
Department policies.
• Assignment of beat officers from beat B-15 to patrol the Annexation
Area. The beat officers will be assigned on a 24-hour basis to assist the
NPO
• Backup for NPO will be as follows When the NPO is m service, non-
emergency calls will be held until the NPO unit is available. If the NPO
is in service, emergency calls will be answered by the nearest available
unit. NPO days off will be assigned based on lowest call nights.
• The complete range of resources available city-wide from the Police
Department that provide the ability to respond to a variety of public
safety needs.
The City will establish a police storefront in the Annexation Area in the former
offices of the Tarrant County MUD No 1 at 8510 Sprang Street within 30 days after
the property is vacated by Tarrant County MUD No 1 The storefront will serve as
abase for the NPO and will be open for limited hours only at the times the NPO is
present in the office. The City will periodically assess the viability of the storefront
at this location and may relocate the storefront to optimize police operations.
B Fire Protection and Emergency Medical Services
Fire protection and first responder services by existing personnel and equipment of
the Fort Worth Fire Department will be provided to the Annexation Area
commencing immediately upon annexation. These services include
• Fire suppression and rescue;
• Emergency medical services first response on life threatening medical

emergencies,
• Hazardous matenals rnitigation and regulation,
• Fire Safety Education,
• Dive rescue;
• Technical rescue;
• Aircraft/rescue/firefightmg;
• Fire protection system plan. review;
• Inspections,
• Emergency management planning.
These services are provided, on a city-wide basis, by over 700 employees operating
from 37 emergency fire stations and other non-emergency sites. .All Fort Worth
firefighters are certified by the Texas Commission on Fire Protection.
The City has established a temporary fire station housing an engine company with
4 personnel on duty 24 hours per day in the building located at 8510 Spnng Street
(identified as Eagle Mountain Fire Station No 2 according to documents provided
to the City by Tarrant County MUD No 1) The temporary fire station will be
operational on January 5, 2000 at 8.00 a.m. The City has constructed living quarters
in the Tarrant County MUD No 1 office at 8510 Spnng Street next door to the fire
station for the firefighters assigned to the station. This temporary facility may or
may not be the site of a permanent facility that the City intends to construct to serve
both the Annexation Area and surrounding areas that maybe annexed in the future.
The Eagle Mountain Volunteer Fire Department and the Tarrant Emergency Services
Distnct #1 have not reached an agreement with the Area Metropolitan Ambulance
Authonty to provide services to the Annexation Area. Accordingly, emergency
medical services will be provided.by the Fort. Worth Fire Department as EMT first
responder Ambulance services will be provided by the Area Metropolitan
Ambulance Authonty The Annexation Area will be served by these emergency
medical service providers with comparable service levels to the rest of the City
If the Eagle Mountain Volunteer Fire Department is unable to provide emergency fire
and medical services to Eagle Mountain Saginaw School Distnct campuses m
unincorporated areas m the City's extraterntonal ~unsdiction, the City of Fort Worth
is willing to enter into an interlocal agreement with the Eagle Mountain-Saginaw
School Distnct to provide such services.
C Sohd Waste Collection
Sohd waste collection shall be provided to the Annexation Area m accordance with
existing City ordinances and policies commencing upon annexation. The City will

allow Duncan Disposal, Inc. to continue to provide waste collection services
consistent with the level of services provided m the existing contract. The City
reserves the right to require amendments to those agreements and to charge fees to
customers for services not included m the agreements. Additional services such as
use of the City's landfill :by~residents, dead animal collection,; illegals dump cleanup,
and contract monitoring will be provided ~immediately~ upon annexation. Upon
expiration of the Duncan Disposal,.Inc. contract on September. 30, 2002,. collection
services m the Annexation Area will be included with other areas being considered
for collection contracts.
D Water and Wastewater Services
The City will provide water and wastewater services through existing facilities
located within the Annexation Area at rates established by City ordinance. The
facilities will be operated and maintained by the City's water and wastewater utility
m accordance with existing ordinances and policies and m conformance with the
policy for extension of water and wastewater services summarized in Section 4(D)
below
The City of Fort Worth will provide retail water and wastewater service to the
Annexation Area that will mclude•
Begin installation of lift station alarms and momtoring equipment that
will be monitored 24 hours each day to improve response times to
potential wastewater overflows into Eagle Mountain Lake. In addition,
the City will begin upgrades to all existing lift stations required to address
deficiencies with current lift stations that may not meet Fort Worth or
state minimum standards.
• The installation of tank level monitors and alarms on the existing elevated
storage tank in the Annexation Area to provide 24 hour momtoring each
day from the City's Supervisory and Data Acquisition (SCADA) system.
Integration of the distribution system into the Fort Worth system wil
allow the removal of the existing 8-inch water meter, improving
hydraulic performance of the existing water main that feeds the MUD
system. Within 24 months from the date of annexation, the City plans to
install a second water transrrussion main to the Annexation Area which
will result m a more reliable water system that can better accommodate
future growth wrtlun the existing development.
• The initiation of water meter reading and billing services and customer
service (871-8210), including 24 hour dispatch for emergency repairs
(871-8300)
• A departmental maintenance crew m the Eagle Mountain Water
Treatment Plant to serve the Annexation Area.

• • Maintain a collection box for the Annexation Area for payment of water
bills.
E. Roads and Streets Includm treet Lighting
The Transportation andPubhc~~Works Department will,assume maintenance of public
streets over which the City has jurisdiction. These .services aclude emergency
pavement repair and repair maintenance of public streets on an as-neededbasis.
Public streets will be included m the City's preventive maintenance program.
Preventive maintenance projects are prioritized on a City-wide basis and scheduled
based on a variety of factors, including surface condition, rideabilrty, age, traffic
volume, functional class, and -available funding. .Any necessary rehabilitation or
reconstruction will be considered and prioritized on a City-wide basis.
The City of Fort Worth will maintain existing public streetlights m the Annexation
Area.
The Transportation and Public Works Department will also provide regulatory
signage services in the Annexation Area. Traffic signal, stop, and all other regulatory
studies are conducted m conjunction with growth of traffic volumes. All regulatory
signs and signals are installed when warranted following an engineering study
Faded, vandalized, or rmssmg signs are replaced as needed. "CALL BACK" service
is provided 24 hours a day, 365 days a year for emergency sign repair
For mayor arterials and collectors, the marking of streets is on an 18-month
frequency All improved intersections and roadways are striped upon improvement.
All roadways are re-striped and remarked as needed.
F Parks, Playgrounds and Swimming Pools
Maintenance and operation of existing parks, playgrounds, swimming pools and
other recreational and community facilities wrtlun the Annexation Area that are
private facilities will be unaffected by the annexation. Residents of the Annexation
Area may utilize all existing parks and community service facilities throughout the
City unmediately As additional residential development occurs, dedicated parkland
or fees m lieu of parkland for neighborhood parks will be required under the Parkland
Dedication Requirements of the Subdivision Ordinance.
G Maintenance of Anv Other Publicly Owned Facility, Building or Service.
In the event the City acquires any other facilities, buildings or services necessary for
municipal services located m the Annexation Area, maintenance services will be
provided by the appropriate City department.

2. PROGRAM FOR PROVIDING ADDITIONAL SERVICES
In addition to the services identified above, the following services will be provided m the
Annexation Area within 60 days~a$er~ heannexation;{:unless: otherwise noted.
A. The residents of the Annexation-'Area will receiveaibrary~services from the.FortWorth
Public Library commencing-'immediately uponannexation. Immediately upon
annexation, all residents of the Annexation Area may utilize all. City library facilities.
Branch libranes m closest-proxunity.to the area to be.annexed.are .the Northside and
Diamond Hi1UJarvis facilities. -The .Central .Library, located in~ downtown Fort Worth,
serves the entire City as a reference and*information .resource center The need for
future library facilities based on existing and projected population growth will be
identified in a Library Comprehensive Plan.
B The City will provide .general municipal administration and administrative services
commencing immediately upon annexation.
C Commencing immediately upon annexation, the Transportation and Public Works
Department will provide drainage maintenance services m :the Annexation Area at
current City-wide service levels, including maintenance of all public drainage
channels within dedicated public drainage easements. The Transportation and Public
Works Department will provide the following services.~storm sewer maintenance and
watershed development review and inspection. In addition,. programs available to
City residents through the Transportation and Public Works Department include
sidewalks, speed humps, traffic volume counts, and neighborhood signs.
D Commencing immediately upon annexation, the Environmental Management
Department will provide the following services.
• Emergency spills and pollution complaints response
• Storm sewer discharge pollution prevention (commercial only)
• Water quality assessments for creeks
• As necessary, fluids lost dunng motor vehicle accidents will be recovered and
disposed of in a manner that m~mmizes their impact on the watershed and Eagle
Mountain Lake.
• Commercial entities and construction projects will be inspected for compliance
with certain discharge regulations associated with storm water runoff.
• Area creeks and drainage will be assessed and monitored for the presence of
matenals that affect the quality of water therein. Programs will be developed and
implemented to ensure the protection of these resources.
• Homeowners will be able to dispose of household hazardous waste at the City of
Fort Worth's Environmental Collection Center located at 6400 Bndge Street.

~ During the year 2000 operation cycle of the associated mobile collection unit (the
Crud Cruiser) at least one outreach collection will be performed. Additional
collections will be added as needed.
Regulated air pollution sources (including but not linited to gasoline Stage II
Vapor Recover ~Systems~_permitted~~:pointsource ,emissions, ,and:ma~or~source
emissions) will .be monitored::for compliance wrth Texas~Natural :Resource
Conservation.Commission:.air°quality'regulations.
• Nuisance air and water..quahty complaints wrll be .investigated m .a .timely
manner
E. Enforcement of the City's environmental health ordinances and.regulations, .including
but not hmrted to weed and. brush. ordinances, dunked and abandoned vehicle
ordinances, food handlers' ordinances and animal control ordinances, will be
provided within the Annexation Area commencing immediately upon annexation.
Complaints of ordinance or regulation violations wrthiin the area will be answered
and investigated by existing personnel beginning upon, annexation.
F The City's building, plumbing, mechanical, electrical, and all other construction
codes will be enforced within the Annexation Area commencing immediately upon
annexation.
G The City's zoning, sign, mobile home, dunk yard .and other •ordmances shall be
enforced m the Annexation Area .commencing immediately upon annexation.
H. All inspection services furnished by the City of Fort Worth, but not mentioned above,
will be provided to the Annexation Area commencing immediately upon annexation.
I. The Department of Engineering will provide information relating to flood plains
commencing immediately upon annexation.
3. PROGRAM FOR PROVIDING FULL MUNICIPAL
SERVICES WITHIN 4 %Z YEARS
In addition to the services listed above, the City will provide full municipal services to the
Annexation Area commensurate with the levels of services provided in other parts of the City unless
different characteristics of topography, land use, and population density are considered a sufficient
basis for providing different levels of service, no later than 4 %2 years after annexation. "Full
municipal services" are services that are funded in whole or m part by municipal taxation and
provided by the City within its boundaries. The City shall provide the services by any of the
methods by which it extends the services to any other area of the City

4. CAPITAL IMPROVEMENTS PROGRAM
The City will initiate construction of capital improvements necessary for providing full municipal
services for the Annexation Area as needed. Any such construction shall begin wrtlun two years
after annexation and shall be substantrally-completed-withm~4 %z~years:after annexation...: Acquisition
or construction-shall be accomphshed:by purchase,.lease,'or other~contract..Anysuch°construction
shall be accomphshed in a continuous~process~ and hall be:completed as soon.;as reasonably possible,
consistent with generally acceptedaocal engmeering~.and;arclutectural~standards and practices.
A. Police Protection. Except as noted. above, no capital unprovements are anticipated
at this time to provide police protection to the Annexation Area. Need for
construction of new facilities will be assessed periodically based on population
growth, predicted growth and call volume.
B Fire Protection. Except as noted above, no capital unprovements are anticipated at
this time to provide fire protection to the Annexation Area. Need for construction
of new facilities will be assessed periodically based on population growth, predicted
growth and call volume.
C Solid Waste Collection. No capital improvements are anticipated at this time to
provide solid waste collection services to the Annexation Area.
D Water and Wastewater. Except as otherwise noted, no capital improvements are
anticipated at this time to provide water service to the Annexation Area. Lift station
improvements will be constructed at the Dozier Creek facility to provide additional
capacity to accommodate additional growth within the drainage area m accordance
with Texas Natural Resource Conservation Commission design criteria.
Following is a summary of the Water and Wastewater Installation Policy (the service
extension policy) as set out in Section III of the City's Policy for the Installation of
Community Facilities.
The developer shall cause to be constructed all water and wastewater
facilities required to provide service to the development, subdivision, or
lot/tract. The developer shall be responsible for 100% of the cost for water
and wastewater facilities designed to provide service to the proposed
development. If larger facilities are required based on comprehensive study,
the additional incremental cost shall be borne by the City
Connection to existing City water mains for domestic water service to serve
residential, commercial, and industrial uses within the Annexation Area will
be provided m accordance with existing City ordinances and policies. Upon
connection to existing mains, water will be provided at rates established by

City ordinances for such service at the normal rates charged throughout the
City
Connections to existing City samtary sewer mains for.samtary sewage service
in the Annexahon.Area~:will be provided,m-~accordance w~nth existing City
ordinances and policies. Upon -connection ~to exishng samtary sewer mains,
samtary sewage service will be .provided at .rates .established by City
ordinances for suchaervrce at the.normal:rates charged-throughout the City
E. Roads and Streets. No road or street-related caprtal.unprovements are anticipated at
this tune. Future extensions of roads or streets and future installation of related
facilities, such as traffic control devices, will be governed by the City's .standard
policies and procedures.
F Drainage Utilitk No capital improvements are anticipated at this time to provide
drainage services.
G .Street Lightm~ It is anticipated that new subdivisions m the Annexation Area will
install street hghhng m accordance with the City's standard policies and procedures.
In other cases, the City will consider installation of additional street hghtmg in the
Annexation Area upon request, with pnonty given to street fighting for traffic safety
Provision of street hghtmg will be m accordance with the City's street hghtmg
policies, and those of the providing utility
H. Parks. Playgrounds and Swimmm P,g ools. Planning for capital improvements such
as parkland acquisition and development of facilities will be based on future land use
of the area, goals established by the Parks, Recreation and Open Space
Comprehensive Plan and appropnation of resources.
I. Other Publicly Owned Facihhes~Buildmg or Services. Additional Services. In
general, other City functions and services, and the additional services described
above can be provided for the Annexation Area by using existing capital
improvements. Additional capital improvements to provide City services are not
anticipated at this lime.
5. IMPACT FEES
Notwithstanding any other provision of this service plan, a landowner within the Annexation Area
will not be required to fund capital improvements necessary to provide mumcipal services in a
manner inconsistent with Chapter 395 of the Local Government Code governing unpact fees, unless
otheivvise agreed to by the landowner

It is recommended that the City Council

2. Authorize the City Manager to execute an agreement to assume Tarrant County Municipal Utility
District No 1's contract with Duncan Disposal, Inc for solid waste collection and to extend the
expiration date to September 30, 2002, and
3 Authorize the City Manager to execute an agreement with Gary Baker, Deborra Baker and the
Estates of Eagle Mountain, Ltd to extend for 45 days the obligation to reimburse them for certain
development expenses incurred in connection with water, wastewater and drainage infrastructure in
the Eagle Mountain MUD
DISCUSSION
Public hearings concerning annexation of Tarrant County MUD No 1 were held on August 31 and September
17, 1999, as required by state law The September 17th hearing was held in the area to be annexed
On October 8, 1999 (M&C PZ-2148), the City Council instituted the annexation and directed staff to
initiate actions necessary for the orderly transition of services outlined in the proposed service plan,
including the location and acquisition of property or the modification of existing facilities for a police
storefront and temporary fire station M&C PZ-2148 reflected the City's intent to use the cash assets of
the MUD, to the extent lawful, for providing services to the annexed area It also stated that the Water
and Human Resources Departments would review existing vacancies within the Water Department to
determine whether the qualifications of existing MUD staff fulfill the job requirements for those
vacancies

Communication to authorize the expenditure of $120,000 00 for purchase of a fire engine and
acquisition of all interest of the Eagle Mountain Volunteer Fire Department in the property located at
8510 Spring Street is on the City Council's agenda for tonight's meeting
Upon transfer of the assets of the Tarrant County MUD to the City and completion of a final audit, City
staff will come back to the City Council to request allocation of MUD funds consistent with the City
Council's commitment to use the cash assets, to the extent lawful, for providing services in the MUD
Employment of former employees of Tarrant County MUD No. 1
The Water Department has extended employment offers to the five employees of Tarrant County MUD
No 1 Four employees have accepted employment with the City One employee declined employment
but will work for the City on a temporary basis to assist in the transition process as an S01
Use of funds in rate stabilization account for payment of water bills
The Tarrant County MUD is in the process of sending final water bills to its customers as of December
15, 1999 The Water Department will read all customer meters immediately after annexation and will
bill customers for service through January 25, 2000 The Water Department will transfer funds from the
MUD's rate stabilization fund to make up for the loss of revenue for water sales between December 15,
1999, and January 5, 2000, if any

Assumption of solid waste collection contract between Tarrant County MUD and Duncan Disposal Inc.
Tarrant County MUD and Duncan Disposal, Inc. entered into a contract for collection of solid waste as
of October 1, 1998 The contract expires on September 30, 2001 By law, the City assumes all
obligations of the MUD upon dissolution of the MUD, which will occur upon annexation In this
connection, City staff recommends that the City Manager be authorized to execute an assumption
agreement in order to (1) document the City's assumption of the MUD's contractual rights and
obligations, (2) extend the term of the agreement to September 30, 2002, and (3) revise the rate
adjustment provisions of the agreement to mirror the consumer price index adjustment contained in the
City's other waste collection agreements
Deferral of obligation to reimburse Gary Baker, Deborra Baker and Estates of Eagle Mountain Ltd.
Gary Baker, Deborra Baker and Estates of Eagle Mountain, Ltd have spent money on water,
wastewater and drainage facilities in the Eagle Mountain Municipal Utility District, consisting of
approximately 457 acres located within the Tarrant County MUD, which they planned to recover through
the issuance of bonds by the Eagle Mountain MUD Pursuant to state law, a city that annexes a
municipal utility district and precludes the ability of the district to issue bonds must pay to the developer
certain development costs that would have been eligible for reimbursement from bond proceeds
Reimbursement of a developer in effect constitutes acquiring. a community water and wastewater
system
City staff and Gary Baker have discussed alternatives to payment of these reimbursable amounts by
the City to Mr Baker which would make continued development by Mr Baker economically feasible
Mr Baker has agreed to extend the deadline for reimbursement by the City to February 15, 2000, to
continue such discussions If the parties have not agreed on an alternative to reimbursement to Mr
Baker by the City by that date, the City will be obligated to pay Mr Baker the reimbursable expenses
not in dispute at that time Mr Baker claims a right to reimbursement of $2,084,697 32 The City
asserts that the amount owned is between $1,500,000 00 and $2,084 697 32 Mr Baker will retain the
right to pursue collection of all disputed amounts
