L/ / -` v AN ORDINANCE VACATING, ABANDONING, CLOSING AND EXTINGUISHING A 16 FOOT WIDE BY 300 FOOT LONG ALLEY RIGHT-OF-WAY CONTAINING APPROXIMATELY 4,800 SQUARE FEET, AND LYING ADJACENT TO LOTS 1 THRU 12, BLOCK 13, POLYTECHNIC HEIGHTS ADDITION, IN THE CITY OF FORT WORTH; TEXAS, PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1. That a 16 foot wide by 300 foot long alley right-of--way containing approximately 4,800 square feet, and lying adjacent to Lots 1 thru 12, Block 13, Polytechnic Heights Addition to the City Fort Worth, Texas, as recorded ~m Volume 63, Page 109, Plat Records, Fort Worth, Tarrant County, Texas, and as more specifically described m Exhibit A attached hereto and incorporated herein by reference be and the same is vacated, abandoned and permanently closed and extinguished. SECTION 2. That the fee to the land in the above described alley is hereby released and shall revert to the adjacent owner as provided by law SECTION 3 That all ordinances or parts of ordinances m conflict herewith are hereby repealed. SECTION 4 That this ordinance shall take effect and be in full force and effect from and after the date of rts passage, and rt is so ordained. DISCUSSION Steven N Roberts, on behalf of Texas Wesleyan University, adjacent owners of the above-described alley, have requested vacation of said alley to allow consolidation of adjacent university properties to enable development expansion Said alley is not currently improved and an appropriate utility easement will be retained for electric service unless, and until, alternate relocation is undertaken at the applicant's expense The Engineering Department, Real Property Management Division has determined, and received, fee payment in the amount of $48 for said alley The City Plan Commission recommended vacation of the alley at its October 25, 2000, meeting Reviewing City departments and public utility companies have raised no objections to this request. An acceptable replat has been received This request is located in COUNCIL DISTRICT 8 FISCAL INFORMATION/CERTIFICATION The Finance Director certifies that this action will have no material effect on City funds.
