ORDINANCE NO. /~3 ~/ AN ORDINANCE VACATING, ABANDONING, CLOSING AND EXTINGUISHING A PORTION OF AVENUE I, A. H FISH ADDITION, TO THE CITY OF FORT WORTH, TEXAS, PROVIDING FOR REVERSION OF FEE IN SAID LAND, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 THAT a 60 foot wide and approximately 53 foot long segment of Avenue I, lying west of Hendricks Street and east of Mitchell Boulevard, containing approximately 3,180 square feet, more or less, and situated between Lots 9A and 10A, A. H Fish Addition, as recorded in Volume 388-L, Page 60, Plat Records, Tarrant County, Texas, and as more specifically described in Exhibit A attached hereto and incorporated herein by reference be and the same is vacated, abandoned and permanently closed and extinguished SECTION 2. That the fee to the land in the above described street right-of-way is hereby released and shall revert to the adjacent owner as provided by law, SAVE AND EXCEPT that existing utility, drainage and public access easements within the vacated portion of the street right-of-way shall be retained for any existing utilities or public access purposes until satisfactory relocation arrangements are made and agreed to by the City of Fort Worth SECTION 3 That all ordinances or parts of ordinances in conflict herewith are hereby repealed SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained APPROVED AS TO FORM AND LEGALITY .. H Fish Addition, City of Fort Worth, Texas, as recorded in Volume 388-L, Page 60, Tarrant County Plat Records. DISCUSSION Mr Jim Anderson, on behalf of the Tarrant County Hospital District, owner of the above-described property, has requested vacation of a portion of Avenue "I" as described above to enable the expansion of medical facilities for John Peter Smith Hospital The right-of-way shall be retained for public utilities until satisfactory relocation arrangements are made The Engineering Department, Real Property Management Division has established a $1 00 fee amount as a taxing entity public service request. Reviewing City departments and public utility companies have raised no objections to this request.
