Ordinance No >> AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SEWER CAPITAL PROJECT FUND IN THE AMOUNT OF $57,676 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING CHANGE ORDER NO 1 WITH STABILE & WINK, INC. FOR WATER AND SANITARY SEWER LINE REPLACEMENTS (iJiVIT 1) AND PAVEMENT RECONSTRUCTION (UNIT II, ALTERNATE NO 2) ON BIRD STREET, BLANDIN AVENUE, CHENAULT STREET, EAGLE STREET, MAURICE STREET AND DALFORD STREET, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1999-00 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Sewer Capital Project Fund in the amount of $57,676 from available funds for the purpose of funding Change Order No. 1 with Stabile & Winn, Inc. for Water and Samtary Sewer Line Replacements (Unit 1) and Pavement Reconstruction (Unit II, Alternate No 2) on Bird Street, Blandin Avenue, Chenault Street, Eagle Street, Maurice Street and Dalford Street. SECTION 2. Should any portion, sectron or part of a section of thrs ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opuuon or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No. 13886 and all other ordinances and appropnations amending the same except in those instances where the provisions of thrs ordinance are in direct conflict with such other ordinances and appropriations, in which instance sard conflrchng provrsrons of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect and be in full force after the date of its passage, and rt rs so ordained. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Sewer Capital Project Fund in the amount of $57,676 00 from available funds, and 3 Execute Change Order No 1 to City Secretary Contract (No 25736) with Stabile & Winn, Inc. in the amount of $117,390 00 to provide for increased pay item quantities, thereby increasing the contract amount to $1,593,682 75 DISCUSSION On March 28, 2000 (M&C C-17955), the City Council approved a contract with Stabile & Winn, Inc. in the amount of $1,476,292 75 for water and sanitary sewer line replacements (Unit I) and pavement reconstruction (Unit II, Alternate No 2) on Bird Street (Sylvania Avenue west to dead end), Blandin Avenue (Belknap Street to Race Street), Chenault Street (Brandies Street to Covello Street), Eagle Street (Belknap Street to Yucca Avenue), Maurice Street (Belknap Street to Seaman Avenue), and Dalford Street (Fairview Street to Belknap Street) An apparent misinterpretation of the plans during a construction staking survey by A.N.A. Consultants, L.L.C ,resulted in nine water services being laid out short of the required distance behind the new curb and gutter along the west side of Blandin Avenue These water services needed to be relayed with new copper, resulting in an additional cost of $6,075 00 to be reimbursed by A.N.A. Consultants, L.L C Additionally, it was determined that an existing 6-inch sanitary sewer line in Blandin Avenue should be replaced with a new 8-inch sanitary sewer line This work was not included in the original. scope of engineering services The cost associated for this additional work is $57,676 00 and will be paid for by the Water Department. This change will cost the City an additional $53,639 00 This cost is based on the actual bids received for cement stabilization, and therefore would not be considered as an extra cost due to errors or omissions by the City's consultant.
