HomeMy WebLinkAboutOrdinance 14269> ; ORDINANCE NO ~ ~~~ ~' 9 AN ORDINANCE AMENDING ORDINANCE NO. 13967 BY REDESIGNATING CERTAIN PROPERTY IN TARRANT COUNTY, TEXAS AS FORT WORTH TAX ABATEMENT REINVESTMENT ZONE NO 32; AND FURTHER PROVIDING THAT THIS ORDINANCE IS CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Crty Council of the City of Fort Worth, Texas ("City") previously adopted Ordinance No 13967, under which certain property m Tarrant County, Texas was designated as Fort Worth Tax Abatement Reinvestment Zone No 32, and WHEREAS, the City wishes to correct the legal descnption of the property designated as Fort Worth Tax Abatement Reinvestment Zone No 32 by replacing Exhibit "A" of Ordinance No 13967 with Exhibit "A" of this Ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS THAT: SECTION 1. Ordinance No 13967 is hereby amended by replacing Exhibit "A" thereof with Exhibit "A" of this Ordinance, attached hereto and hereby made a part of this Ordinance for all purposes. SECTION 2. This Ordinance shall be cumulative of all ordinances of the City, except where the provisions of this Ordinance are m direct conflict with the provisions of such other ordinances, m which case the conflicting provisions of such other ordinances are hereby repealed. SECTION 3. The sections, paragraphs, sentences, clauses and phrases of this Ordinance are severable. If any portion of this Ordinance is declared illegal or unconstitutional by the valid final judgment or decree of any court of competent ~unsdiction, such. illegality or unconstitutionality shall not affect the legality and enforceability of any of the remaining portions of this Ordinance. SECTION 4. This Ordinance shall be m full force and effect following its adoption. AND IT IS SO ORDAINED. Adopt the attached ordinance which amends Fort Worth Tax Abatement Reinvestment Zone Number 32 pursuant to the Texas Property Redevelopment and Tax Abatement Act, Tax Code, Chapter 312. DISCUSSION The Fort Worth Tax Abatement Reinvestment Zone Number 32 is located in the Bell Helicopter Textron manufacturing plant development in east Fort Worth The exact amended boundaries of the property are described in Exhibit A of the attached Ordinance Bell Helicopter Textron's Tax Abatement application was approved by the City Council in October 1999 This site was selected for the construction of a manufacturing facility associated with development of the V-22 Osprey When the original legal description of Reinvestment Zone Number 32 was prepared, two tracts of land were inadvertently excluded, therefore, only one of three tracts actually appeared in the legal description of the original ordinance. However, the intent was to include all three tracts as Reinvestment Zone Number 32. The attached ordinance correctly amends the intended boundaries of the Reinvestment Zone. Approval of this Mayor and Council Communication and the attached ordinance does not change the effectiveness of the Tax Abatement Agreement between the City and Bell Helicopter A public hearing on this matter is required by the Texas Property Redevelopment and Tax Abatement Act.
