c` e. A ,~ ORDINANCE NO. r~ U AN ORDINANCE VACATING, ABANDONING, CLOSING AND EXTINGUISHING FIVE (5) SCATTERED UTILITY EASEMENTS, MATTHEWS SUBDIVISION, TO THE CITY OF FORT WORTH, TEXAS;. PROVIDING FOR REVERSION OF FEE IN SAID LAND, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. SECTION 1 THAT five (5) scattered utility easements varying in width from 5 feet to 15 feet, ar~i in length from 68 feet to 232 feet, and containing approximately 5,381 square feet, more or less, as located in proposed Lot 1-R, Block 1, Matthews Subdivision, as • recorded in Volume 388-46, Page 259, and Volume 3575, Page 1, Deed Records of Tarrant County, Texas, and as more specifically described in Exhibit A attached hereto and incorporated herein by reference be and the same is vacated, abandoned and permanently closed and extinguished SECTION 2 That the fee to the land in the above described vacated scattered utility easements is hereby released and shall revert to the adjacent owner as provided by law SECTION 3 That all ordinances or parts of ordinances in conflict herewith are hereby repealed • y ~ ~ .`. DISCUSSION T.J Flynn (J B.J Development) of Windermere, Florida, owner of the property, has requested this vacation to enable replatting with the encompassing lot for re-development of the site Reviewing City departments and public utility companies have raised no objection to this vacation request. Southwestern Bell requires easements retained over these easements in which aerial facilities are located, unless the applicant relocates said facilities at his expense.
