CO SURVEY, ABSTRACT 1135, TARRANT COUNTY, TEXAS, PROVIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT HEREWITH, PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT, PROVIDING FOR SEVERABILITY, AND NAMING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That, in accordance with and subject to that certain Joint Resolution and Agreement between the City of Fort Worth and the Town of Haslet, a copy of which is attached hereto and expressly made a part hereof, the following described land within the corporate limits of the City of Fart Worth is hereby disannexed and ordered discontinued as a part of the City of Fort Worth, Texas, said land being described as follows Being a tract of land situated in the G Overton Survey, Abstract No 1185 and the M F P &P RFC. DRAWN TM URTER d BURGESS, ING ,6,6,,,,x„ „„~~T DESIGNED 1067 V1010l~TX 76107-71St °~'~'ss ~' 106 NO. 870087-0101 CHECKED JFK City of Fort Worth, Texas M~yoe and Council communicAtion DATE REFERENCE NUMBER LOG NAME PAGE 5/9/00 G-12912 12LIMITS 1 of 2 SUBJECT ORDINANCE DISANNEXING AND DISCONTINUING FROM THE CORPORATE LIMITS OF THE CITY OF FORT WORTH A 152 893 ACRE TRACT OF LAND SITUATED IN THE G OVERTON SURVEY, ABSTRACT NO 1185 AND THE M F P & P RR COMPANY SURVEY, ABSTRACT NO 11.35, TARRANT COUNTY, TEXAS RECOMMENDATION It is recommended that the City Council adopt the attached ordinance disannexing and discontinuing from the corporate limits of the City of Fort Worth, the above subject 152 893 acre tract of land situated in the G Overton Survey, Abstract No 1185 and the M F P & P RR Company Survey, Abstract No 1135, Tarrant County, Texas DISCUSSION On April 14, 1987 (M&C G-7028), the City Council approved a Joint Resolution and Agreement between the City of Fort Worth (Fort Worth) and the Town of Haslet (Haslet) to adjust the corporate boundaries and extra-territorial jurisdiction of the two cities The purpose of the Joint Resolution and Agreement, identified as Resolution No 1158, was to facilitate the proposed annexation and development of the Fort Worth Alliance Airport site Because of overlapping extra-territorial jurisdiction, and because a portion of the proposed airport site was located within the city limits of Haslet, it was necessary that Fort Worth and Haslet enter into a Joint Resolution and Agreement so that the future Alliance Airport would be located entirely within the corporate boundaries of Fort Worth A portion of the Joint Resolution and Agreement specifically provided that Haslet would disannex a 152 893 acre tract of land so that Fort Worth could construct an additional runway sometime in the future, if necessary Accordingly, Haslet disannexed the 152 893 acre tract which was then annexed by Fort Worth The Joint Resolution and Agreement further provided that if the construction of the additional runway was not commenced within fifteen years after the date of the adoption of the Joint Resolution and Agreement, Fort Worth would disannex the 152 893 acre tract and release all extra- territorialjurisdiction rights it may have in the tract, so that the subject property may then be annexed by Haslet. To date, the City of Fort Worth has not constructed a runway on the subject property, and with two years left in the fifteen year period, there are no plans to do so Accordingly, on February 29, 2000 (M&C G-12832), the City Council adopted a Joint Resolution and Agreement whereby the City of Fort Worth agreed to disannex the subject property prior to the expiration of the prescribed fifteen year period, and release it from Fort Worth's extraterritorial jurisdiction so that Haslet may then annex it into its corporate limits In accordance with that Joint Resolution and Agreement, attached hereto for the City Council's consideration is an ordinance which, if adopted by the City Council, will disannex and discontinue the subject tract from the Fort Worth corporate limits The City staff. recommends that the City Council adopt the subject ordinance City of Font Worth, Texas ~1V~u~a~ And C,,~runc~l a~n~un~cut~ian C DATE 5/9/00 REFERENCE NUMBER G-12912 LOG NAME 12LIMITS PAGE 2 of 2 SUBJECT ORDINANCE ` DISANNEXING AND DISCONTINUING FROM THE CORPORATE LIMITS OF THE CITY OF FORT WORTH A 152 893 ACRE TRACT OF LAND SITUATED IN THE G OVERTON SURVEY, ABSTRACT NO 1185 AND THE M F P & P RR COMPANY SURVEY, ABSTRACT NO 1135, TARRANT COUNTY, TEXAS FISCAL INFORMATION/CERTIFICATION Approval of the proposed ordinance will not require the expenditure of City of Fort Worth funds.
