HomeMy WebLinkAboutOrdinance 14187.~ ORDINANCE NO. ~ y~~'7 AN ORDINANCE VACATING, ABANDONING, CLOSING AND EXTINGUISHING STREET RIGHTS-OF-WAY, LOCATED IN PORTIONS OF EAST BLUFF STREET AND NORTH JONES STREET, CITY OF FORT WORTH, TEXAS, PROVIDING FOR REVERSION AND RELEASE OF THE CITY'S RIGHT, TITLE AND INTEREST IN SAID LAND; PROVIDING FOR CONDITIONS PRECEDENT TO THE OCCURRENCE OF SAME, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS s SECTION 1 THAT subject right-of--way dedicated to East Bluff Street is variable m width and abuts Block 12, Original Town of Fort Worth, Lots 10, 11, 12, and 13, Land 600 Subdvision, an unrecorded subdivision to the City of Fort Worth, and Lots 1, 2, 3, 4, 5, and 6, and Parts of Lots 7 and 8, Mark Evans Subdivision, a subdivision to the City of Fort Worth, per the plat recorded m Volume 864, Page 75 of the Tarrant County Plat Records, and that subject right-of--way dedicated to North Jones Street measures 60 feet in width and abuts Blocks 12 and 13, Original Town of Fort Worth, and Lot 1, Mark Evans Subdivision, a subdivision to the City of Fort Worth, per the plat recorded m Volume 864, Page 75 of the Tarrant County Plat Records, as said portions of said street rights-of--way are more specifically described m Exhibit "A", attached hereto and incorporated herein, be and the same are vacated, abandoned, permanently closed and extmgulshed. SECTION 2. That subject to the occurrence of the conditions prescribed m Section 3 hereof, all the City's right, title and interest m and to the land m and under the above-described street rights-of--way is released and shall revert to the property owner of the fee simple title to the land as provided by law ~ 3~ SECTION 3. That the vacation, abandonment, closure and extmguishments of the above-described portion of the street nghts-of--way, and the release and reversion of the City's nght, title, and interest in and to the land therein, shall be subject to and conditioned upon (i) the approval of the final plat by the City Plan Commission, and (ii) the filing of said final plat m the Tarrant County Plat Records on or before the date that is sixty (60) months from the date of this Ordinance. In the event such final plat is approved and filed for record m the Tarrant County Plat Records wrtlun the prescribed time, then a copy of said final plat shall be attached as Exhibit "B" to this ordinance, as same is filed m the office of the City Secretary of the City of Fort Worth, and the attachment of said final plat as Exhibit "B" shall constitute conclusive evidence of the occurrence of such conditions. In addition, the above-described portion .of the street nghts-of--way shall remain open as public street nghts-of--way unless and until the vacation, abandonment, closure and extinguishments of them become effective upon satisfaction of the conditions stated above. The petitioner has delivered payment for the fair market value of the land in the subject nghts-of--way, as prescribed by the City, which the City shall hold mescrow m aninterest-beanng account penchng the filing of the final plat. In the event said plat is not approved by the City and filed m the Tarrant County Plat Records on or before the date that is sixty (60) months from the date of this Ordinance, then this ordinance shall become null and void, the same as if rt had never been adopted, the vacation, abandonment, closure and extinguishments of the street nghts-of--way, and the release and reversion of the nght, title and interest m and to the land therein shall not take effect; and the petitioner's land payment plus all interest earned thereon shall be returned to petitioner -2- • J SECTION 4. That all ordinances or parts of ordinances m conflict herewith are hereby repealed. SECTION 5. The Transportation and Public Works Department requires a Traffic Impact Study to be submitted for review prior to the acceptance of a replat. On August 25, 1999, the City Plan Commission recommended approval of this request, subject to the above described items.
