HomeMy WebLinkAboutOrdinance 14298ORDINANCE NO I ~~Z /O AN ORDINANCE AMENDING SECTION 7-317 OF ARTICLE VIII, FLOODPLAIN PROVISIONS, CHAPTER 7, "BUILDINGS", OF THE CODE OF THE CITY OF FORT WORTH (1986), PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PROVISIONS OF ORDINANCES AND THE CODE OF THE CITY OF FORT WORTH, PROVIDING A SAVINGS CLAUSE, PROVIDING A SEVERABILITY CLAUSE, AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS Section 1 "Section 7-317 of the Code of the City of Fort Worth (1986), as amended, is hereby amended, and after having been so amended shall be and read as follows "Sec. 7-R317 Basis for establishing the areas of special flood hazard The areas of special flood hazard identified by the Federal Emergency Management Agency in the most current scientific and engineering report titled "The Flood Insurance Study for the City of Fort Worth," dated August 23, 2000, with accompanying Flood Insurance Rate Maps (FIRM) or any amended or supplementary maps, or any comparable or similar map which is a substitute or replacement therefore, as well as any revisions thereto, are hereby adopted by reference and declared to be a part of this article " Section 2 That this ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth (1986), as amended, affecting Chapter 7, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event such conflicting provisions of such ordinances and such Code are hereby repealed Section 3 That all rights or remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of Chapter 7 of the Code of the s City of Fort Worth (1986), as amended, which have accrued at the time of the effective date of this ordinance, and, as to such accrued violations, and all pending litigation, both civil or criminal, whether pending in court or not, under such chapter and/or other ordinances same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts Section 4 That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void., ineffective or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such voidness, ineffectiveness or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section Section 5 This ordinance shall be in full force and effect from and after August 23, 2000, and it is so ordained APPROVED AS TO FORM AND LEGALITY Assistan ity Attorney Date ~`! ~~~ Adopted o ~~S ~~ D Effective 8 -~~ S -~ O City of Fort Worth, Texas ~11~A~ar And aunc~l anlnlun~cAt~an C C DATE REFERENCE NUMBER LOG NAME PAGE 8/15/00 G-12989 30FLOODPLAIN 1 of 1 SUBJECT ADOPTION OF CITY ORDINANCE AMENDING SECTION 7-317 OF ARTICLE VIII, FLOODPLAIN PROVISIONS, CHAPTER 7, CODE OF THE CITY OF FORT WORTH RECOMMENDATION It is recommended that the City Council adopt the attached ordinance amending Section 7-317 of Article VIII, Chapter 7, "Buildings" of the Code of the City of Fort Worth (1986) DISCUSSION On June 13, 1995 the City Council adopted Ordinance No 11998 which adopted the Flood Insurance Study for the City of Fort Worth dated August 2, 1995 The Federal Emergency Rate Management Agency will issue a new Flood Insurance Study for the City of Fort Worth with an effective date of August 23, 2000 The recommended ordinance will adopt the new Flood Insurance Study and will become effective the same date that the Flood Insurance Study becomes effective The Federal Emergency Management Agency is issuing the new Flood Insurance Study to reflect the new base flood elevations determined by the United States Army Corps of Engineer's restudy of the Trinity River FISCAL INFORMATION/CERTIFICATION The Finance Director certifies that this action will have no material effect on City funds MG k Submitted for City Manager's FUND ACCOUNT CENTER AMOUNT CITY SECRETARY Office by: (to) ~ P~ 4 ~OVE® Mike Groomer 6140 G~~ i 'u0~.1l~!l.~~~ Originating Department Head: AtlG i5 200® A, Douglas Rademaker 6157 (from) y ~~~~ 1~~~ Additional Information Contact: Gitp Secretary of the Citp of Fort ytJorth, Tsxas A.
