HomeMy WebLinkAboutOrdinance 18988-01-2010Ordinance No 18988-01 2010 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE PARK GAS LEASE PROJECT FUND IN THE AMOUNT OF $129 059 44 FROM AVAILABLE FUNDS FOR ALL WORK PHASES OF THE ED K. COLLETT PARK PROJECT PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2009-2010 and in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the Park Gas Lease Project Fund in the amount of $129 059 44 from available funds, for all work phases of the Ed K. Collette Park project SECTION 2 That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction such decision, opinion or judgment shall in no way impair the remaining portions, sections, or/parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 18809 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Collett Park and Adopt Appropriation Ordinance (COUNCIL DISTRICT 7) RECOMMENDATION It is recommended that the City Council 1 Authorize the transfer of $129 059 44 in gas well bonus revenue from the 'unspecified" work phase for the Ed K. Collett Park project to various other work phases for the same project within the Park Gas Lease Project Fund 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Park Gas Lease Project Fund in the amount of $129 059 44 from available funds for all work phases of the Ed K. Collett Park project, and 3 Authorize the City Manager to execute a construction contract with Dirtco d/b/a Styles Contracting in the amount of $281 189 30 for parking ballfield and park improvements at Ed K. Collett Park. DISCUSSION The purpose of this M&C is to authorize the award of construction contract to Dirtco d/b/a Styles Contracting in the amount of $281 189 30 for parking ballfield and park improvements at Ed K. Collett Park. This M&C also recommends that the Council Council authorize the appropriation of gas well lease bonus funds in the amount of $129 059 44 in accordance with the CFW Financial Management Policy The 2004 Capital Improvement Program (CIP) Proposition Two allocated $81 000 00 for parking improvements, $154 500 00 for ballfield improvements and $103 000 00 for ballfield lighting replacement, totaling $338 500 00 for Ed K. Collett Park. Additionally on July 29 2008 (M&C L 14605) the City Council authorized the execution of a gas lease agreement with Range Resource Corporation in which the net lease bonus amount of $129 059 44 was earmarked for park improvements at the site The total of all funds available for this project amount is $467 559 44 On February 3 2009 (M&C C-23315) the City Council authorized the City Manager to execute a contract with HNTB Corporation in the amount of $54,294 00 for the development of construction documents for parking ballfield and ballfield lighting renovations at Collett Park. There will be no impact on the annual operating budget with this project. Construction is anticipated to commence in January 2010 and be completed in May 2010 Ed K.
