AN ORDINANCE VACATING AND EXTINGUISHING A FIFTEEN FOOT
WIDE ALLEY RIGHT-OF WAY, SITUATED IN BLOCK 3, SOUTHSIDE
ADDITION, AN ADDITION TO THE CITY OF FORT WORTH AS
RECORDED IN VOLUME 204-A, PAGE 109 OF THE PLAT RECORDS OF
TARRANT COUNTY, TEXAS, AND CONTAINING APPROXIMATELY
0.029 ACRE OF LAND MORE OR LESS, PROVIDING FOR REVERSION
OF FEE IN SAID LAND, PROVIDING THAT THE CITY SHALL RETAIN
ALL EXISTING UTILITIES EASEMENTS, REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
SECTION 1
That a fifteen foot alley nght-of way situated in the Block 3 Southside Addition, an
Addition to the City of Fort Worth as recorded m Volume 204-A, Page 109 of the Plat Records
of Tarrant County Texas, and containing approximately 0 029 acre (1,282 square feet) of land
more or less, and as more specifically described in Exhibits A and `B" attached hereto and
incorporated herein by reference be and the same is vacated and extinguished.
SECTION 2.
That the easement to the land in the above-described vacated street nght of way is hereby
released and shall revert to the adjacent owner as provided by law
SECTION 3.
All existing utility easement be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 4
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

BEING a fifteen (15) foot wide strip of land designated as a Public Alley on the
plat of Block 3 SOUTHSIDE ADDITION to the City of Fort Worth Tarrant
County Texas according to the plat thereof recorded in Volume 204-A, Page
109 of the Plat Records of Tarrant County Texas and being more particularly
described by metes and bounds as follows
BEGINNING at a point, at the Northwest corner of Lot 1 of said Block 3 and said
POINT OF BEGINNING also lying in the South right-of-way line of Malta
Street,
THENCE SOUTH 85 50 feet, along the East boundary line of said Public
Alley and the West boundary line of said Lot 1 and also Lot 2, to a point,
THENCE WEST 15 00 feet, crossing said Public Alley to a point in the
West boundary line of said Public Alley and the East boundary line of Lot
7 of said Block 3
THENCE NORTH 85 50 feet, along a the West boundary line of said
Public Alley and the East boundary line of said Lot 7 to a point at the
Northeast corner of said Lot 7 lying in the South right-of-way line of

Adopt an Ordinance Vacating an Eighty-Six Foot by Fifteen Foot Portion of an Alley Between Lots 1 2 and
7 Block 3 Southside Addition Located at Malta Street and Flint Street (COUNCIL DISTRICT 9)
RECOMMENDATION
It is recommended that the City Council
1 Adopt an ordinance vacating an eighty-six foot by fifteen foot portion of an alley between Lots 1 2 and
7 Block 3 Southside Addition located at Malta Street and Flint Street; and
2 Waive any and all purchase fee value of the vacated land in accordance with City policy (M&C G-
15624)
DISCUSSION
Brittain and Crawford on behalf of Bertha Jimenez, has requested the vacation of the above referenced
alley to improve vehicle circulation in the parking lot adjacent to the existing restaurant. The City Plan
Commission recommended approval of this request at its meeting on August 26 2009 An acceptable
replat (FS-09-113) has been received Any existing utilities will be relocated at the applicant's expense or
retained within a designated easement along with an appropriate plat note that no permanent structures
may be constructed or placed thereon
The City of Fort Worth (City) originally obtained the above mentioned right-of-way through the platting
process The City does not own land under or adjacent to the above referenced alley Since no City funds
have been expended to purchase property or easement rights collection of the fair market value or any
portion thereof is recommended by staff to be waived
This land is located in COUNCIL DISTRICT 9
