HomeMy WebLinkAboutOrdinance 19018-02-2010Ordinance No 19018-02 2010 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL TRUST FUND IN THE AMOUNT OF $182,965 00 WITH $82,965 00 TRANSFERRED FROM THE GENERAL FUND AND $100 000 00 COMING FROM THE FORT WORTH BOTANICAL SOCIETY FOR THE OPERATION OF THE BOTANIC GARDEN EDUCATION AND VOLUNTEER PROGRAMS FOR FISCAL YEAR 2010 PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2009-2010 in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the Special Trust Fund in the amount of $182,965 00 with $82,965 00 transferred from the General Fund and $100 000 00 coming from the Fort Worth Botanical Society for the operation of the Botanic Garden Education and Volunteer Programs for Fiscal Year 2010 SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No.18809 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 This ordinance shall take effect upon adoption D jAS TO FORM AND LEGALITY Assi§t`~nt ADOPTED AND EFFECTIVE. No. 1901&02-2010 DATE Tuesday February 02, 2010 REFERENCE NO *G-16831 LOG NAME 80BGEDPROGCONT4 SUBJECT Accept a Contribution in the Amount of $100 000 00 from Fort Worth Botanical Society for Operation of the Botanic Garden Education and Volunteer Programs Create New Program Account in Special Trust Fund Authorize Transfer from the General Fund to the Special Trust Fund Authorize Amendment to License Agreement with Fort Worth Botanical Society and Adopt Appropriation Ordinance (COUNCIL DISTRICT 7) RECOMMENDATION It is recommended that the City Council 1 Authorize the City Manager to accept a monetary contribution in the amount of $100 000 00 from the Fort Worth Botanical Society for the operation of the Botanic Garden Education and Volunteer Programs 2. Authorize the City Manager to create a Botanic Garden Education Program Account within the Special Trust Fund 3 Authorize the transfer of $82 965 00 from the General Fund to the Special Trust Fund 4 Authorize the City Manager to amend the City's license agreement with the Fort Worth Botanical Society to address the contribution for the Botanic Garden Education Program and 5 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Special Trust Fund by $182,965 00 DISCUSSION Since 1973 the City and the Fort Worth Botanical Society (FWBS) have entered into a series of license agreements for the operation of the Japanese Garden at the Fort Worth Botanic Garden (FWBG). During that time the Gardens Restaurant and Botanic Garden concessions have been added to the agreements The current agreement, City Secretary Contract 32788 was executed in 2005 with an initial term that continues until 2015 Under the contract, the FWB places revenues generated as a result of the license in a special account and used for the operation expansion and improvement of the FWBG During Fiscal Year 2009 the General Fund provided funding for the Botanic Garden Education and Volunteer Programs which included three authorized positions an Education Horticulturist, Public Education Specialist/Volunteer Coordinator and Customer Service Representative The Programs activities included workshops classes tours volunteer coordination docent/teacher training grant writing outreach program material development, and exhibit coordination The Volunteer Program registered and coordinated 425 persons who donated 22 168 hours during Fiscal Year 2009 with an estimated monetary value of $432 497 00 Logname. 80BGEDPROGCONT4 Page 1 of 3 The City Manager's proposed Fiscal Year 2010 budget included a program reduction package which would have eliminated the Programs In response the FWBS submitted a proposal to contribute $100 000 00 to partially fund the Botanic Garden Education and Volunteer Program contingent upon 1 } an increase in fees effective October 1 2009 at the Botanic Garden and Japanese Garden to fund the contribution and 2) the City of Fort Worth providing the remaining balance of funding for the Program in the amount of $82,965 00 This proposal was intended to save the Programs from elimination during Fiscal Year 2010 by providing funding for the three authorized positions and Program costs Parks and Community Services Department staff identified several items in the Botanic Garden operations budget that could be deferred so that funds could be reprogrammed to realize the $82 965 00 needed for the City's contribution The deferred items include the freezing of one vacant Senior Maintenance Worker position decrease in temporary employee funding and reductions in supply and contractual service line items. The revised fees and reprogramming of the identified operations budget items were presented to the City Council and adopted as part of the Fiscal Year 2010 budget.
