AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS
IN THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $13 652,350 00
FROM AVAILABLE FUNDS, FOR PHASE V SECTION 1 OF THE CITY'S ENERGY
SAVINGS PERFORMANCE CONTRACT AT VILLAGE CREEK WASTEWATER
TREATMENT PLANT PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS
SECTION 1
That in addition to those amounts allocated to the various City departments for Fiscal Year 2009-2010 in the
Budget of the City Manager there shall also be increased estimated receipts and appropriations in the
Sewer Capital Projects Fund in the amount of $13 652,350 00 from available funds, for Phase V Section
1 of the City's Energy Savings Performance Contract at Village Creek Wastewater Treatment Plant.
SECTION 2
That should any portion, section or part of a section of this ordinance be declared invalid inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3
That this ordinance shall be cumulative of Ordinance No.18809 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repeated
SECTION 4
This ordinance shall take effect upon adoption

SUBJECT
Authorize Amendment No 4 in the Amount of $13 577 350 00 to City Secretary Contract No 29110 with
Johnson Controls Inc. to Implement Phase V Section 1 of the City's Energy Savings Performance
Contract at Village Creek Wastewater Treatment Plant and Adopt Appropriation Ordinance (COUNCIL
DISTRICT 5)
RECOMMENDATION
It is recommended that the City Council
1 Authorize the transfer of $13 652 350 00 from the Commercial Paper Sewer Fund to the Sewer Capital
Projects Fund
2 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Sewer Capital Projects Fund in the amount of $13 652,350 00 from available funds and
3 Authorize the City Manager to execute Amendment No 4 with Johnson Controls Inc. in the amount of
$13 577 350 00 to implement Energy Savings Performance Contract (ESPC) Phase V Section 1 at
Village Creek Wastewater Treatment Plant.
DISCUSSION
On September 2 2003 (M& C C-19739) City Council authorized the City's first Energy Savings
Performance Contract (ESPC) with Johnson Controls Inc (JCI) ESPC Phase I Subsequently ESPC
Phases 11 III and IV were added by amendment.
On September 23 2008 (M& C C-23046) City Council authorized a contract with JCI to conduct a
detailed energy study of the City's Village Creek Wastewater Treatment Plant (VCWWTP) as Phase V of
the successful ESPC project. The study is complete and the product of this study the Utility Assessment
Report (UAR) dated Nov 2009 has been reviewed and approved by City staff Kinsman and Associates
Engineering Consultants retained by the City as an independent third party reviewer (M&C C-23788) has
also reviewed the report and verified the project costs, guaranteed savings measurement and verification
methods are appropriate
On August 25 2009 (Informal Report No 9106) City Council was informed of City staffs intent to forward
an M&C seeking authorization to execute an agreement to implement the ESPC Phase V project at the
(VCWWTP) as part of the City's overall Resource Conservation Program
The ESPC Phase V project will be implemented in two sections By splitting the project into two sections,
work to implement Section 1 can begin using capital funding while awaiting additional funding sources for
Section 2

The proposed ESPC Phase V Section 1 scope of work includes energy and operations related
conservation measures and treatment process facility improvement measures to be installed at the
(VCWWTP), including Aeration Diffuser Upgrades Supervisory Control and Data Acquisition (SCADA)
System Replacement, Aeration Control Improvements and Pump and Motor Upgrades
The total JCI contract amount for Phase V Section 1 is $13 577 350 00 and includes $215 044 00 for
Final Engineering Construction Management, Performance and Payment Bonds Measurement and
Verification After implementation of the improvements included in Section 1 the first year electricity
savings are estimated to be $829 428 00
JCI will guarantee projected savings to the City and will perform ongoing Measurement and Verification
services under an annually renewable service agreement also included in the avoided costs JCI will also
manage appropriate applications for and secure potential utility incentives that may be available for the
project.
Johnson Controls Inc. is in compliance with the City's M/WBE Ordinance by committing to 18 percent
M/WBE participation on this Amendment No 4 The City's goal on this Amendment is 18 percent.
The Village Creek Wastewater Treatment Plant is located in COUNCIL DISTRICT 5 and serves ALL
DISTRICTS
