HomeMy WebLinkAboutOrdinance 19037-02-2010Ordinance No 19037-02 2010 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE PARK GAS LEASE PROJECT FUND IN THE AMOUNT OF $114 642.00 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING THE COMMUNITY TREE PLANTING PROGRAM; PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2009-2010 and in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the Park Gas Lease Project Fund in the amount of $114 642 00 from available funds for the purpose of funding the Community Tree Planting Program SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No 18809 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Tuesday February 09 2010 REFERENCE NO G-16842 LOG NAME 8000MMUNITY TREE PLANTING PROGRAM SUBJECT Authorize the Use of $78 214 62 in Tree Removal Fees Revenue $114 641 00 in Gas Well Royalty Revenue and Donations in the Amounts of $100 000 00 from Chesapeake Energy Corporation $1 000 00 from Johnson Controls Inc. and $698 12 from Friends of Trinity Trees to Fund the Community Tree Planting Program and Adopt Appropriation Ordinances (ALL COUNCIL DISTRICTS) RECOMMENDATION It is recommended that the City Council 1 Authorize the use of $78,214 62 of Tree Removal Fees Revenue and $100 000 00 from Chesapeake Energy Corporation to fund the Community Tree Planting Program 2. Authorize the use of $114 642 00 of Gas Well Royalty Revenue to fund the Community Tree Planting Program 3 Authorize the City Manager to accept monetary donations in the amount of $1 000 00 from Johnson Controls, Inc. for volunteer outreach programs $698 12 from the Friends of Trinity Trees for the Trinity Trail tree planting project; 4 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Park Gas Lease Projects Fund in the amount of $114 642 00 from available funds 5 Authorize the transfer of $317 839 00 from the Park Gas Lease Projects Fund to the Community Tree Planting Program Fund and 6 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Community Tree Planting Program Fund in the amount of $497 751 74 from available funds. DISCUSSION The purpose of this M&C is to authorize use of various revenue to fund the Community Tree Planting Program appropriate the funding for the continuation of the Community Tree Planting Program and to accept donated revenue and transfer authorized funding into one Community Tree Planting Program operating fund During the deliberations for the Fiscal Year (FY) 2009 operating budget, the City Manager was authorized to use three funding sources in order to continue the Community Tree Planting Program Tree Removal Fees Revenue Parks Gas Well Royalty Revenue and the Chesapeake Energy Corporation Donation On September 16 2008 (M&C G-16276) the City Council authorized the City Manager to accept a monetary donation in the amount of $100 000 00 per year for five years for a total of $500 000 00 from Chesapeake Energy Corporation and adopted appropriation ordinances in the amount of $135 000 00 Logname• 8000MMUNITY TREE PLANTING PROGRAM Page 1 of 3 from Tree Fund revenue and $203 197 00 from Gas Well Revenue to fund one year of the Community Tree Planting Program for FY 2009 This M&C authorizes a fund correction for FY 2009 and FY 2010 for the Community Tree Planting Program This is accomplished by authorizing the transfer of the previously appropriated funding of $203 197 00 that was authorized for use for the Community Tree Planting Program from the Gas Well Revenue Fund to the Community Tree Planting Program Fund and appropriate these funds. The transfer of funds from Fiscal Year 2009 will allow for more accurate accounting as trees are not considered capital assets by the City and funds for the program need to reside in anon-capital account. Of the $203 197 00 from FY 2009 there was $45 340 38 in savings from delays in projects due to position vacancies this savings will be used towards funding the program in FY2010 This M&C also authorizes the use of $114 642 00 in Gas Well Royalty Revenue for the Community Tree Planting Program in FY 2010 appropriates $114 642.00 of the Gas Well Royalty Revenue transfers this amount from the Park Gas Lease Projects Fund to the Community Tree Planting Program Fund and includes this amount in the total FY 2010 appropriation of the Community Tree Planting Program Fund This M&C also request to accept and authorize monetary donations in the amount of $1 698 12 and include this amount in the total FY 2010 appropriation of the Community Tree Planting Program Fund The $1 000 00 donation from Johnson Controls Inc. (JCI) will be used to enhance volunteer outreach programs The $698 12 donation from Friends of Trinity Trees (FTT) will be used for a tree planting project along the Trinity Trail upstream from the Rogers Road Bridge Funding for FY 2010 Community Tree Planting Program Fund is identified in the following table Fiscal Year 2010 2010 2010 Subtotal 2010 2010 Subtotal FY 2009 and 2010 Fund Correction FY 2010 Total Appropriation $497 751 74 The Community Tree Planting Program provides approximately 1 700 trees annually for neighborhood associations and organizations for community tree planting projects on public property Additionally the Foresters manage the Citizen Forester Program and other volunteer programs which train volunteers for tree planting data collection and ongoing care and maintenance of the tree farm The annual cost of the program totals $338 197 00 which provides funding for six authorized positions consisting of two Foresters and a four person nursery production/tree planting crew The Community Tree Planting Program benefits ALL COUNCIL DISTRICTS FISCAL INFORMATION /CERTIFICATION The Financial Management Services Director certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinances funds will be available in the current operating budget, as appropriated of the Community Tree Planting Fund FUND CENTERS Fundina Amount Tree Fund Revenue $78 214 62 Gas Well Royalty Revenue $114 642 00 Chesapeake Energy Corporation Donation $100,000.00 $292 856 62 Johnson Controls, Inc.
