HomeMy WebLinkAboutOrdinance 19040-02-2010Ordinance No 19040-02 2010 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE STORM WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $500 000 00 FROM AVAILABLE FUNDS FOR THE MISCELLANEOUS STORM DRAIN IMPROVEMENTS CONTRACT PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2009-2010 and in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the Storm Water Capital Projects fund in the amount of $500 000 00 from available funds, for the Miscellaneous Storm Drain Improvements Contract. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 18809 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 This ordinance shall take effect upon adoption APPROVE TO FORM ITY Assi City ne ADOPTED AND EFFECTIVE. DATE Tuesday February 09 2010 REFERENCE NO C-24092 LOG NAME 20SWMEVERGREEN_1STRENEWAL SUBJECT Authorize the Execution of the First Renewal of City Secretary Contract No 38360 in an Amount Up to $1 000 000 00 with Tri Tech Construction Inc. for the Miscellaneous Storm Drain Improvements Contract and Adopt Appropriation Ordinance (ALL COUNCIL DISTRICTS) RECOMMENDATION It is recommended that the City Council 1 Authorize the transfer from the Storm Water Utility Fund to the Storm Water Capital Projects Fund in the amount of $500 000 00 2 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Storm Water Capital Projects Fund in the amount of $500 000 00 from available funds, and 3 Authorize the City Manager to execute the first one year renewal of City Secretary Contract No 38360 with Tri Tech Construction Inc. in an amount up to $1 000 000 00 for the Miscellaneous Storm Drain Improvements DISCUSSION On March 3 2009 (M&C C-23382) the City Council authorized execution of a contract in an amount up to $1 000 000 00 with the option of two one year renewals with Tri Tech Construction Inc. for the Miscellaneous Storm Drain Improvements Contract. As a result of the initial contract funds being depleted Transportation and Public Works Department wishes to exercise the first renewal option at this time The Storm Water Management Program was established to reduce flooding in Fort Worth preserve streams minimize water pollution and to operate the storm water system in a more effective manner to fully comply with state and federal regulatory requirements This will be accomplished by infrastructure reconstruction and system maintenance master planning enhanced development review and increased public education and outreach On October 16 2007 (Ordinance No 17840-10-2007) the City Council authorized the issuance and sale of $25 000 000 00 in Storm Water (Drainage) Revenue Bonds Series 2007 to fund a two year Storm Water Capital Project program The $500 000 00 authorized for transfer per this M&C will be combined with existing funding to fully fund the contract plus the funds necessary for right-of-way and easement acquisition inspection and survey services. The work to be performed under this contract consists of minor extensions replacements and/or improvements to existing storm water systems and other pertinent construction required to provide a more Logname: 20SWMEVERGREEN_1 STRENEWAL Page 1 of 2 effective drainage system to neighborhoods within the City limits of Fort Worth There is not apre-defined single project scope for this contract but, rather work orders issued on this contract as needs arise The price of each work order is based on the unit prices bid with the cumulative amount of all work orders issued under this extension of the Miscellaneous Storm Drain Contract capped at $1 000 000 00 This contracting tool has enhanced the City's responsiveness to minor drainage infrastructure needs that arise periodically by precluding the need to conduct an independent solicitation and award process for each small project. Tri Tech Construction Inc. is in compliance with the City's M/WBE Ordinance by committing to 15 percent M/WBE participation The City's goal on this project is 15 percent.
