HomeMy WebLinkAboutOrdinance 19041-02-2010ORDINANCE NO 19041-02-2010 AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF OLD SEMINARY DRIVE AT THE SOUTHEAST CORNER OF SEMINARY DRIVE AND TOWN CENTER DRIVE, SITUATED IN THE JOHN THORNHILL SURVEY, ABSTRACT NO 1519, CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, PROVIDING FOR REVERSION OF FEE IN SAID LAND, PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS, AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONVEYANCE OF THE RIGHT OF WAY, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That a portion of Old Seminary Dnve at the southeast corner of Seminary Dnve and Town Center Dnve, as situated in the John Thornhill Survey Abstract No 1519 City of Fort Worth, Tarrant County Texas and located adjacent to Lots 4 through 7 Block 1 of the Martin Place Addition, an addition to the City of Fort Worth, as recorded m Volume 902, Page 307 of the Plat Records of Tarrant County Texas and containing approximately 0.2949 acres of land more or less and as more specifically described in Exhibits A and `B" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That the easement to the land m the above-described vacated street nght of way is hereby released and shall revert to the adjacent owner as provided bylaw SECTION 3. All existing utility easement be shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. SECTION 4. Waive any and all purchase fee value for the portion of vacated land not held in fee simple title by the City in accordance with City policy (M&C G-15624) DISCUSSION Lawrence A. Cates and Associates on behalf of Hemphill Joint Venture have requested the vacation of the above referenced right-of-way to construct a new parking lot for the adjacent commercial development.
