ORDINANCE NO 19053-03-2010 AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF A TWELVE FOOT WIDE ALLEY RIGHT-OF WAY, LOCATED IN BLOCK 33, JENNINGS WEST ADDITION, AN ADDITION TO THE CITY OF FORT WORTH AS RECORDED IN VOLUME 152, PAGE 631 OF THE PLAT RECORDS OF TARRANT COUNTY, TEXAS, AND CONTAINING APPROXIMATELY 0.028 OF AN ACRE OR 1,200 SQUARE FEET OF LAND MORE OR LESS, PROVIDING FOR REVERSION OF FEE IN SAID LAND, PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That a portion of a twelve foot alley nght-of way situated m Block 33 Jennings West Addition, an Addition to the City of Fort Worth as recorded in Volume 152, Page 631 of the Plat Records of Tarrant County Texas, and containing approximately 0 028 of an acre or 1,200 square feet of land more or less, and as more specifically described in Exhibits A and `B" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That the easement to the land in the above-described vacated street nght of way is hereby released and shall revert to the adjacent owner as provided by law SECTION 3 All existing utility easement be shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. SECTION 4 That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect upon adoption. Said portion of a 12-foot wide alley is adjoined on both the north and south by land described in a deed to Educational Employees Credit Union of Fort Worth and recorded in Volume 122b3 Page 2103, said deed records. Said portion of a l2-foot wide alley is more particularly described as follows: Beginning at a'/z iron found in the west line of Summit Avenue, at the southeast comer of Lot 1 Block 33 said Jennings West Addition and at the northeast comer of said 12 foot wide alley- Thence South with the west line of Summit Avenue, 12.00 feet to a 1 pipe found at the northeast corner of Lot 4, Block 33 said Jennings West Addition and at the southeast corner of said 12-foot wide alley- Thence West with the north line of said Lot 4 and the south line of said 12-foot wide alley 100 00 feet to a capped 5/8" iron set at the northwest corner of said Lot 4, Thence North, 12.00 feet to a'/: iron found at the southwest corner of said Lot 1 and being in the north tine of said 12 foot wide alley 1~ence East with the south line of said Lot 1 and the north line of said 12-foot wide alley 100.00 feet to the point of beginning and containing 0.028 of an acre or 1,200 square feet. Waive any and all purchase fee value of the vacated land in accordance with City Policy (M&C G- 15624) DISCUSSION Boydston Designs Inc. on behalf of Educational Employees Credit Union has requested the vacation of the above referenced portion of an alley to replat the right-of-way with the adjoining property to develop a potential new restaurant. The City Plan Commission recommended approval of this request at its meeting on November 20 2009 An acceptable replat (FS-009-138) has been received Any existing utilities will be relocated at the applicant's expense or retained within a designated easement, along with an appropriate plat note that no permanent structures may be constructed or placed thereon The City of Fort Worth (City) originally obtained the above mentioned right-of-way through the platting process The City does not own land under or adjacent to the above referenced emergency access easement.
