HomeMy WebLinkAboutOrdinance 19087-03-2010Ordinance No 19087-03-2010 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANT CAPITAL PROJECTS FUND IN THE AMOUNT OF $1 900 000 00 UPON RECEIPT OF FUNDS FROM THE HIGHWAY BRIDGE REPLACEMENT AND REHABILITATION PROGRAM THROUGH THE TEXAS DEPARTMENT OF TRANSPORTATION FOR REPLACEMENT OF THE WEST 7T" STREET BRIDGE, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2009-2010 in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the Grant Capital Projects Fund in the amount of $1 900 000 00 upon receipt of funds from the Highway Bridge Replacement and Rehabilitation Program through the Texas Department of Transportation for replacement of the West 7th Street Bridge SECTION 2 That should any portion, section or part of a section of this ordinance be declared invalid inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 18809 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 This ordinance shall take effect upon adoption APPROVED AS FORM LE ALITY Assistant City or ~ ADOPTED AND EFFECTIVE. DATE Tuesday March 23 2010 LOG NAME 20AMEND1 W7THSTBRIDGE REFERENCE NO C-24141 SUBJECT Authorize the Execution of Amendment No 1 to City Secretary Contract No 38892 an Advance Funding Agreement with the Texas Department of Transportation to Increase State and Federal Participation by $1 900 000 00 for the Replacement of the West Seventh Street Bridge and Adopt Appropriation Ordinance (COUNCIL DISTRICT 9) RECOMMENDATION It is recommended that the City Council 1 Authorize the City Manager to execute Amendment No 1 to City Secretary Contract No 38892 an Advance Funding Agreement with the Texas Department of Transportation to increase State and Federal participation by $1 900 000 00 for the replacement of the West Seventh Street Bridge thereby revising the State and Federal participation to $13 900 000 00 from $12 000 000 00 2. Authorize the City Manager to accept $1 900 000 00 non-cash federal funds from the Highway Bridge Replacement and Rehabilitation Program through Texas Department of Transportation and 3 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grant Capital Projects Fund by $1 900 000 00 DISCUSSION On May 27 2008 (M&C C-22828) the City Council approved an Advance Funding Agreement with Texas Department of Transportation City Secretary Contract No 38892 for replacement of the West 7th Street Bridge Since then more detailed design and cost estimates have been developed and the Texas Department of Transportation (TXDOT) has agreed to participate with an additional $1 900 000 00 increasing the State and Federal participation from $12 000 000 00 to $13 900 000 00 The basic eligible cost of a like-kind bridge will remain the same As such there is no required increase in the City's participation toward TxDOT's Equivalent-Match program This project is located in COUNCIL DISTRICT 9 FISCAL INFORMATION /CERTIFICATION The Financial Management Services Director certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance funds will be available in the current capital budget, as appropriated of the Grant Capital Projects Fund FUND CENTERS TO Fund/Account/Centers FROM Fund/Account/Centers Logname 20AMENDIW7THSTBRIDGE Page 1 of 2 2) GR74 451962 020302268000 $1,900,000.00 3) GR74 541180 020302268830 $1,900,000.00 __..~ __ r_._~~ ~-~.rr.
