HomeMy WebLinkAboutOrdinance 14003ORDINANCE NO ~~D~ AN ORDINANCE AMENDING CHAPTER 22, "MOTOR VEHICLES AND TRAFFIC,'° OF THE CODE OF THE CITY OF FORT WORTH, TEXAS (1986) AS AMENDED, BY AMENDING SUBSECTION (d) OF SECTION 22-191, PROVIDING THAT THE PROVISIONS HEREOF SHALL BE CUMULATIVE PROVIDING A SAVINGS CLAUSE, PROVIDING A SEVERABLITY CLAUSE, PROVIDING A PENALTY CLAUSE, DIRECTING PUBLICATION OF THE CAPTION, PENALTY CLAUSE AND EFFECTIVE DATE, AND NAMING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That Chapter 22, "Motor Vehicles and Traffic," of the Code of the City of Fort Worth, Texas (1986), as amended, be and the same is hereby amended by amending Subsection (d) of Section 22-191, which shall be and hereafter read as follows (d) The fees for parking meter zones so established shall be as follows (1) Parking Meter Zone No 1 Four (4) minutes for the depositing in the meter of a five cent ($0 05} coin of the United States of America, eight (8) minutes for the depositing of a ten cent ($0 10) coin of the United States of America, and twenty (20) minutes for the depositing in" the meter of atwenty-fve ($0 25) coin of the United States of America (2) Parking Meter Zone No 2• Eight (8) minutes for the depositing in the meter of a five cent ($0 05) coin of the United States of America, sixteen (16) minutes for the depositing of a ten cent ($0 10) coin of the United States of America, and forty (40) minutes for the depositing in the meter of a twenty-five ($0 25) coin of the United States of America (3) Parking Meter Zone No 3 Fifteen (15) minutes for the depositing in the meter of a five cent ($0 05) coin of the United States of America, thirty (30) minutes for the depositing of a ten cent ($0 10) coin of the United States of America, and one (1) hour and fifteen (15) minutes for the depositing in the meter of a twenty-five ($0 25) coin of the United States of America (4) Parking Meter Zone No 4 Twenty (20) minutes for the depositing in the meter of a five cent ($0 05) coin of the United States of America, forty (40) minutes for the depositing of a ten cent ($0 10) coin of the United States of America, and one (1) hour and forty (40) minutes for the depositing in the meter of a twenty-five ($0.25) coin of the United States of America SECTION 2. That this ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, affecting parking zones, except where the provisions of this ordinance are in direct conflict with provisions of such ordinances and such Code, in which event conflicting provision of such ordinances and such Code are hereby repealed SECTION 3 That all rights or remedies of the City of Fort Worth, Texas are expressly saved as to any and all violation of the provisions of Chapter 22 of the code of the City of Fort Worth, Texas (1986), as amended, and of any other ordinances affecting parking zones which have accrued at the time of the effective date of this ordinance and as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under said Chapter or other ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts SECTION 4 That it is hereby declared to be the intention of the City Council of the City of Fort Worth, Texas, that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any section, paragraph, sentence, clause or phrase shall be declared void, ineffective or unconstitui:ional by the valid judgment or -final decree of a court of competent jurisdiction, such voidness, ineffectiveness or unconstitutionality shall not affect any of the remaining sections, paragraphs, sentences, clauses or phrases of this ordinance since same would have been enacted by the City Council without the incorporation herein of any such void, ineffective, or unconstitutional section, paragraph, sentence, clause or phrase SECTION 5 That any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and each__~~such person shall be deemed guilty of a separate offence for each day or portion tKereof during which ~a,violation is committed and each violation shall be punishable by a fine not to exceed two hundred dollars ($200 00) SECTION 6 The City Secretary of the City of Fort Worth, Texas, is hereby directed to publish the caption and penalty clause of this ordinance for two (2) days in the official newspaper of the City of Fort Worth, Texas, as authorized by Section 52 013, Texas Local Government Code SECTION 7 That this ordinance shall be in full force and effect from and after the date of its passage and publication, and it is so ordained APPROVED AS TO FORM AND LEGALITY ~ \~ Assistant y Attorney Date ~~lLl~ Adopted ~~ 'I ~o ~ 1 Effective l~- 30 -q~j ~' City of Fort Worth, Texas t1-~Ayar And Caunc~l C,ammun~cAt~an DATE REFERENCE NUMBER LOG NAME PAGE 11/9/99 G-12725 Revised 20METER 1 of 2 suB~ECT REVISION OF THE PARKING METER ORDINANCE RECOMMENDATION It is recommended that the City Council approve the attached ordinance, which amends Section 26-103 in Chapter 26 "Motor Vehicles and Traffic" of the Code of the City of Fort Worth, Texas, to increase parking meter rates DISCUSSION In conjunction with recommending the purchase of electronic meters, it is recommended that parking meter rates be increased in the Central Business District (CBD) (Zones 1-3) and in the TCU area (Zone 4) The last parking meter rate increase was in August 1982.
