HomeMy WebLinkAboutOrdinance 13907Ordinance No. 13 ~ O~ e' AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $449,664 00 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING THE SAFE AND SOBER SELECTIVE TRAFFIC ENFORCEMENT PROGRAM THROUGH A GRANT FROM THE TEXAS DEPARTMENT OF TRANSPORTATION, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1998-99 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $449,664 00 from available funds for the purpose of funding the Safe and Sober Selective Traffic Enforcement Program through a grant from the Texas Department of Transportation. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way unpair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No. 13540 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect and be in full force and effect after the date of its passage, and it is so ordained. APPROVED AS TO FORM AND LEGALITY ~~ Assis an ity Attorney 41~(4~ Date '~- g-~~ -~~ Adopted ~/ ~ ~ '~~ Effective „-r-~' ., City of Fort T~orth, Texas M,'Ayar And Council CammunicAtion DATE REFERENCE NUMBER LOG NAME PAGE 8/17/99 **C-17599 35SOBER 1 of 3 SUBJECT SAFE & SOBER STEP (SELECTIVE TRAFFIC ENFORCEMENT PROGRAM) RECOMMENDATION It is recommended that the City Council 1 Authorize the City Manager to accept a contract with the Texas Department of Transportation (TxDOT) to continue to operate the Safe & Sober Selective Traffic Enforcement Program (STEP) from October 1, 1999 through September 30, 2001, on an overtime basis in the amount of $449,664 (State $255,161/City $194,503), and 2 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Special Trust Fund awarded assets by $194,503 from available funds, and 3 Authorize the transfer of $194,503 from the Special Trust Fund awarded assets to the Grants Fund for the City's cash match, and 4 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund by $449,664 from available funds, and 5 Authorize the City Manager to waive the indirect cost in the amount of $76,762 since indirect costs are not allowed by TxDOT DISCUSSION TxDOT has agreed to provide funds for the Safe & Sober STEP for the next two years. Speeding continues to be a major contributor to traffic crashes resulting in injuries and fatalities, not only on State highways, but on all types of roadways within cities and towns as well Law enforcement entities now have the opportunity to focus their enforcement efforts on those streets -and roadways that have a high number of speed-related crashes and/or experience high rates of noncompliance with the posted speed limits. In addition, Department of Public Safety crash data also indicates that drunk drivers are a major contributor to traffic crashes and fatalities in Texas. One of the best defenses against a drunk or speeding driver is a properly worn safety belt. Working on an overtime basis, officers will attempt to decrease total crashes on targeted STEP sites, reduce speeds in excess of the posted speed limit, arrest intoxicated drivers, and increase safety belt and safety seat usage rates.
