BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: ~~Y SECTION 1. Exhibit A, Land Use Assumptions for Water, incorporated by reference into Section 35- 70.2(a) of the Code of the Crty of Fort Worth (1986), as amended, is hereby amended and, after having been so amended, shall be and read as shown on Exhibit A, attached hereto SECTION 2. Exhibit B, Land Use Assumptions for Wastewater, incorporated by reference into Section 35-70.2(b} of the Code of the City of Fort Worth (1986), as amended, is hereby amended and, after having been so amended, shall be and read as shown on Exhibit B, attached hereto r F1 .r~ SECTION 3. Schedule 1, the Maximum Assessable Impact Fee per Service Umt, incorporated by reference into Section 35-70.3(a} of the Code of the City of Fort Worth (1986), as amended, is hereby amended and, after having been so amended, shall be and read as shown on Schedule 1, attached hereto SECTION 4. Schedule 2, Collection Schedule, incorporated by reference into Section 35-70.3(b) of the Code of the City of Fort Worth (1986), as amended, is hereby amended and, after having been so amended, shall be and read as shown on Schedule 2, attached hereto SECTION 5. Exhibit C, Water Benefit Area, incorporated by reference into Section 35-71(a) of the Code of the Crty of Fort Worth (1986), as amended, is hereby amended and, after having been so amended, shall be and read as shown on Exhibit C, attached hereto SECTION 6. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are m direct conflict with the provisions of such ordinances and such Code, m which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 10. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation m this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. :~ SECTION 11. The state statute requires that the original Impact Fees Ordinance and any amendments to it be reviewed at least every three years, and amended as necessary to reflect any changes in the Land Use Assumptions, Capital Improvements Plan and the Impact Fee Ordinance. On March 16, 1999, the City Council approved a resolution calling for a public hearing to consider the adoption of amendments to the Land Use Assumptions, Capital Improvements Plan and Impact Fee Ordinance. The amendments were filed with the City Secretary on March 15, 1999, and have been available for public inspection since that date Revised Impact Fee Ordinance The Impact Fee Ordinance which amends Chapter 35, Sections 35-70.2(a)(b), 35-70 3(a)(b), 35-71(a), 35-72(a), 35-76(a) and 35-77(a) of the Code of the City of Fort Worth applies to all new development within the corporate boundaries of Fort Worth and its extraterritorial jurisdiction The revised ordinance establishe"s a maximum impact fee assessment per service unit of $1,063 and $1,296 for water and wastewater facilities respectively, to be assessed as set forth in Schedule 1, an attachment to the ordinance Anew development would be assessed at the time of final platting using Schedule 1, and would pay the fee at the time a building permit is approved Impact fees collected pursuant to the ordinance must be kept in a separate interest-bearing account and used only to finance projects designated in the Capital Improvements Plan Procedure for refunds, rebates and relief procedures are described in the 'ordinance r`~~k City of Fort Worth, Texas ~-~Ayor And Cat~ncl( C,amntun~,cAt~an DATE 5/18/99 REFERENCE NUMBER G-12565 LOG_ NAME ' 601MPACT PAGE 2 of 2 SUBJECT PUBLIC HEARING AND ACTION CONCERNING PROPOSED AMENDMENT TO .LAND USE- ASSUMPTIONS, CAPITAL IMPROVEMENTS PLAN AND IMPACT FEE ORDINANCE FOR WATER AND WASTEWATER FISCAL INFORMATION/CERTIFICATION The Customer Service and Engineering Divisions of .the Water Department are responsible for all computations and collections of water and wastewater impact .fees.
