I ~ ~~ IJ AN ORDINANCE VACATING, ABANDONING, CLOSING AND EXTINGUISHING A 16 FOOT ALLEY AND TWO PRESCRIPTIVE UTILITY EASEMENTS, PROSPECT HEIGHTS ADDITION, TO THE CITY OF FORT WORTH, TEXAS, PROVIDING FOR REVERSION OF FEE IN SAID LAND, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 THAT the following 16 foot alley, and two prescriptive utility easements, Block 18, Prospect Heights Addition, and as more specifically described in the Exhibit A attached hereto and incorporated herein by reference be and the same is vacated, abandoned and permanently closed and extinguished 1 A 16 foot wide by 600 foot long alley between West Bowie Street and West Lowden Street, serving Lots 1 through 24 in Block 18, Prospects Heights Addition to the City of Fort Worth as recorded in Volume 63, Page 59 of the Deed Records of Tarrant County, Texas, and containing 9,600 square feet. 2 A Prescriptive Easement fora 21 inch storm drain pipe between Lots 21 and 22 of Block 18, Prospect Heights Addition to the City of Fort Worth, as recorded in Volume 2473, Page 1203 of the Deed Records of Tarrant County, Texas, and extending from the east curb line at the mid-block alley, easterly to the west right-of-way line of McCart Street. 3 A Prescriptive Easement fora 15 inch sanitary sewer Main No 79, along the contour lot line of Lots 16 and 17, Block 18, Prospect Heights Addition to the City of Fort Worth as recorded in Volume 63, Page 59 of the Deed Records of Tarrant County, Texas, and extending west from McCart Street to the east right-of-way line of the mid block alley F SECTION 2 That the fee to the land in the above described vacated alley and easements is hereby released and shall revert to the adjacent owner as provided by law SEGTION 3 That all ordinances or parts of ordinances in conflict herewith are hereby repealed SECTION 4. The City Plan Commission recommended these vacations at a previous public hearing This request is located in COUNCIL DISTRICT 9 FISCAL INFORMATION/CERTIFICATION The Finance Director certifies that the City has received payment in the amount of $3,081 60 for the alley portion of this request.
