AN ORDINANCE AMENDING CHAPTER 3 "AIRPORTS AND
AIRCRAFT" OF THE CODE OF THE CITY OF FORT WORTH (1986),
AS AMENDED, BY DELETING THE TITLE OF SECTION 3-102
"RIGHT-OF-WAY FOR TAXIING AIRCRAFT" AND RETITLING SUCH
SECTION "VEHICLE AND PEDESTRIAN COMMUNICATIONS IN
AIRPORT MOVEMENT AREAS"; ESTABLISHING
COMMUNICATIONS PROTOCOL FOR PEDESTRIANS WHEN
WALHING AND VEHICLES WHEN DRIVING ON OR ACROSS
AIRPORT MOVEMENT AREAS; ESTABLISHING PENALTIES FOR
VIOLATIONS THEREOF; DELETING SECTION 3-104 "VEHICLE
COMMUNICATIONS"; AND FURTHER PROVIDING THAT THIS
ORDINANCE IS CUMULATIVE; PROVIDING A SEVERABILITY
CLAUSE; PROVIDING FOR PUBLICATION; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS THAT•
SECTION 1.
Section 3-102 ("Right-of--way for taxiing aircraft") of Chapter 3 ("Airports and Aircraft")
of Code of the City of Fort Worth, Texas (1986), as subsequently amended, is hereby amended
so that such Section shall hereafter read as follows
Sec. 3-102. Vehicle and Pedestrian Communications in Airport Movement Areas.
(a) Taxiing Aircraft shall have the right-of--way in preference over pedestrians and all
other motor vehicles at all Airports.
(b) At any Airport that has a control tower, it shall be unlawful for any person to walk
or drive a vehicle on or across any portion of a Movement Area unless (i) that person has
received proper authorization from the control tower to walk or drive on or across any portion of
the Movement Area and is in and maintains constant radio contact with the control tower while
walking or driving on or across any portion of the Movement Area or (ii) for an operator of an
Aircraft or other motor vehicle, that person has received a fight signal or similar clear permission
from the control tower prior to operating such Aircraft or other motor vehicle on any portion of
the Movement Area.
(c) At any Airport that does not have a control tower, it shall be unlawful for any
person to walk or drive a vehicle on or across any portion of the Movement Area unless that
person has received proper authorization from the Director or authorized designee to walk or
drive on or across any portion of the Movement Area and (i) is m and mamtams constant contact
with the authorized LTNICOM operator by way of two-way radio or (ii) is under escort by an
individual who is m and maintains constant contact with the authorized LTNICOM operator by
way of two-way radio
(d) A violation of this Section 3-102 shall constitute a misdemeanor criminal offense
punishable by a fine not to exceed Five Hundred Dollars ($500 00)
SECTION 2.
Section 3-104 ("Vehicle communications") of Chapter 3 ("Airports and Aircraft") of
Code of the City of Fort Worth, Texas (1986), as subsequently amended, is hereby deleted in its
entirety
SECTION 3.
This Ordinance shall be cumulative of all ordinances of the City, except where the
provisions of this Ordinance are m direct conflict with the provisions of such other ordinances, m
which case the conflicting provisions of such other ordinances are hereby repealed.
SECTION 4
The sections, paragraphs, sentences, clauses and phrases of this Ordinance are severable.
If any portion of this Ordinance is declared illegal or unconstitutional by the valid final judgment
or decree of any court of competent ~unsdiction, such illegality or unconstitutionality shall not
affect the legality and enforceability any of the remaining portions of this Ordinance.
SECTION 5.
After the adoption of this Ordinance and m accordance with Section 2 of Chapter XXV
of the City Charter of the City of Fort Worth, Texas, the City Secretary of the City of Fort Worth
shall have this Ordinance is published in its entirety two (2) times in the official newspaper of
the City In lieu thereof, the City Secretary of the Crty of Fort Worth may have descriptive
captions or titles that summarize the purpose of this Ordinance and the penalty for violations
thereof published two (2) times in the official newspaper of the City
SECTION 6.
This Ordinance shall be m full force and effect following its adoption and publication as
specified herein.

SUBJECT ORDINANCE AMENDING SECTION 3-102 OF THE CITY OF FORT WORTH CODE
RECOMMENDATION
It is recommended that the City Council adopt the attached ordinance amending Section 3-102 of the
City Code to clarify right-of-way priorities and protocols between aircraft, other motor vehicles, and
pedestrians at City-owned airports.
DISCUSSION
On several occasions, pedestrians have walked across runways and taxiways within the movement
area at Fort Worth Meacham International Airport without permission from the control tower These
incidents have constituted violations of Federal Aviation Administration regulations Section 3-102 of
the City Code currently prohibits motor vehicles from crossing a runway or taxiway without permission
from the control tower, but does not specifically extend that prohibition to pedestrians. The attached
ordinance rectifies this omission, clarifies right-of-way priorities and protocols at City-owned airports
with control towers, and establishes right-of-way priorities and protocols at City-owned airports without
control towers.
Pursuant to Section 3-2 of the City Code, offenses of general airport and aircraft provisions of the City
Code are punishable by fines of up to $500 Because the City is subject to fines assessed by the
Federal Aviation Administration for runway and taxiway incursions that the City does not address
adequately, the attached ordinance provides additional notice to the public and clarifies that a violation
of its provisions constitutes an offense that is punishable by a fine of up to $500
