AN ORDINANCE VACATING, ABANDONING, CLOSING AND
EXTINGUISHING A PORTION OF LIPSCOMB STREET RIGHT-OF-
WAY, W. W. WELCH SURVEY, TO THE CITY OF FORT WORTH,
TEXAS, PROVIDING FOR REVERS{ON OF FEE IN SAID LAND,
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE. CITY OF FORT WORTH,
TEXAS:
SECTION 1
THAT a portion of Lipscomb Street, extending 447 79 feet north of West
Magnolia Street, and being a variable width right-of--way (63 86 to 63 89 feet) containing
0 66 acres of land, situated in the W W Welch Survey, Abstract No 1644, Plat
- Records, Tarrant County, Texas, and as more specifically described in Exhibit A
attached hereto and incorporated herein by reference be and the same is vacated,
abandoned and permanently closed and extinguished
SECTION 2
That subject to the conditions stated in Section 3, the fee to the land in the above
described street right-of-way is hereby released and shall revert to the adjacent owner
as provided by law
SECTION 3
That the vacation, abandonment, closure and extinguishment of the above
described portion of the street right-of-way, and the release and reversion of the City's
rights, title and interest in and to the land therein, shall be subject to and conditioned
upon the following (a) a temporary turn around until the northern portion of Lipscomb
Street extending to Rosedale Street is vacated, (b) the approval by the City of the final
replat submitted by the property owner; (c) the City's retention of all public drainage and
utility easements located within the street right-of-way abandoned hereunder provided
that arrangements may be made with the property owner for the property owner to pay
for the cost of all future relocation of any of the drainage and utility easement.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby
repealed
SECTION 5
That this ordinance shall take effect and be in full force and effect from and after
the date of its passage, and it is so ordained

EEING a 0.66 acre tract of land situated In the W. W. Welch Survey, Abstract No 1544,
Tarrant County, Texas, Said 0.56 acre tract of land being mare particularly described by
metes and bounds as follows:
BEGINNING at the intersection of the north right-of-way line of West Magnolia Avenue
(a 8Q' wide public righfi-of-way) and the weft right-af--way line of Lipscomb Street (a
variable width public right-of-way);
THENCE North, along sG~id west link of Lipscomb Street, a distance of 44.55 feet;
THENCE East, leaving :said west right-of--way line of Lipscomb Street, a distance of
53.86 feet to a point in t:he east right-of-way line of Lipscomb Street;
THENCE South, along the east line of Lipscomb Street, a distance of 447 79 feet to the
north line of Magnolia S~:reet;
THENCE West, along the north line of Magnolia Street, a distance of 53.89 feet to the

SUBJECT PARTIAL LIPSCOMB STREET VACATION EXTENDING 447 79 FEET NORTH
OF WEST MAGNOLIA STREET, W W WELCH SURVEY, FORT WORTH,
TEXAS (VA-99-020)
RECOMMENDATION
It is recommended that the City Council adopt the attached ordinance vacating the southerly portion of
Lipscomb Street, projecting 447 79 feet north of West Magnolia Street, and being a variable width right-
of-way (63 86 feet to 63 89 feet) and containing 0 66 acres of land, situated in the W W Welch Survey,
Abstract No 1644, Fort Worth, Tarrant County, Texas.
DISCUSSION
Norwest Bank, owner of the land on either side of this request, along with co-applicant, Phoenix
Property Company of Texas, has requested that the City vacate the above portion of the Lipscomb
right-of-way to facilitate development of the surrounding property fora mixed commercial and
residential project. The Zoning Commission recommended approval of the zoning under Z-99-056 and
the development plan under case SP-99-009
The City Plan Commission recommended approval of the request to vacate Lipscomb from Magnolia
north to Rosedale on April 28, 1999 Norwest Bank and Phoenix Property Company of Texas wish to
vacate Lipscomb in phases, with only the southern portion running through the mixed use project to be
vacated at this time Vacation of the northern portion of Lipscomb extending to Rosedale will be
submitted to the City Council when a redevelopment plan or replat is presented by the property owner
Reviewing City departments and public utility companies have raised no objections to this vacation
request, and have recommended that the vacation be subject to provisions of a temporary turnaround
until the northerly street portion is vacated, that a replat of the affected properties be received and
approved, and that appropriate public drainage and utility easements be retained over the vacated
street segment unless other satisfactory arrangements are made, including relocation at the applicants'
expense
