AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE
SPECIAL TRUST FUND IN THE AMOUNT OF $45,557.80 FROM AVAILABLE FUNDS FOR THE
PURPOSE OF FUNDING THE CLEARFORK/BENBROOK BIKE TRAIL, PROVIDING FOR A
SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES
AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS.
SECTION 1
That in addition to those amounts allocated to the various City departments for the Fiscal Year 1998-99 and in the Budget of
the City Manager, there shall also be increased estimated receipts and appropriations in the Special Trust Fund in the amount of
$45,557.80 from available funds for the purpose of funding the City's portion of improvements to the Clearfork/Benbrook
Bike Trail.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by
a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections,
or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3
That this ordinance shall be cumulative of Ordinance No. 13540 and all other ordinances and appropriations amending the
same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and
appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly
repealed.
SECTION 4
This ordinance shall take effect and be in full force and effect after the date of its passage, and it is so ordained.

OF TRANSPORTATION FOR THE CLEARFORK/BENBROOK BIKE TRAIL,
ACCEPTANCE OF DONATION FROM STREAMS AND VALLEYS, INC , AND
ADOPTION OF RELATED APPROPRIATION ORDINANCES
RECOMMENDATION
It is recommended that the City Council
1 Authorize the City Manager to execute an amendment/change order to the agreement with the
Texas Department of Transportation (TxDOT) for improvements to the Ciearfork/Benbrook Bike
Trail in the amount of $45,557 90, with a revised project cost of $1,260,688 17, and
2 Accept $22,778 90 from Mayfest 1998 to fund the City's portion of the improvements; and
3 Accept $22,778.90 from Streams and Valleys, Inc. to fund the City's portion of the improvements;
and
4 Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in
the Special Trust Fund by $45,557 80, and
5 Authorize the transfer of funds in the amount of $45,557.80 from the Special Trust Fund to the
Grants Fund, and
6 Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations by
$45,557 80 in the Grants Fund from available revenues.
On°"July 21, 1992 (M&C G-9738), the City Council approved the 1993 Transportation Improvement
Program, which included a number of bikeway projects. The approval made these projects eligible for
funding under the Intermodel Surface Transportation Efficiency Act of 1991 (ISTEA) In late 1992,
TxDOT accepted the Clearfork/Benbrook Bike Trail Project as a funded project under the Congestion
Mitigation and Air Qua{ity (CMAQ} program of ISTEA. The total project cost estimated at that time was
$687,500 00 The local share of 20°!° ($137,500 00) was committed by Streams and Valleys, Inc.
On February 21, 1995 (M&C C-14702), the City Council authorized the City Manager to execute an
agreement with TxDOT for improvements to the Clearfork/Benbrook Bike Trail
On September 15, 1998 (M&C C-16995), the City Council authorized the first amendment to the
agreement with TxDOT for improvements to the Clearfork/Benbrook Bike Trail with a revised project
cost of $1,033,000 00 The local share of 20% was committed by Streams and Valleys, Inc.
($34,550 00) and the City (proceeds from Mayfest $34,550 00)

In November 1998, actual construction began under the management of TxDOT The general
contractor, Linder-Stahl Construction Company, Inc. of Fort Worth, began the clearing and construction
of this 3.5 mile bike trail During the initial phase of construction it was discovered that quantities were
underestimated for vegetation and tree removal because an actual tree count was not pertormed during
the engineering phase, and because of special requirements to construct the improvements. Additional
contractor costs to perform the necessary clearing is $190,850 00 The addition of TxDOT's
Engineering and Contingencies (9 5%) and TxDOT's Indirect Cost (9%) brings the total amendment
cost to $227,789 00
The revised project cost exceeds the amended Metropolitan Planning Organization (MPO) authorization
of $1,032,899 17 by $227,789 00 The MPO has agreed to increase the authorization of CMAQ funds
and modify the Transportation and Improvement Program. The following outlines the total local share
for this project after the above proposed additions

The project is scheduled to be completed in June 1999 The proposed change order will not change
the estimated $4,800 00 annual operational impact on the General Fund
The portion of the Cleartark/Benbrook Trail that is within the City is in COUNCIL DISTRICT 3
