AN ORDINANCE AMENDING THE CODE OF THE CITY OF
FORT WORTH (1986), AS AMENDED, BY CHANGING
SECTION 10-17 THEREOF TO PROVIDE THAT PARKING
VIOLATIONS BUREAU HEARING OFFICERS SHALL
REPORT TO AND BE UNDER THE ADMINISTRATIVE
OVERSIGHT OF THE DIRECTOR OF MUNICIPAL COURT
SERVICES, PROVIDING FOR A SEVERABILITY CLAUSE,
PROVIDING THAT THIS ORDINANCE IS CUMULATIVE,
AND PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS
SECTION 1
That Section 10-17, "Hearing Officers", of the Code of the City of Fort
Worth (1986), as amended, is hereby amended by changing subsection (a)
thereof to read as follows
" (a) The Parking Violations Bureau shall be composed of one (1) or
more Hearing Officers who shall be appointed by the City Council for
terms of two (2) years Hearing Officers shall report to and be under
the administrative oversight of the Director of Municipal Court
Services. The City Council shall be authorized to remove Hearing
Officers. The Director of Municipal Court Services shall be authorized
to take disciplinary action against Hearing Officers other than removal.
Hearing Officers shall be exempt from the dismissal, suspension, and
demotion sections in Chapter 2. Article V of the Fort Worth City Code."
SECTION 2.
That this ordinance shall be cumulative of all provisions of ordinances and
of the Code of the City of Fort Worth (1986), as amended, except where the
provisions of this ordinance are in direct conflict with the provisions of such
ordinances and Code, in which event such conflicting provisions of such
ordinances and such Code are hereby repealed.
SECTION 3
That it is hereby declared to be the intention of the City Council that the
sections, paragraphs, sentences, clauses and phrases of this ordinance are
severable, and, if any section, paragraph, sentence, clause or phrase of this
ordinance shall be declared unconstitutional by the valid judgment or decree of
any court of competent jurisdiction, such unconstitutionality shall not affect any of
the remaining sections, paragraphs, sentences, clauses or phrases of this
ordinance, since the same would have been enacted by the City Council without
the incorporation in this ordinance of any such unconstitutional section,
paragraph, sentence, clause or phrase.
SECTION 4
That this ordinance shall take effect and be in full force and effect from
and after its passage, and it is so ordained.

BUREAU HEARING OFFICER SHALL REPORT TO AND BE UNDER ADMINISTRATIVE

RECOMMENDATION
It is recommended that the City Council adopt the attached Ordinance that amends Section 10-17 of
the Fort Worth City Code to provide that the Parking Violations Bureau Hearing Officer shall report to
and be under the administrative oversight of the Director of Municipal Court Services
DISCUSSION
The City's Parking Violations Bureau Hearing Officer is appointed by the City Council to conduct
hearings involving violations of City ordinances relating to the parking, stopping or standing of vehicles
as contained in Chapter 22 of the Fort Worth City Code
The Hearing Officer presently reports only to the City Council through its Municipal Court Advisory
Committee
On August 3, 1999, the Municipal Court Advisory Committee voted to recommend to the City Council
that the Hearing Officer should report to and be placed under the administrative supervision of the
Director of Municipal Court Services Under the proposed Ordinance, the City Council would continue
to have authority to appoint and remove the Hearing Officer The Director of Municipal Court Services
would be given authority to take disciplinary action other than removal
