Home My WebLink AboutOrdinance 13944~~; /~J.i' ORDINANCE NO _ 13 t, .; AN ORDINANCE AMENDING SECTIONS 35-56(b), 35-56(g) and 35- 56(h) OF CHAPTER 35 OF THE CODE OF THE CITY OF FORT WORTH (1986), AS AMENDED, BY REVISING AND ADDING CERTAIN RATES AND CHARGES, MAKING THIS ORDINANCE CUMU-LATIVE OF PRIOR ORDINANCES, REPEALING ALL ORDINANCES AND PROVISIONS OF THE FORT WORTH CITY CODE IN CONFLICT HEREWITH, PROVIDING A SAVINGS CLAUSE, PROVIDING A SEVERABILITY CLAUSE, AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH. SECTION 1. SECTION 2 That Section 35-56(g) of Chapter 35 of the Code of the Crty of Fort Worth (1986), as amended, is hereby amended to be and read as follows (g) The following schedule of rates per month, or fraction thereof, shall be the charges to all wholesale customers the furnishing water to such customers RATE FOR WHOLESALE WATER SERVICE Volume ($/1,000 gallons)* $0.3750 Maximum Day ($/MGD excess) $79,545 Maximum Hour ($/MGD excess) $ 0 Customer ($/Meter/Month) $ 25 00 *plus raw water cost SECTION 3 That Section 35-56(h) of Chapter 35 of the Code of the City of Fort Worth (1986) as amended, is hereby amended to be and read as follows (h) the following schedule of rates per month, or fraction thereof, shall be the charges to all wholesale customers for furnishing wastewater services to such customers RATE FOR WHOLESALE WASTEWATER SERVICE Volume ($/1,000 gallons) $0 5956 BOD ($/pound) $0.2093 TSS ($/pound) $0 1565 Customer ($/month) $ 75 00 SECTION 4. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are m direct conflict with the provisions of such ordinance and such Code, m which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 5. It is hereby declared to be the intention of the Crty Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid~udgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation m this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 6. This ordinance shall take effect and be in full force and effect for usage from and after October 1, 1999, and rt is so ordained.
