AN ORDINANCE VACATING, ABANDONING, CLOSING AND
EXTINGUISHING INGRESS-EGRESS AND MISCELLANEOUS UTILITY
EASEMENTS IN SUMMERFIELDS ADDITION, TO THE CITY OF FORT
WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
SECTION 1
THAT the following easements, as more specifically described in Exhibit A
attached hereto and incorporated herein by reference, be and the same are vacated,
abandoned and permanently closed and extinguished
^ Item 1 a 26 foot emergency access and utility easement containing
approximately 18,250 square feet of land in Lots 2, 3 & 4, Block 152,
Summerfields Addition as recorded in Volume 388/202, Page 21, Tarrant
County Plat Records
^ Item 2 a 5 foot by 10 foot utility easement containing 50 square feet in Lot 3,
Block 152, Summerfields Addition as recorded in Volume 8872, Page 796, of
the Tarrant County Deed Records

^ Item 3 a 5 foot by 10 foot utility easement containing 50 square feet in Lot 4,
Block 152, Summerfields Addition as recorded in Volume 8872, Page 796, of
the Tarrant Gounty Deed Records
^ Item 4 a 10 foot by 15 foot utility easement containing 150 square feet in Lot
4, Block 152, Summerfields Addition as recorded in Volume 8872, Page 796
of the Tarrant County Deed Records
^ Item 5 a 10 foot by 717 15 foot water easement containing 7,175 square feet
of land equally in Lots 2, 3 & 4, Block 152 Summerfields Addition as recorded
in Volume 388/202, Page 21 Tarrant County Plat Records and in a tract of
land deeded to Randall's Properties as recorded in Volume 12814, Page 442,
of the Tarrant County Deed Records
SECTION 2.
That the fee to the land in the above described easements is hereby released
and shall revert to the adjacent owner as provided by law
SECTION 3
That al{ ordinances or parts of ordinances in conflict herewith are hereby
repealed

SECTION 4.
That this ordinance shall take effect and be in full force and effect from and after
the date of the date of its passage, and it is so ordained

COMMENCING at a 5/8 inch iron rod found at the southwest corner of said Lot 2, said point

RECOMMENDATION
It is recommended that the City Council adopt the attached ordinance vacating the following
easements
• Item 1 - A 26-foot emergency access and utility easement containing approximately 18,250
square feet of land in Lots 2, 3 and 4, Block 152, Summerfields Addition as recorded in Volume
388/202, Page 21, Tarrant County Plat Records,
• Item 2 - A 5-foot by 10-foot utility easement containing 50 square feet in Lot 3, Block 152,
Summerfields Addition as recorded in Volume 8872, Page 796 of the Tarrant County Deed
Records,
• Item 3 - A 5-foot by 10-foot utility easement containing 50 square feet in Lot 4, Block 152,
Summerfields Addition as recorded in Volume 8872, Page 796 of the Tarrant County Deed
Records,
• Item 4 - A 10-foot by 15-foot utility easement containing 150 square feet in Lot 4, Block 152,

DISCUSSION
Randall's Properties, Inc. has requested the vacation of this improved private ingress-egress access
easement and utility easements to allow for the construction of a grocery store Reviewing City
departments and public utility companies have raised no objection to this request. On July 28, 1999,
the Plan Commission recommended approval of this request. Are-plat has been filed with the City for
approval
