"FOOD ESTABLISHMENTS" DIVISION 3 "REGULATION OF SANITATION" BY THE ADDITION OF SECTION 16-125 "ROADSIDE VENDING" PROVIDING THAT ROADSIDE VENDING OF UNPROCESSED POTENTIALLY HAZARDOUS FOOD IS PROHIBITED; BY THE AMENDMENT OF ARTICLE IV. "FOOD ESTABLISHMENTS" DIVISION 4 "REQUIREMENTS FOR CERTAIN ESTABLISHMENTS", SECTION 16-131 `MOBILE FOOD UNITS" SUBSECTION (C) PROVIDING THAT ALL MOBILE FOOD UNITS HANDLING POTENTIALLY HAZARDOUS FOOD SHALL REPORT AT LEAST ONCE A DAY TO THEIR COMMISSARY TO CLEAN AND SERVICE THE UNIT; BY THE AMENDMENT OF ARTICLE IV. "FOOD ESTABLISHMENTS" DIVISION 4 "REQUIREMENTS FOR CERTAIN ESTABLISHMENTS", SECTION 16-131 "MOBILE FOOD UNITS" BY THE ADDITION OF SUBSECTION (I) PROVIDING THAT SEASONALLY OR ANNUALLY PERMITTED MOBILE UNITS THAT OPERATE AT THE SAME LOCATION THROUGHOUT THE DAY SHALL EITHER PROVIDE A SANITARY RESTROOM FACILITY BUILT IN THE MOBILE UNIT OR THE MOBILE UNIT SHALL BE WITHIN 300 FEET OF A COMMERCIALLY PLUMBED RESTROOM, BY THE AMENDMENT OF ARTICLE IV. "FOOD ESTABLISHMENTS" DIVISION ~ 4 "REQUIREMENTS FOR CERTAIN ESTABLISHMENTS", SECTION 16-131 "MOBILE FOOD UNITS" BY THE ADDITION OF SUBSECTION (.i) PROVIDING THAT ,~ TIEIE OWNER OR OPERATOR OF A MOBILE FOOD UNIT COMMITS AN OFFENSE IF THE MOBILE FOOD UNIT IS OPERATED IN VIOLATION OF ANY PROVISION OF THIS SECTION; BY THE AMENDMENT OF ARTICLE IV., "FOOD ESTABLISHMENTS" DIVISION 5 "FOOD MANAGERS AND FOOD HANDLERS" SECTION 16-140 "FOOD MANAGER CERTIFICATION" PROVIDING THAT ALL CERTIFIED FOOD MANAGERS SHALL OBTAIN A CITY OF FORT WORTH CERTIFIED FOOD MANAGER CERTIFICATE AND THAT SUCH CIERTIFICATE SHALL BE VALID FOR THE SAME TIME AS THE TEXAS DEPARTMENT OF HEALTH FOOD MANAGER CERTIFICATE, AND PROVIDING THAT A PERSON COMMITS Alv OFFENSE IF THE PERSON FAILS TO OBTAIN OR FAILS Ollt REFUSES TO SHOW A FOOD MANAGERS CERTIFICATE FROM THE TEXAS DEPARTMENT OF HEALTH AND THE Cl[TY OF FORT WORTH PUBLIC HEALTH DEPARTMENT; BY THE AMENDMENT , OF ARTICLE IV., "FOOD ESTABLISHMENTS" DIVISION 5 "FOOD MANAGERS AND FOOD HANDLERS" SECTION 16-141 "FOOD HANDLER CERTIFICATION" SUBSECTION (D) PROVIDING THAT A FOOD HANDLER CERTIFICATE SHALL BE VALID FOR TWO YEARS FROM THE DATE OF FOOD HANDLER TRAINING; BY TI3E AMENDMENT OF ARTICLE XVIL, "DAY CARE CENTERS" SECTION 16-435 "CHILD CARE WORKER CERTIFICATE REQUIRED" SUBSECTION (D) PROVIDING THAT A CHILD CARE WORKER CERTIFICATE SHALL BE VALID FOR TWO YEARS FROM THE DATE OF ITS ISSUANCE UNLESS REVOKED;BY THE AMENDMENT OF ARTICLE XVIII. "P'UBLIC SWIMMING POOLS" SECTION 16-463 "CERTIFIED POOL OPERATORS" SUBSECTION (C) IS DELETED; PROVIDING THAT THIS ORDINANCE IS CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A FINE OF Ul' TO $2,000 FOR EACH OFFENSE IN VIOLATION OF THE Ol[tDINANCE; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER OF THE CITY AND PROVIDING AN EFFECTIVE DATE. BI+; IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Chapter 16, "Health and Sanitation", Article IV., "Food Establishments", Division 1. "General Provisions", section 16-101 "Definitions" of the Code of the Crty of Fort Worth (1986), as amended, is hereby further amended by the amendment of the introductory statement which shall be and read as follows. Sec 16-101 Definitions. "Unless a provision exphcrtly states otherwise, the following terms and phrases, as used m this article, shall have the meanings hereinafter designated. If a word or term used m this article is not contained m the following list, it shall have the definition provided for such word or term in Chapter 25 of the Texas Administrative Code" Further, Chapter 16, "Health and Sanitation", Article IV., "Food Establishments", Division ll "General Provisions", section 16-101 "Definitions" of the Code of the City of Fort Worth (1986), as amended, is hereby further amended by the amendment of the definition of "beverage" which shall be and read as follows: "Beverage means a liquid for dnnkmg, including water " Further, Chapter 16, "Health and Sanitation", Article IV., "Food Establishments", Division 1. "General Provisions", section 16-101 "Definitions" of the Code of the City of Fort Worth (1986), as amended, is hereby further amended by the amendment of the definition of "food" which shall be and read as follows: "Food means any raw, cooked, or processed edible substance, ice, beverage, or ingredient used or intended for use or for sale in whole or in part for human consumption, or chewing gum." Further, Chapter 16, "Health and Sanitation", Article IV., "Food Establishments", Division l "General Provisions", section 16-101 "Definitions" of the Code of the City of Fort Worl:h (1986), as amended, is hereby further amended by the amendment of the definition of "potentially hazardous food" which shall be and read as follows. i ,. "Potentially hazardous food means a food that is natural or synthetic and that requires temperature control because it is in a form capable of supporting the rapid and progressive growth of infectious or toxigenic microorganisms, the growth and toxin production of Clostridium botulism, or in raw shell eggs, the growth of Salmonella ententidis." Further, Chapter 16, "Health -and Sanitation", Article IV., "Food Establishments", Division 1 "General Provisions", section 16-101 "Definitions" of the Code of the City of Fort Worth (1986), as amended, is hereby further amended by the amendment of the definition of " sanitizer" which shall be and read as follows. "Sanitizer means the application of cumulative heat or chemicals on cleaned food-contact surfaces that, when evaluated for efficacy, yield a reduction of 5 logs, which is equal to a 99 999% reduction of representative disease microorganisms of public health importance." Further, Chapter 16, "Health and Sanitation", Article IV., "Food Establishments", Division 1. "General Provisions", section 16-101 "Definitions" of the Code of the City of Fort Worth (1986), as amended, is hereby further amended by the amendment of the definition of " single-service articles" which shall be and read as follows. "Single-service articles means tableware, carry-out utensils, and other items such as bags, containers, placemats, stirrers, straws, toothpicks, and wrappers that are designed and constructed for one time, one person use." Further, Chapter 16, "Health and Sanitation", Article N., "Food Establishments", Division 1 "General Provisions", section 16-101 "Definitions" of the Code of the City of Fort Wori:h (1986), as amended, is hereby further amended by the amendment of the definition of "utensils" which shall be and read as follows. "Utensil means any food-contact implement or container used m the storage, preparation, transportation, dispensing, sale, or service of food, suc;h as kitchenware or tableware that is multi-use, single-service, or single-use; glove used in contact with food, and food temperature measuring devices." Further, Chapter 16, "Health and Sanitation", Article N., "Food Establishments", Division 3 "Regulation of Sanitation", section 16-121 "State Laws Adopted" of the Code of the City of Fort Worth (1986), as amended, is hereby further amended changing the title and such section shall be amended and read as follows: "Section 16-121 State laws and Regulations Adopted. (a) The following statutes, in their current form and as they may hereafter be amended, are adopted and incorporated into this article as if they were set forth at length herein. (1) The "Texas Food, Drug and Cosmetic Act," Texas Health and Safety Code, Chapter 431 (2) The "Mminium Standards of Sanitation and Health Protection Measures," Texas Health and Safety Code, Chapter 341 (I~) The following regulations adopted by the Texas board of health, in their current form and as they may hereafter be amended, are adopted and incorporated into this article as if they were set forth at length herein. If there is a conflict between a rule and any section of this article, the more restnchve provision shall apply (1) The "Sanitary Rules for Food and Drug Establishments," 25 Texas Administrative Code, §§ 229 41, et seq (2) The rules for "Texas Food Establishments Rules," 25 Texas Administrative Code, §§ 229 161, et seq (c.) The director will assure that a current copy of each rules manual will be kept on file in the office of the city secretary (d) A food establishment's owner, manager or operator commits an offense if an employee, owner, manager, or operator of the food establishment violates a rule adopted pursuant to subsection (b) Further, Chapter 16, "Health and Sanitation", Article IV., "Food Establishments", Division 3 "Regulation of Sanitation", by the addition of section 16-125 "Roadside Vending" of the Code of the City of Fort Worth (1986), as amended, and read as follows: "Section 16-125 Roadside Vendm~ (a) Roadside vending of unprocessed potentially hazardous food is prohibited. (b;) A person commits an offense if the person violates subsection (a) " Further, Chapter 16, "Health and Sanitation", Article IV., "Food Establishments", Division 4 "Requirements for Certain Establishments", section 16-131 "Mobile Food Units" subsection (c) of the Code of the City of Fort Worth (1986), as amended, is hereby further amended and shall read as follows. "(c) Commissary All mobile food units handling open potentially hazardous foods, catering units and pushcarts shall operate from a commissary or other fixed food service establishments that are regularly inspected by a regulatory health agency All mobile food amts handling potentially hazardous foods shall report at least once a day to their commissary to clean and service the mobile unit." Further, Chapter 16, "Health and Sanitation", Article IV., "Food Establishments", Division 4 "Requirements for Certain Establishments", section 16-131 "Mobile Food Units" subsection (i) of the Code of the City of Fort Worth (1986), as amended, is hereby further amended and shall read as follows. "(i) A.11 seasonally or annually pernutted mobile amts that operate at the same lacation throughout the day shall either (i) provide a sanitary restroom facility built in the mobile unit; or (2) be within 300 feet of a commercially plumbed restroom." Further, Chapter 16, "Health and Sanitation", Article IV , "Food Establishments", Division 4 "Requirements for Certain Establishments", section 16-131 "Mobile Food Units" of the Code of the City of Fort Worth (1986), as amended, is hereby further amended by the addition of subsection (j) and shall read as follows. "(j;) The owner or operator of a mobile food amt commits an offense if the mobile food amt is operated m violation of any provision of this section." Further, Chapter 16, "Health and Sanitation", Article N., "Food Establishments", Division 5 "Food Managers and Food Handlers", section 16-140 "Food Manager certificatian" subsection (c) of the Code of the City of Fort Worth (1986), as amended, is hereby further amended and shall read as follows. "(c) A certified food manager shall apply to the City of Fort Worth health department for a City of Fort Worth food manager's certificate. A City of Fort Worth's food manager's certificate is valid for the same time penod as the certified food manager certificate issued by the Texas Department of Health. Further, Chapter 16, "Health and Sanitation"; Article IV , "Food Establishments", Division 5 "Food Managers and Food Handlers", section 16-140 "Food Manager certification" subsection (i)(2) of the Code of the City of Fort Worth (1986), as amended, is hereby further amended and shall read as follows. " (i)(2) .A person commits an offense if the person is the food manager of a food establishment and fails to obtain a food manager certificate from the Texas Department of Health and the City of Fort Worth Public Health Department." Further, Chapter 16, "Health and Sanitation", Article IV., "Food Establishments", Division 5 "Food Managers and Food Handlers", section 16-140 "Food Manager certification" of the Code of the City of Fort Worth (1986), as amended, is hereby further amended by the addition of subsection (i)(3)and shall read as follows. "(i)(3) A person commits an offense if the person is the food manager of a food establishment and fails or refuses to present his/her food manager's certificate issued by the Texas Department of Health and the City of Fort Worth Public Health Department to the director for inspection immediately upon the director's request." Further, Chapter 16, "Health and Sanitation", Article IV , "Food Establishments", Division 5 "Food Managers and Food Handlers", section 16-141 "Food Handler Certification" subsection (d) of the Code of the Crty of Fort Worth (1986), as amended, is hereby furl:her amended and shall read as follows. "(d.) Food handler certificates are valid for two (2) years from the date of foad handler training. A food handler may renew his/her certificate pnor to ~.ts expiration by attending a food handler class." Further, Chapter 16, "Health and Sanitation", Article XVIL, "Day Care Centers", section 16-435 "Child care worker certificate required" subsection (d) of the Code of the City of Fort Worth (1986), as amended, is hereby further amended and shall read as follows. "(d) A child care worker certificate shall be valid for two (2) years from the date of its issuance unless revoked as provided hereunder Application by a certificate holder for a new certificate shall be made pnor to irr~pendmg expiration of the certificate m the manner described above m section 16-435(c)." Further, Chapter 16, "Health and Samtahon", Article XVIII. "Public Swimming Pools" Section 16-463 "Certified pool operators" subsection (c) of the Code of the City of Fort Worth (1986), as amended, is hereby deleted and such section's subsections are hereby renumbered. SECTION 2. Thas ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are m direct conflict with the provisions of such ordinances and such Code, m which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent ~unsdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation m this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4 Any person, firm or corporation, who violates, disobeys, oriuts, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($2,000 00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 5. All nghts and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of the ordinances amended m Section 1, which have accrued at the tune of the effective date of this ordinance and, as to such accrued violations and all pending litigation, both civil and crunmal, whether pending m court or not, under such ordirAances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 6. The City Secretary of the City of Fort Worth, Texas, is hereby directed to publish the caption and Section 4 of this ordinance for two (2) days in the official newspaper of the City of Fort Worth, Texas, as authonzed by Section 2, Chapter XXV of the Charter of the City of Fort Worth, Texas and by Section 52.013, Texas Local Government Code. SECTION 7. TYns ordinance shall be in full force and effect after its passage and upon publication as required by law, and it is so ordained. Approve the attached Consumer Health Fee Schedule. DISCUSSION The Texas Board of Health adopted new food safety guidelines. These new rules went into effect on October 6, 1998 The new rules replace more subjective food safety standards, which had been in effect since 197'7 The new rules establish new minimum food safety standards for all food facilities in Texas and closely parallel the Federal Food and Drug Administration's 1997 Food Code. The Federal 1997 Food Codle is the recommended minimum food safety standard for the nation The federal standards are scientifically based and are designed to prevent food-borne illnesses. These new rules are adopted in the attached ordinance 1n addition to adopting the new Texas Food Establishment Rules, the attached ordinance contains changes to they existing Fort Worth Food Establishment Code to improve existing food safety requirements.
