SUBJECT ORDINANCE REVISING CHAPTER 16 "HEALTH AND SANITATION" OF THE CITY
CODE AND CONSUMER HEALTH FEE SCHEDULE
RECOMMENDATION
It is recommended that the City Council
1 Adopt the attached ordinance revising Chapter 16 "Health and Sanitation" of the City Code, and
2. Approve the attached Consumer Health Fee Schedule.
DISCUSSION
The Texas Board of Health adopted new food safety guidelines. These new rules went into effect on
October 6, 1998 The new rules replace more subjective food safety standards, which had been in
effect since 197'7 The new rules establish new minimum food safety standards for all food facilities in
Texas and closely parallel the Federal Food and Drug Administration's 1997 Food Code. The Federal
1997 Food Codle is the recommended minimum food safety standard for the nation The federal
standards are scientifically based and are designed to prevent food-borne illnesses. These new rules
are adopted in the attached ordinance
1n addition to adopting the new Texas Food Establishment Rules, the attached ordinance contains
changes to they existing Fort Worth Food Establishment Code to improve existing food safety
requirements. Changes include
• Revising definitions to correspond to state regulations,
• Assigning responsibility for ensuring compliance with food rules,
• Requiring all certified food managers to apply fora "Fort Worth Food Manager's Certificate",
• Prohibiting roadside vending of all unprocessed potentially hazardous foods,
• Requiringi all seasonally or annually permitted mobile vending units handling potentially
hazardous foods to be serviced daily at their commissary;
• Requiringi all seasonally or annually permitted mobile units that operate at the same location
throughout the day to either provide a sanitary restroom built in the mobile unit, or be within 300
feet of a commercially plumbed restroom,
• Providing that food handler certificates are valid for two years from the date of food handler
training,
• Providing that a child care worker certificate is valid for two years, and
• Deleting t:he provision regarding the challenge exam for certified pool operation
The attached feE~ schedule increases the six-month seasonal permit fee from $75 to $100, which is one
half of the annual permit fee The increase in the re-issuance fee is consistent with reinstatement fees
of other cities grid will further reduce late payments for permits Pool, spa, hotel and motel permit fees
have not been adjusted since 1987 The increases in pool operator class fee, mobile vendor vehicle
fee, temporary ;>tand fee, document replacement and rule book fee reflect higher costs of operation
The fee increases will offset the costs of implementing more stringent state rules and improving the
level of industry. compliance with minimum food safety standards and public swimming pool and spa
standards. _
