HomeMy WebLinkAboutOrdinance 13949Ordinance No.~,q~,,,,_, AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL ASSESSMENT DISTRICT FUND IN THE AMOUNT OF 5604,750 FROM AVAILABLE FUNDS FOR THE PURPOSE OF PROVIDING FISCAL YEAR 1999-2000 FUNDING FOR IMPROVEMENT DISTRICT NO. 1; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for the Fiscal Year 1999- 2000 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriation:> in the Special Assessment District Fund in the amount of $604,7S0 00 from available funds for the purpose of providing fiscal year 1999-2000 funding for Improvement District No 1 SECTION 2. Should any portYOn, section or part of a section of this ordinance be declared invalid, inoperative or void for any mason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way unpavr the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No 13617 and all other ordmances and appropriations amending the same except in those instances where the provisions of this ordinance aze indirect conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect and be in full force and effect from and after the date of rts passage, and it is so ordained. Close the benefit hearing, and 3 Adopt the attached ordinance which levies the proposed assessments, and 4 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations by $604,750 in the Special Assessment District Fund from available funds. DISCUSSION On September 7, 1999, the City Council adopted M&C G-12655 which directed that certain improvements and/or services (the "Improvements") shall be provided in PID 1 during the 1999-2000 fiscal year It also adopted the proposed assessment roil and provided notice of this benefit hearing The improvements to be provided and the costs thereof are: Total Cost To Be Assessed Maintenance and Landscaping Program $543,924 $335,652 Promotions Program 46,950 28,973 Marketing Program 67,500 41,654 Security Program 23,165 14,295 Transportation and Parking Program 89,642 55,318 City Administration Fee 5,000 5,000 Management Program 20_ 3,$13 12~85~ TOTAL $979,994 $604,750 The $375,244 difference between total costs and assessments includes $233,144 in direct payments from the City, $122,100 in revenues from district activities and $20,000 from other miscellaneous revenue sources, including the use of district reserve funds, if necessary ~,r t ~t City of Fort Worth, Texas n-~uycfr And Caunc~l Cammun~cAt~an DATE 9/28/99 REFERENCE NUMBER BH-193 LOG NAME 13PID1 PAGE 2 of 2 SUBJECT ADOPTION OF APPROPRIATION ORDINANCE AND BENEFIT HEARING FOR FORT WORTH PUBLIC IMPROVEMENT DISTRICT NO 1 AND LEVYING OF ASSESSMENTS FOR FISCAL YEAR 1999-2000 All costs of improvements shall be assessed against private property located in the district and the owners of the property The City Manager has filed with the City Secretary a proposed assessment roll and an estimate of the assessments against each parcel Based on the appraised value of the property, and considering the benefits to be received from the proposed improvements, it is the opinion of the City staff that each parcel of property will be enhanced in value by an amount equal to, or more than the proposed assessments upon completion of the improvements in accordance with the contract.
