AN ORDINANCE ADJUSTING THE TOTAL NUMBER OF AUTHORIZED CIVIL SERVICE POSITIONS AT THE OFFICER CLASSIFICATION IN THE POLICE DEPARTMENT; CREATING ONE ADDITIONAL POLICE OFFICER POSITION; PROVIDING A STATEMENT OF PURPOSE ANA INTENT FOR THE ADOPTION OF THIS ORDINANCE; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT OF THIS ORDINANCE; AND PROVIDING AN EFFECTIVE DATE. BE IT HEREBY KNOWN: WHEREAS, the Police Chief has requested the City Council to readjust and thereafter specify the total number of authorized civil service positions at the officer classification in the Police Department for the remainder of the 1998-1999 Fiscal Year, and WHEREAS, the City's most recent ordinance concerning the authorized and budgeted positions for the Police Department adjusted the Department's civil service staffing as follows. Deputy Chief 5 Captain 12 Lieutenant 46 Sergeant 124 Corporal/Detective 188 Police Officer 821 TOTAL 1,196 WHEREAS, the Police Chief now requests the Council to adjust the authorized number of Police Department civil service positions into conformity with the proposed changes as set forth immediately below in order to effect efficient economy of the operations of the Police Department; and WHEREAS, pursuant to Chapter 143 021(a), Texas Local Government Code, the City Council may prescribe and/or adjust the authorized number of positions in the officer classification (rank) by ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That, effective immediately upon the formal adoption of this ordinance, the following positions shall be the only civil service positions authorized in the City of Fort Worth Police Department for the remainder of the fiscal year 1998-1999 or until modified by subsequent ordinance Deputy Chief 5 Captain 12 Lieutenant 46 Sergeant 124 Corporal/Detective 188 Police Officer 822 TOTAL 1,197 SECTION 2. The "Mayor and Council Communication" memorandum which is presented contemporaneously with this ordinance is hereby expressly incorporated herein by reference for further clarification and explanation of the purposes and intent of the Council in their adoption of this ordinance In addition, it is expressly stated that this ordinance serves only to adjust the total number of police officer positions 2 ~ T SECTION 3 This ordinance shall be cumulative of all provisions of previous ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of prior civil service staffing ordinances for the Police Department and such Code, in which event conflicting provisions of such ordinan- ces and such Code provisions are hereby repealed SECTION 4 It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconsti- tutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section SECTION 5 The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption and effective date in the minutes of the City Council and by filing the ordinance in the ordinance records of the City 3 ;: SECTION 6 This ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained APPROVED AS TO FORM AND LEGALITY c City At~brney q ~J ' Date ~ ~ ~ ~ ` ( - ADOPTED: ~~ L~ ` ~I "I EFFECTIVE ~" ~ `~~ 4 City of Fort Worth, Texas ~I~A~~~ And ~,~unc~l Cammun~cAt~an DATE REFERENCE NUMBER LOG NAME PAGE 7/6/99 G-12600 35STAFF 1 of 2 SUBJECT ORDINANCE AUTHORIZING CIVIL SERVICE STAFFING FOR THE POLICE DEPARTMENT RECOMMENDATION It is recommended that the City Council adopt the attached ordinance specifying the authorized positions in the Police Department, increasing by one the number of authorized police officer positions DISCUSSION The proposed increase in the Police Department's authorized strength is due to the adoption of Council Proposal No 208 on April 13, 1999, which provides 2,080 hours of annual leave time for the individual who serves as the Fort Worth Police Officers Association (FWPOA) president. This policy also provides that the FWPOA will reimburse the City for the base pay of the FWPOA president. The leave tune granted to the FWPOA president by this policy reduces the effective strength of the Police Department by one police officer position It is necessary to increase the authorized number of police officer positions to maintain the department's existing staffing level Because the FWPOA is reimbursing the base salary of the POA president, the salary of this additional officer is offset by the reimbursement. Benefits for this additional officer position, including group health, retirement contribution, Medicare, and civil service uniform allowance amount to $7,182 annually in City funds, which will be included in the FY 1999-2000 budget.
