HomeMy WebLinkAboutOrdinance 13765 Ordinance No.~~~ AN ORDINANCE INCREASING THE ESTIMATED RECEII'TS AND APPROPRIATIONS IN THE GRANT FUND IN THE AMOUNT OF $737,948.00 SUBJECT TO THE RECEIPT OF THE GRANT FROM THE TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS FOR THE PURPOSE OF FUNDING THE COMPREHENSIVE ENERGY ASSISTANCE PROGRAM, PROVIDING FORA SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1998-99 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $737,948.00 subject to the receipt of the grant from the Texas Department of Housing and Community Affairs for the purpose of funding the Comprehensive Energy Assistance Program. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of secfions of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No. 13540 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect and be in full force and effect after the date of its passage, and it is so ordained. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the Grants Fund by $737,948, and 3 Apply indirect cost rates in accordance with the City's Administrative Regulation 3-15 at a rate of 25.52%, which is the most recently approved rate for this department, and apply the new, approved rate when available. DISCUSSION On December 9, 1997 (M&C G-12079), the City Council approved an anticipated contract amount of $796,640 with the TDHCA Comprehensive Energy Assistance Program (CEAP) The final contract award accepted by City Secretary Contract No 23755 was in the amount of $692,477 In July 1998, TDHCA notified the City that its 1998 CEAP allocation had been increased by $1,661,442. This increase was to address the extreme heat wave and energy crisis that resulted in President Clinton declaring the entire state of Texas a disaster area. In order to ameliorate these conditions, the release of emergency Low-Income Home Energy Assistance Program funds were authorized for administration through the TDHCA. This increase resulted in a total amount of $2,353,919 for the 1998 allocation The current year (1999) anticipated contract amount is $737,948 The CEAP for contract year 1999 has six components. 1) Elderly/Disabled, 2) Energy Crisis, 3) Co- Payment, 4) Heating and Cooling Systems, 5) Direct Service Support and 6) Case Management. The allocation is being made to address the need of low-to-moderate income households in Tarrant County who are paying a disproportionate amount of their income to meet the increase in their utility bills that have resulted from the marked increase in the temperature. All households at or below 125% of the federal poverty level will be afforded access to the program All applicant households will be determined eligible according to the income guidelines and program procedures. Benefit determinations include the household's income, the household size, the energy consumption° and/or the vulnerability of the household and the availability of funds. The Parks and Community Services Department will review all applications at the nine City-operated Neighborhood Resources Development Program Center facilities. This program is located in all Council Districts.
