Ordinance No. 3
AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE
GRANTS FUND IN THE AMOUNT OF $112,580 00 SUBJECT TO THE RECEIl'T OF AN EXECUTED
CONTRACT WITH THE TEXAS NATURAL RESOURCE CONSERVATION COMMISSION, AND IN
THE AMOUNT OF $55,450 00 FROM THE GENERAL FUND, UPON RECEIPT OF THE EXECUTED
CONTRACT, AS THE CITY'S IN-KIND MATCH, FOR THE PURPOSE OF FUNDING AN AIR
POLLUTION CONTROL PROGRAM, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING
THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR
ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS
SECTION 1
That in addition to those amounts allocated to the various City departments for the Fiscal Year 1999-00 and in the Budget of
the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the mount of
$112,580 00 subject to the receipt of an executed contract with the Natural Resource Conservation Commission, and in the
amount of $55,450 00 from the Generat Fund, upon receipt of the executed contract, as the City's in-kind match, for the
purpose of funding an air pollution control program.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared mvalid, inoperative or void for any reason by
a court of competent jurisdiction, such decision, opinion or Judgment shall in no way impair the remaining portions, sections,
or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3
That this ordinance shall be cumulative of Ordinance No 13540 and all other ordinances and appropriafions amending the
same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and
appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly
repealed.
SECTION 4
This ordinance shall take effect and be in full force and effect after the date of its passage, and it is so ordained.

PROGRAM AND APPROPRIATION ORDINANCE
RECOMMENDATION
It is recommended that the City Council
Authorize the City Manager to execute an agreement with the Texas Natural Resource
Conservation Commission (TNRCC) in the amount of $112,580 to conduct an air pollution control
program, to include a complaint handling system, investigation, and enforcement for outdoor air
pollution during the period September 1, 1999, through August 31, 2000, and
2. Authorize anon-interest bearing inter-fund loan from the Environmental Management Fund to the
Grants Fund in the amount of $28,145 for interim financing of 25% of this project pending contract
execution, and
3 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Grants Fund by $168,030, subject to receipt of an executed contract; and
4 Authorize the use of $55,450 in the General Fund as an in-kind match for this contract.
DISCUSSION
Since FY 1991-1992, the City has entered into an .annual contract with the TNRCC for the City to
provide certain air-pollution control services within Fort Worth The services provided include complaint
investigation, new source review and comment, annual inspections at volatile organic compound
sources, used car emission inspections, and Stage II vapor recovery system inspections at area gas
stations
The City must provide matching funds so that the combined federal and state share of the total funding
for the City's air pollution control program does not exceed 67% The matching funds must be allocated
for federal air pollution grants A portion of the $191,660 air quality section budget proposed for FY
1999-2000 will be used as the required in-kind match
No City funds will be expended before the contract is approved Upon approval and acceptance of the
contract, City funds will be expended before receipt of contract funds

FISCAL INFORMATION/CERTIFICATION
The Finance Director certifies that upon approval of the above recommendations, adoption of the
attached appropriation ordinance, and execution of a contract, funds will be available in the current
operating budget, as appropriated, in the Grants Fund Upon execution of the grant contract, the inter-
fund loan of $28,145 will be returned to the Environmental Management Fund
