HomeMy WebLinkAboutOrdinance 13879F~!i, ~~• ~-~ Ordinance No.~~~- AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $56,000 00 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING AN INTERLOCAL AGREEMENT WITH THE TEXAS NATURAL RESOURCE CONSERVATION COMMISSION FOR OPERATION OF SEVEN PM 2.5 AIR POLLUTION MONITORING STATIONS, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1999-00 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $56,000 00 from available funds for the purpose of funding an interlocal agreement with the Texas Natural Resource Conservation Comrnission for operation of seven PM 2.5 air pollution monitoring stations. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 13540 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect and be in full force and effect after the date of its passage, and it is so ordained. Authorize anon-interest bearing inter-fund loan from the Environmental Management Fund to the Grants Fund in the amount of $14,000 for interim financing of 25% of the project pending contract execution, and 3 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund by $56,000 DISCUSSION In 1998, the US Environmental Protection Agency (EPA) revised its measurement standards for particulate matter (PM) emitted into the atmosphere New monitoring equipment was necessary to perform the required testing The TNRCC provided the equipment for four PM monitoring stations and related supplies, and is contracting with the City of Fort Worth for the operation and maintenance of this monitoring equipment, as well as for an additional three monitors to be located as follows. • Fire Station No 1 at 120 North Pecan • Environmental Resource Center at 5000 Martin Luther King Freeway • Diamond Hill Community Center at 1701 NE 37th Street The City of Fort Worth will be responsible for retrieving the sampling data, sending it for analysis, and performing regular maintenance activities on the equipment.
