A ORDINANCE AMENDING CITY OF FORT WORTH
ORDINANCE NO. 13471 BY AMENDING ATTACHMENT 1;
PROVIDING A SEVERABILITY CLAUSE; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS, THAT:
Section 1
Section I of Attachment 1 to City of Fort Worth Ordinance No 13471 is hereby
amended by adding a definition for "Combined contract", which definition shall be and
read as follows
" 30 "Combined Contract" means a construction contract which
includes paving and/or drainage elements of construction AND water
and/or sanitary sewer construction elements, but does not include a
standard water and/or sanitary sewer contract where the pavement is
temporarily or permanently repaired and that repair is not a separate unit.
Section 2
Attachment 1 to City of Fort Worth Ordinance No 13471 is hereby amended by
adding a new XII, which shall be and read as follows
XII. COMBINED CONTRACTS
A. For Combined Contracts, the offeror shall list all first and second tier
subcontracting and/or supplier opportunities.
B All other provisions of this Attachment 1 apply to Combined Contracts.
Section 3
Paragraph 4 of Article III, Counting MBE/WBE Participation is amended to be
and read as follows
4 Documentation required under either paragraph 2 or 3 above must be
received by the Managing Department within five (5) City business
days, exclusive of the date that the offeror was ruled non-responsive. If
the documentation is not received within the stated time, the offeror
shall be deemed to have withdrawn its bid. The Crty will not
communicate with another offeror regarding award of the contract
until five (5) Crty business days after the original offer has been ruled
non-responsive.

Section 4
That this ordinance shall be cumulative of all provisions of ordinances and of the
Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions
of this ordinance are in direct conflict with the provisions of such ordinances and such
Code, in which event conflicting provisions of such ordinances and such Code are hereby
repealed.
Section 5
It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clause and phrases of this ordinance are severable, and, if any
phrase, clause, sentence, paragraph, or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent ~unsdiction,
such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences,
paragraphs, or sections of this ordinance, since the same would have been enacted by the
Crty Council without the incorporation m this ordinance of any unconstrtuhonal phrase,
clause, sentence, paragraph, or section.
Section 6
This ordinance shall take effect and be m full force and effect from and after rts
passage, and it is so ordained.

SUBJECT AMEND MINORITY AND WOMEN BUSINESS ENTERPRISE ORDINANCE NO 13471
RECOMMENDATION
It is recommended that the City Council
1 Adopt the attached Ordinance amending the Minority and Women Business Enterprise (M/V1/BE)
Ordinance No 13471, and
2 Extend the review of the current Minority and Women Business Enterprise Ordinance until
September 1999, to allow for the completion of the Availability and Disparity Study and a thorough
review by the City Manager and the Minority and Women Business Enterprise Advisory Committee
(MWBEAC)
DISCUSSION
On February 23, 1999, staff briefed the City Council on the impact of M/WBE participation when street
and/or storm drainage projects are combined with water and/or sanitary sewer projects Staff is
proposing to combine street with water and sewer projects using one prime contractor in an effort to
minimize the impact on neighborhoods, provide scheduling efficiencies and increase completion rates.
However, under the City's current M/WBE Ordinance, combined projects may reduce the M/WBE
participation The recommended amendment will add a definition for these specific projects and require
Good Faith Effort documentation for both first and second tier subcontracting opportunities These
changes will address the M/WBE participation concerns The MWBEAC was briefed by staff in March
1999 and voted to recommend the suggested change to the Ordinance
Due to new appointments to the MWBEAC and additional information needed for the Availability and
Disparity Study, an extension of the Ordinance review is requested
FISCAL INFORMATION/CERTIFICATION
The Finance Director certifies that this action will not have any material effect on City funds
