Ordinance No ' ~J AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $19,210 00 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING AMENDMENT NO 5 TO ENGINEERING AGREEMENT WITH TRANSYSTEMS CORPORATION FOR MAIN M-390 DRAINAGE AREA SANITARY SEWER SYSTEM REHABILITATION AND IMPROVEMENTS PART 4 AND MAIN M-36SR DRAINAGE AREA SANITARY SEWER SYSTEM REHABILITATION PART 7, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1999-00 and in the Budget of the City Manager, there shall also be increased estunated receipts and appropriations in the Water Capital Projects Fund in the amount of $19,210 00 from available funds for the purpose of funding Amendment No. 5 to Engineering Agreement with TranSystems Corporation for Main M-390 Drainage Area Sanitary Sewer System Rehabilitation and Improvements Part 4 and Main M-36SR Drainage Area Sanitary Sewer System Rehabilitation Part 7 SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opuiion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No. 13886 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect and be in full force and effect and after the date of its passage, and it is so ordained APPROVED AS TO FORM AND LEGALITY Assistant i ttorney l ~/l~l Date i©a~-a~5 Adopted ~®-a~ ~ a g Effective City of Fort Worth, Texas n-~Ayar And C,aunc~l C,ammun~cAt~an DATE REFERENCE NUMBER LOG NAME PAGE 10/26/99 **C-17718 30LYNNFIELD 1 of 2 SUBJECT APPROPRIATION ORDINANCE AND AMENDMENT NO 5 TO ENGINEERING AGREEMENT WITH TRANSYSTEMS CORPORATION FOR MAIN M-390 DRAINAGE AREA SANITARY SEWER SYSTEM REHABILITATION AND IMPROVEMENTS (GROUP 6, CONTRACT 1) PART 4 AND MAIN M-36SR DRAINAGE AREA SANITARY SEWER SYSTEM REHABILITATION (GROUP 5, CONTRACT 2) PART 7 RECOMMENDATION It is recommended that the City Council 1 Authorize the City Manager to transfer $19,210 from the Water and Sewer Operating Fund to the Water Capital Project Fund, and 2 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Project Fund in the amount of $19,210 from available funds, and 3 Authorize the City Manager to execute Amendment No 5 to City Secretary Contract No 23247 with TranSystems Corporation in the amount of $19,210 to provide for additional survey and design services, thereby increasing the contract amount to $936,403 DISCUSSION On October 14, 1997 (M&C C-16352), the City Council authorized the City Manager to execute an engineering agreement with TranSystems Corporation in the amount of $791,298 for the preparation of plans and specifications for Main M-390 drainage area sanitary sewer system rehabilitation and improvements (Group 6, Contract 1) Part 4 and Main M-36SR drainage area sanitary sewer system rehabilitation and improvements (Group 5, Contract 2) Part 7 The contract was subsequently revised by four previous amendments totaling $125,895 It has been determined that it is necessary to replace approximately 2,400 linear feet of severely deteriorated water main located within the Main 390, Part 4 drainage area on Lynnfield Drive between Hampshire Boulevard and Ayers Avenue, in conjunction with the replacement of the sewer line on the street.
